Identity politics can be positive or negative. Positive in nature means that it makes an impetus to recognize and accommodate the existence of comparisons, even to the extent of recognizing the predicate or privilege of a region or nation due to a basis that can be understood historically and logically. It is negative when there is a difference between one group and another, for example the domination between the majority and the minority. The validity of voting results depends on various factors, one of which is the completeness and validity of the ballot paper, which is one of the important elements in elections that voters use to mark their choices. Based on the circular letter of the Tanjungpinang City General Election Supervisory Agency (Bawaslu) Number: 136/PM.00.02/K.KR-06/02/2024 there were 2 TPS taking place at TPS 006 and TPS 015 there were 115 x 5 ballot papers that were not signed by KPPS so that the ballot box is open during voting, raising questions regarding its validity and the potential for fraud in the voting process. This research aims to analyze the consequences of not signing the ballot paper and its impact on the validity of the voting results, as well as the conditions for re-voting. The research method that researchers use is normative juridical, namely based on basic legal materials. This research was conducted by examining theories, concepts, legal principles and laws and regulations that are relevant to this research topic. The research results show that there are several factors that cause ballot papers not to be signed, including KPPS negligence, lack of socialization, and misinterpretation of regulations. Thus, re-voting is a step that can be taken to ensure the validity and legitimacy of voting results by considering various factors, including the number of unsigned ballot papers, the potential for fraud, and the impact on democratic stability.

The Recapitulation Information System, known as SIREKAP, launched by the General Election Commission of the Republic of Indonesia, is an election tool based on the latest technology to receive and manage manual vote counting of general election results which are converted into digital data. The Recapitulation Information System (SIREKAP) is the starting point in the process of transitioning election administration from manual to digital, which will ensure that elections in Indonesia can be held effectively and efficiently in the future, so that elections and democracy will look better. Through SIREKAP, this long process can be shortened, costs can be reduced, disputes can be extended and resolved more quickly, and elections can be conducted in a more environmentally friendly manner. However, this has many challenges and risks that must be taken seriously. SIREKAP is also vulnerable to election data security problems due to system hacking or data manipulation which could endanger the integrity of election results, especially in the 2024 General Election for Presidential and Vice Presidential Candidates.

The purpose of the research is to find out the causes of differences in interpretation between the Gorontalo Regency KPU and Bawaslu Gorontalo Regency regarding administrative violations of the 2020 elections in Gorontalo Regency and how the process of resolving administrative violations of the 2020 elections in Gorontalo Regency by the Gorontalo Regency KPU and Bawaslu Gorontalo Regency. This research uses two legal research methods, namely: Normative and empirical legal research to find answers to the differences in interpretation between the KPU and Bawaslu Gorontalo Regency regarding administrative violations of the 2020 Pilkada in Gorontalo Regency. The difference in interpretation between the Regency KPU and Bawaslu Gorontalo Regency regarding administrative violations is caused by overlapping statutory provisions. Where in Law Number 10 Year 201 concerning Pilkada, the two institutions are given the authority to examine and decide administrative violations, then the two institutions in deciding administrative violations have their own guidelines where Bawaslu is guided by Perbawaslu while the KPU itself is guided by KPU Regulations. This certainly does not provide legal certainty for justice seekers in election administration violations and the process of resolving administrative violations in the 2020 Pilkada in Gorontalo Regency, namely through DKPP and Constitutional Court decisions. We do not have to face different decisions between the two institutions because DKPP is an ethical judicial institution while the Constitutional Court is a legal judicial institution. Although there has been a decision from the Constitutional Court, it does not change the DKPP's decision because until now there has been no ethics court to appeal the DKPP's decision.

The act of falsifying documents in general elections is a serious violation of the basic principles of democracy and legal regulations governing the democratic process. In politics, document falsification not only impacts specific individuals or groups, but also substantially undermines the integrity and legitimacy of the democratic process as a whole. From a legal justice perspective, such actions violate the basic principles that should govern the integrity of elections, threatening the foundations of democracy itself. By using fake documents, individuals or groups can manipulate election results in unfair ways, leading to a reduction in public trust in democratic institutions. Moreover, such actions create doubts about the legitimacy and fairness of the election process, which is the main foundation of an effective democratic system. In the case mentioned, Dr. Sihabuddin Chalid, M.M., Pd. bin (late) Khalid Noor, deliberately created fake documents to become a candidate for DPRD members, which directly violated Law Number 7 of 2017 concerning General Elections. Therefore, strict law enforcement is very important to prevent abuse of political power and maintain public trust in government institutions.
