Referendum : Jurnal Hukum Perdata dan Pidana 2025 Asosiasi Peneliti dan Pengajar Ilmu Hukum Indonesia

This paper explores the involvement of International Civil Law in the implications of foreign divorce on land rights by paying attention to the principles contained in International Civil Law. In terms of writing, the author will analyze Decision No. 19/Pdt.G/2014/PN.Sgr. as a review of facts that will be analyzed in accordance with the scope of International Civil Law using relevant research methods. The author reviews that the research method used to compile this writing is juridical-normative based on the applicable laws and regulations and in accordance with what is the subject of discussion. In addition, this paper also pays attention to the theory of legal protection by Philipus M. Hadjon and the principles contained in International Civil Law as supporting aspects in the preparation of this analysis. To strengthen the argument, the author also compares several provisions related to the status of land ownership by foreign parties and the application of pre-marriage agreements as an alternative settlement. The final result of this writing will highlight the correctness of the judge's decision based on the author's analysis and provide suggestions that are considered relevant as solutions that can be offered.

This study aims to analyze the legal consequences arising from changes to personal data made by data subjects on the validity of collateral that has been used as security for credit, as well as to examine the forms of legal protection that may be granted to creditors. Changes to personal data such as identity, address, and the debtor’s legal status may lead to legal uncertainty regarding the validity of credit security agreements, particularly those involving Hak Tanggungan (mortgage rights). In this research, the author employs a normative juridical method using statutory and conceptual approaches. The findings of this study show that changes to personal data without notification or updates to the security documents have the potential to create administrative discrepancies and legal risks for creditors during the execution of the collateral. Legal protection for creditors needs to be strengthened through the regulation of the debtor’s obligation to report any changes in personal data, updates to the security certificates, and clear provisions outlined in the credit agreement. Accordingly, legal certainty between the creditor and the debtor can be maintained in line with the implementation of Law Number 27 of 2022 on Personal Data Protection.

This study analyzes the legal implications of the Merauke Food Estate Project on the principles of sustainable development and Indonesia's commitment to Net Zero Emission (NZE) from the viewpoint of international environmental law. Through a normative legal approach complemented by qualitative empirical analysis, this study reveals that the realization of this project has the possibility of violating national and international environmental principles, which include sustainable development, the precautionary principle, and the polluter pays principle, due to the mass deforestation that increases carbon emissions and the absence of the implementation of the Free, Prior, and Informed Consent (FPIC) mechanism for indigenous peoples. The findings indicate that the legal responsibility of the state and corporations in this project is not fully aligned with Indonesia's commitments under the Paris Agreement and the NZE target. Previously, and Informed Consent (FPIC/PADIATAPA) for indigenous peoples. The findings show that the legal responsibilities of the state and corporations in this project are not completely in line for Indonesia's commitments in the Paris Agreement and the 2060 NZE target, thus requiring policy reconstruction according to a rights-based strategy to ensure a balance between food security, ecological fairness, and a healthy environment.

Losing citizenship has significant legal consequences, particularly concerning land ownership rights. According to the Basic Agrarian Law (UUPA) No. 5 of 1960, land ownership is only permitted for Indonesian citizens. Therefore, individuals who lose their citizenship status automatically forfeit their right to own land. This study aims to analyze the legal implications of losing citizenship on land ownership rights and the resolution mechanisms outlined in the UUPA. The research employs a normative legal approach using secondary data sources such as laws and regulations, legal literature, and court decisions. The findings indicate that individuals who lose their citizenship are required to relinquish or transfer their land ownership within one year. If this is not done, the ownership rights will be nullified by law, and the land will revert to the state. This reflects the protection of the principles of nationality and national sovereignty in land control. Therefore, resolving land ownership issues for individuals who lose their citizenship is crucial to balancing individual rights and state interests.

Akuntansi dan Ekonomi Pajak: Perspektif Global 2025 Asosiasi Riset Ekonomi dan Akuntansi Indonesia

This study aims to explore how religious Muslim students interpret halal labels on product packaging and how these interpretations influence their consumption behavior. In the context of increasing awareness of halal product importance, halal labeling is not just a symbol of religious law, but also a guarantee of quality, safety, and trust. The research uses a descriptive qualitative method phenomenological approach, involving students from UIN Prof. K.H. Saifuddin Zuhri Purwokerto who were selected through purposive sampling. Data was collected through semi-structured interviews, literature study, and documentation, then analyzed using thematic analysis. The findings reveal that highly religious students tend to be more selective, careful, and responsible in choosing products, prioritizing those with halal certification even when priced higher. The halal label provides psychological comfort and certainty that the product aligns with Islamic principles. Additionally, a strong understanding of halal labels increases consumer loyalty and supports the growth of the halal industry through rising demand for certified products. Thus, the halal label plays a significant role in shaping the consumption patterns of religious Muslim students and contributes to the broader development of the halal industry in Indonesia.

This article examines the implications of parental verbal violence on the socio-emotional development of early childhood aged 3–6 years. The study was conducted through an extensive literature review supported by general field observations in community settings. The purpose of this research is to describe the phenomenon of verbal violence experienced by young children, analyze its effects on their emotional security, self-confidence, and social adaptation, and identify contributing factors from both the family environment and parental characteristics. Using a qualitative descriptive approach, relevant books, journal articles, and institutional reports were synthesized to construct a comprehensive understanding of how negative communication patterns shape children’s socio-emotional development. The findings indicate that verbal violence such as yelling, scolding, insulting, labeling, and threatening can disrupt children’s emotional regulation, lower their self-esteem, and hinder their ability to interact positively with peers. Repeated exposure to harsh language also increases the risk of anxiety, aggression, and social withdrawal. Conversely, positive, supportive, and empathetic parental communication fosters emotional resilience, empathy, and healthy social behavior. This article highlights the urgent need for parents, educators, and communities to strengthen awareness regarding the harmful impact of verbal violence and to promote nurturing communication practices that support the holistic development of young children.

This study examines the biblical approach to the truth and inspiration of the Word of God in critical dialogue with Progressive Christian Theology (PCT). Using a qualitative-descriptive method and comparative biblical-theological analysis, the research explores the fundamental differences, points of convergence, and potential integration between the two approaches. PCT emphasizes the importance of socio-cultural context, moral development, and human experience in understanding faith. In contrast, biblical theology affirms the authority and unchanging nature of the Word of God as the foundation of absolute truth that undergirds church doctrine and practice. The findings indicate an urgent need to formulate a balanced synthesis between fidelity to the biblical text and sensitivity to contemporary cultural changes. This integrative approach is not intended to weaken the authority of Scripture but to enrich theological understanding so that it becomes more relevant to modern contexts without neglecting divine truth. This synthesis ultimately produces a model of church growth that is contextual, Scripture-centered, and capable of balancing love and truth in addressing contemporary theological, social, and ethical challenges. The model bears significant implications for shaping congregational spirituality, developing pastoral ministry, and guiding the church’s mission amid increasingly complex cultural shifts.

Penelitian ini bertujuan untuk menganalisis strategi sekolah dalam mencegah dekadensi moral siswa di SMK Al–Azami Cianjur. Fenomena kemerosotan moral di kalangan pelajar menjadi tantangan serius di era modern, sehingga lembaga pendidikan Islam dituntut untuk berperan aktif dalam pembinaan karakter. Penelitian ini menggunakan pendekatan kualitatif dengan metode deskriptif yang dilaksanakan di SMK Al–Azami Cianjur selama Oktober–November 2025. Data dikumpulkan melalui observasi dan wawancara dengan kepala sekolah, guru, serta peserta didik, kemudian dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa pencegahan dekadensi moral dilakukan melalui lima strategi utama: (1) pembiasaan religius melalui kegiatan shalat berjamaah, shalat dhuha, puasa sunnah, dan budaya 5S (senyum, salam, sapa, sopan, santun); (2) penguatan pendidikan moral dan etika di setiap mata pelajaran dan kegiatan ekstrakurikuler; (3) pendampingan psikologis melalui layanan Bimbingan dan Konseling (BK) serta kerja sama dengan lembaga STIFIn untuk mengenali potensi siswa; (4) kolaborasi aktif antara sekolah, orang tua, dan masyarakat; serta (5) penerapan disiplin yang tegas namun mendidik. Strategi tersebut membentuk ekosistem pendidikan yang harmonis dan berakar pada nilai-nilai Islam. Implikasi penelitian ini menegaskan bahwa pendidikan karakter berbasis pembiasaan dan keteladanan efektif dalam membentuk generasi berakhlak mulia, disiplin, dan bertanggung jawab di tengah tantangan moral abad ke-21.

This study compares the educational evaluation systems in Indonesia and Finland and their implications for learning quality. The method used is a library study, collecting data from literature related to educational evaluation policies in both countries. The educational evaluation system in Indonesia is quite complex, implementing various forms of assessment, such as homework (PR), daily tests, mid-semester assessments (PTS), final semester assessments (PAS), and school exams (US). Indonesia also implements the Minimum Completion Criteria (KKM) as a requirement for student graduation. In contrast, Finland implements a simpler evaluation system with an emphasis on formative evaluation, a reduced number of exams, and the absence of the KKM or National Exam (UN). In the Finnish system, students are not held back from a grade, and evaluation is conducted throughout the learning process, focusing on students' continuous development. The results of this study indicate that differences in evaluation systems have a significant impact on learning methods and the development of educational quality in each country. The implication is the need to adapt evaluation policies that integrate holistic and formative aspects to improve learning quality, particularly in Indonesia.

Penelitian ini bertujuan untuk mengkaji dampak penutupan perlintasan kereta api Alastuo terhadap peningkatan volume kendaraan dan intensitas kebisingan di kawasan Fly Over Bangetayu, Kota Semarang. Fenomena ini mencerminkan tantangan tata kelola lalu lintas urban akibat perubahan infrastruktur transportasi. Dengan menggunakan pendekatan kualitatif deskriptif, studi ini dilakukan melalui metode studi kasus di lokasi terdampak. Data dikumpulkan melalui wawancara semi-terstruktur, observasi partisipatif, dokumentasi visual, serta pengukuran intensitas kebisingan menggunakan sound level meter pada sembilan titik waktu berbeda selama tiga hari pengamatan. Partisipan meliputi warga sekitar, pengguna jalan, dan petugas lalu lintas. Hasil analisis tematik menunjukkan adanya korelasi positif antara peningkatan volume kendaraan dan intensitas kebisingan, dengan nilai puncak kebisingan mencapai 93,6 dB pada sore hari. Temuan ini menegaskan bahwa perubahan rute akibat intervensi kebijakan infrastruktur dapat menyebabkan beban akustik yang signifikan di jalur alternatif. Penelitian ini memberikan kontribusi pada pemahaman tentang relasi spasial antara kebijakan lalu lintas dan degradasi lingkungan akustik. Implikasi teoretis mengarah pada integrasi studi kebisingan dalam perencanaan transportasi berkelanjutan, sementara implikasi praktis mencakup kebutuhan akan pengaturan lalu lintas yang adaptif serta mitigasi kebisingan melalui vegetasi, jalur alternatif, dan edukasi berkendara. Penelitian lanjutan disarankan melibatkan pendekatan interdisipliner untuk mengevaluasi dampak kebisingan terhadap kesehatan masyarakat secara langsung.

Epistemology is a branch of philosophy that focuses on the nature, sources, methods, and limits of human knowledge. This article aims to examine the concept of epistemology within the context of the philosophy of science, its scope, and its relevance to the development of modern scientific thought. This study employs a descriptive qualitative approach using a literature review method thatdraws upon both classical and contemporary sources in the field of the philosophy of science. The findings indicate that epistemology encompasses four main domains: the sources of knowledge, the methods of acquiring knowledge, the validity and truth of knowledge, and the limits of human understanding. In the modern context, epistemology faces new challenges such as technological advancement, scientific interdisciplinarity, and the relationship between local and global knowledge systems. The practical implications of epistemology are also evident in education through constructivism, inquiry-based learning, and epistemological literacy. Therefore, a sound understanding of epistemology serves as a crucial foundation for developing an educational and scientific system that is critical, reflective, and contextually relevant.

This study explores the implications of the 1983 Code of Canon Law (CIC) on mixed marriages within the Catholic Church, focusing on its legal, pastoral, and social dimensions in the context of religious pluralism. Mixed marriages, involving a Catholic an a non-Catholic partner, pose unique spiritual and legal challenges due to differing faith backgrounds, the research aims to analyze how the CIC, alongsid Church documents such as Muto Proprio Matrimonia Mixta, Familiaris Consortio, and Amoris Laetitia, addresses these challenges while upholding the sacramental nature of marriage. A qualitative descretive method was employed, utilizing critical textual analysis of relevant literature, including books, journals, and Church documents, the findings highlight that Canons 1124-1126 og the CIC provide a robust legal framework requiring episcopal dispensation, commitment to Catholic faith preservation, and respect for the non-Catholic partner’s beliefs. these Canons balance the protection of Catholic identity with openness to interfainth dialogue. Additionally, Church documents emphasize pastoral accompaniment, compassion, and doalogue to foster family unity and fainth education for children. The study concludes that the CIC, enriched by pastoral approaches in the referenced documents, offers a framework that not only regulates mixed marriages but also transforms them into opportunities for spiritual growth and interreligious harmony, particularly in diverse societies like Indonesia. This integrated approach ensures the mixed mariages can be a source of blessing rather than conflict, promoting stability ant mutual respect in families.

Marriage is a physical and emotional bond between a man and a woman recognized by law and religion. In practice, issues often arise regarding the status of joint property acquired during marriage, especially in the event of divorce. To anticipate such disputes, a prenuptial agreement serves as a legal instrument that provides certainty and legal protection for both husband and wife in managing and dividing joint assets, either during the marriage or after divorce. This study aims to analyze the urgency of drafting a prenuptial agreement, identify the legal aspects that need to be included in the deed, and examine its juridical implications. This research employs a normative legal method with a conceptual and statutory approach, using descriptive-analytical techniques, secondary data sources, and qualitative analysis. The findings indicate that a prenuptial agreement has significant urgency in protecting the rights of both spouses in case of divorce. Furthermore, it holds binding legal force and creates juridical implications by clarifying the separation between personal and joint property, thereby ensuring legal certainty for both parties.

This paper aims to explore the hermeneutics proposed by Fatima Mernissi in reading a hadith, especially those related to the hadith of female leadership. In this case, the hadith narrated by Abu Bakrah's companion stated that "a people who entrust their affairs to women will not be successful." This research is a qualitative research with a descriptive analytical nature, which focuses on analyzing the sanad and matan and revealing how the socio-historical context of a hadith is narrated. The results of this study indicate that the hermeneutic concept proposed by Fatima Mernissi is able to identify bias in the narration of a hadith. In this case, the hadith narrated by Abu Bakra is considered weak for several reasons, such as the incompleteness of Abu Bakra's genealogy, the influence of the social conditions of the hadith, and the lack of credibility of the narrator. Therefore, the hermeneutic approach proposed by Fatima Mernissi provides a reinterpretation of the hadiths so that they are in line with the principle of justice.

This study investigates the role of fintech and digital finance as intermediary variables in the influence of sharia financial literacy on increasing sharia financial inclusion in Aceh Province. This study examined 308 respondents spread across various regions of Aceh Province and analyzed using SEM AMOS and a purposive sampling technique. After conducting various tests, this study demonstrated that sharia financial literacy, fintech, digital finance, and sharia financial inclusion have been well-functioning. Sharia financial literacy has been proven to enhance fintech, digital finance, and sharia financial inclusion in Aceh. Correspondingly, fintech and digital finance also have a positive and significant impact on sharia financial inclusion. Furthermore, fintech and digital finance have also been shown to partially mediate the relationship between sharia financial literacy and sharia financial inclusion

The contemporary digital era has triggered the normalization of pornography and promiscuous sexual behavior, which significantly threatens the theological understanding and sacramental practice of Catholic marriage among young adults. This article aims to examine, from a theological-juridical perspective, how canons 1055–1101 of the Code of Canon Law (CIC) serve as the authoritative foundation for the Church in safeguarding the dignity and validity of the sacrament of marriage. The method employed is a comprehensive literature study of the CIC, relevant magisterial documents of the Church, and contemporary scholarly works on the dynamics of young adult relationships. The concise findings indicate that exposure to and normalization of pornography directly weaken three fundamental aspects of Catholic marriage, namely the capacity to give free consent, the intention to practice permanent fidelity, and the correct understanding of the body’s meaning as a total self-gift. Nevertheless, the Church possesses solid canonical and pastoral instruments to address these challenges and facilitate restoration. In conclusion, a synergistic integration of canonical approaches, moral teachings, and pastoral guidance is required to assist young adult couples so that they may realize marriages that are not only canonically valid but also psychologically mature and sacramentally holy.

With the rise in human migration across national boundaries in the age of globalization, the issue of dual citizenship has become more and more important. Dual citizenship brings up a number of issues in the context of international law about legal status, diplomatic protection, and allegiance to both the nation of origin and the nation of residence. Increased cross-border social interactions that push people to hold several citizenships, technological improvements, and increased global economic integration have all complicated this dynamic. As a nation that upholds the idea of a single citizenship, Indonesia has trouble aligning its national laws with the shifting global legal framework, which governs things like dual citizenship, migration, and statelessness. is often more accepting of the practice of dual citizenship. From an international law standpoint, this research seeks to examine the subject of dual citizenship and its consequences for Indonesia's citizenship legislation and legal system. With a juridical-comparative examination of international legal instruments, scholarly publications, and applicable national legislation, the study uses a normative methodology. The results show that Indonesia's single citizenship concept conflicts with the worldwide trend that prioritizes human rights, diverse identities, and diaspora protection. Indonesia, according to the research, should think about changing its citizenship laws to take into account global concerns while still protecting its sovereignty, national stability, and core national values.

Rice production remains a strategic component in supporting local food security, yet its performance is strongly influenced by the heterogeneity of farmers' characteristics. This study aims to describe the characteristics of rice farmers in Tonra District and analyze their implications for the formulation of agricultural extension programs. Using a descriptive quantitative approach with 100 respondents selected proportionally from eleven villages, the research examines key variables including land size, seed use, fertilizer application, age, education level, and farming experience. The findings reveal clear variations in productivity among farmers, where higher production is generally associated with larger landholding, optimal input use, productive age groups, higher educational attainment, and moderate farming experience. These patterns highlight how farmers' demographic and agronomic characteristics shape their management capacity and adoption of recommended practices. The study emphasizes that extension programs must be designed based on farmers’ actual profiles to enhance relevance and effectiveness. Tailored strategies—such as visual communication for low-education groups, mechanization support for senior farmers, and input-use optimization training—are necessary to improve productivity outcomes. The results provide an important basis for developing more targeted, responsive, and sustainable agricultural extension programming at the district level.

Integrated Quality Management (IQM) or Total Quality Management (TQM) has become a strategic issue in the field of education because it is directly related to improving the quality of learning, school management, and the achievement of sustainable competency standards. In the context of Islamic education and integrated schools, the implementation of IQM is not only oriented toward managerial efficiency but also toward the integration of religious values and the development of students’ character. Therefore, this literature review is essential to understand the development, trends, and challenges of IQM implementation in education. The purpose of this literature review is to examine how IQM is applied in various educational institutions and to identify its theoretical and practical contributions. The research questions proposed are: (1) How are the concepts and principles of IQM developed in education? (2) What are the main impacts and challenges of its implementation? The study employed a literature search through repositories, e-journals, and online publications using the keywords “integrated quality management,” “TQM,” and “education.” Out of 20 initial articles, only 5 met the inclusion criteria and were analyzed in depth. The analysis results revealed three main themes: strengthening the fundamental concepts of IQM, the role of key figures and TQM principles in education, and the implementation impacts on academic and non-academic quality. In conclusion, IQM has proven to be relevant as a strategy for improving educational quality, although challenges such as limited resources and internal resistance still need to be addressed. Future research should explore adaptive IQM strategies tailored to the local school context.

The development of artificial intelligence technology has given birth to deepfake technology which has the potential to be misused to damage a person's digital identity. This research aims to analyze the mode of misuse of deepfake technology in Indonesia, examine its legal implications based on applicable laws and regulations, and examine the urgency of special regulation of deepfake in the Indonesian legal system. The research method used is normative juridical legal research with statutory and conceptual approaches, and data collection is carried out through literature study of primary, secondary, and tertiary legal materials tertiary. The results show that deepfake abuse can take the form of spreading fake videos, face forgery and digital identity-based fraud that harms victims socially, legally and psychologically. Although several articles in the ITE Law, Personal Data Protection Law, and Criminal Code can be used to charge perpetrators, these regulations have not specifically and explicitly regulated the characteristics and technical aspects of deepfake-based crimes. This creates obstacles in law enforcement and victim protection. Therefore, it is necessary to establish special regulations or amend existing laws so that the legal system in Indonesia is able to answer the challenges of deepfake technology appropriately, fairly, and effectively.
