Copyright is a key pillar of the Intellectual Property Rights system, providing legal protection for creative works in the arts sector, particularly musical works. Within the copyright framework, the most crucial aspect is economic rights, namely the exclusive right of creators to derive financial benefit from any use of their works. However, the reality on the ground demonstrates the rampant use of songs for commercial purposes without proper authorization, which directly harms creators. This article analyzes economic rights violations in the context of commercial use, using the case study of the song "Akad" by Payung Teduh as a case study. This research uses normative legal methods through a statutory and legal conceptual approach. The research findings indicate that the exploitation of songs for material gain without the explicit consent of the rights holder constitutes a clear violation of Law Number 28 of 2014 concerning Copyright. Such violations carry serious legal consequences, including civil liability in the form of compensation payments and criminal sanctions. Therefore, synergy between firm law enforcement and increased collective public awareness is necessary. These efforts are vital to guaranteeing the protection of creators' economic rights while creating a healthy, fair, and sustainable creative industry ecosystem in Indonesia for all arts stakeholders.

This article examines the legal ambiguities surrounding the status of civilians actively engaged in hostilities (civilian combatants) within the framework of International Humanitarian Law (IHL) and International Human Rights Law (IHRL). While the 1949 Geneva Conventions and the 1998 Rome Statute establish a clear demarcation through the distinction principle, the phenomenon of direct participation in hostilities (DPH) poses a significant legal challenge, as civilians forfeit their protected status upon taking part in combat. Using a normative-legal approach, this study analyzes how acts of violence committed by armed civilians can be categorized as war crimes, crimes against humanity, or gross human rights violations. The findings demonstrate that civilian status does not grant impunity for individuals who commit atrocities. Under the principle of individual criminal responsibility, the International Criminal Court (ICC) and national tribunals possess the jurisdiction to prosecute offenders, regardless of their formal military standing. Such legal enforcement is paramount to upholding the integrity of humanitarian principles and ensuring justice for victims within the landscape of modern armed conflict.

Trademarks not only serve as product identities but also represent the reputation and trust built by a company over the long term. In increasingly fierce global competition, legal protection for brands, especially well-known brands, is crucial. This study examines the legal implications of alleged trademark infringement by the Louis Vuitton Dak restaurant in Korea, which resembles the luxury brand Louis Vuitton. The purpose of the study is to analyze the application of Law Number 20 of 2016 concerning Trademarks and Geographical Indications and to assess the effectiveness of law enforcement against such violations. The method used is normative juridical with a statutory and conceptual approach. The analysis focuses on similarities in principle, the element of bad faith in trademark registration, and violations of exclusive rights to well-known brands. The results of the study indicate that although regulations have provided protection, law enforcement in practice still faces various obstacles and has not fully created a deterrent effect.

The increasing intensity of traffic object movement in urban areas has not been accompanied by adequate road infrastructure, resulting in traffic congestion, air pollution, and a higher risk of traffic accidents. One of the primary causes of accidents is traffic violations, particularly wrong-way driving behavior. This study develops a video-based automated traffic violation detection system using the YOLOv5 algorithm. A computer vision approach is employed to detect, classify traffic objects, and count wrong-way violations in real time. Due to limited access to real-world traffic violation footage, simulated traffic scenarios are used as testing data. The system is evaluated on four traffic object classes: motorcycles, cars, buses, and trucks. Experimental results demonstrate strong performance, achieving a precision of 90%, a recall of 92%, and an F1-score of 91%, while the traffic object counting accuracy reaches 89%. These findings indicate that the proposed system has significant potential to support traffic analysis and assist authorities in making more effective decisions to reduce congestion and traffic accidents.

Di tengah dinamika industri musik yang terus berkembang pesat di Indonesia, permasalahan royalti atas karya musik menjadi tantangan besar yang memerlukan solusi hukum yang konkret dan efektif. Performing rights merupakan hak pokok yang dilindungi dalam UU Hak Cipta (UUHC) atas pemanfaatan karya dalam pertunjukan publik, pada penerapannya belum optimal dan sering menimbulkan permasalahan hukum antara pencipta lagu, performer, dan event organizer. Konteks penelitian ini menghadirkan peranan strategis Notaris sebagai penjaga keabsahan kontrak melalui penyusunan klausul performing rights pada kontrak event organizer sebagai solusi preventif terhadap permasalahan royalti di industri musik Indonesia. Rumusan masalah penelitian ini meliputi: bagaimana kedudukan performing rights menurut UUHC, bagaimana penerapan klausul performing rights pada kontrak event organizer, serta bagaimana peranan Notaris dalam penyusunan klausul performing rights sebagai upaya mencegah sengketa royalti. Penelitian ini menggunakan metode pendekatan yuridis normatif dan konseptual, dengan mengkaji peraturan perundang-undangan, doktrin hukum, dan praktik industri musik secara sistematis serta analitis. Hasil penelitian menunjukkan bahwa klausul performing rights yang disusun dan disahkan oleh Notaris memiliki peran sentral dalam memastikan legalitas, kekuatan mengikat, serta perlindungan hak cipta, sehingga mampu meminimalisir potensi sengketa royalti dan pelanggaran hak cipta. Berdasarkan analisis terhadap regulasi dan kebutuhan praktis sebagaimana uraian dalam penelitian ini, Peneliti menyusun sebuah draf klausul Performing Rights yang komprehensif dan aplikatif untuk dimuat dalam kontrak antara Event Organizer dan Performer. Disarankan perlunya standarisasi klausul performing rights, peningkatan pengetahuan hukum bagi event organizer, sosialisasi kewajiban royalti, serta peningkatan kapasitas Notaris di bidang kekayaan intelektual guna membangun ekosistem industri musik yang lebih adil, transparan, dan berkelanjutan di Indonesia.

Penelitian ini membahas secara mendalam mengenai perlindungan hukum bagi nasabah dalam sengketa gadai syariah, khususnya yang berkaitan dengan pengembalian barang jaminan setelah pelunasan utang. Perkembangan industri gadai syariah di Indonesia yang sangat pesat menunjukkan adanya peningkatan kepercayaan masyarakat terhadap lembaga keuangan berbasis syariah. Namun, di sisi lain, dinamika ini juga memunculkan tantangan baru dalam aspek perlindungan konsumen, terutama ketika terjadi wanprestasi, kesalahan administrasi, atau kelalaian lembaga gadai dalam menjaga serta mengembalikan barang jaminan milik nasabah. Melalui pendekatan yuridis normatif dan studi kasus terhadap Putusan Pengadilan Agama Banjarmasin Nomor 1112/Pdt.G/2021/PA.Bjm, penelitian ini berupaya menganalisis bentuk tanggung jawab hukum lembaga gadai serta perlindungan yang seharusnya diterima oleh nasabah sebagai pihak yang dirugikan. Hasil kajian menunjukkan bahwa dalam perspektif hukum syariah, barang gadai (marhun) memiliki kedudukan hukum sebagai amanah yang wajib dijaga dengan penuh tanggung jawab oleh pihak penerima gadai (murtahin). Apabila lembaga gadai lalai dalam menjaga atau gagal mengembalikan barang tersebut, maka tindakan tersebut dapat dikategorikan sebagai wanprestasi sekaligus pelanggaran terhadap prinsip keadilan dan hak-hak konsumen. Perlindungan hukum terhadap nasabah diatur dalam berbagai peraturan, antara lain Kitab Undang-Undang Hukum Perdata (KUHPerdata), Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, serta pengawasan yang dilakukan oleh Otoritas Jasa Keuangan (OJK) terhadap lembaga keuangan syariah. Namun demikian, efektivitas implementasi peraturan tersebut masih menghadapi berbagai kendala, seperti lemahnya pengawasan, kurangnya pemahaman masyarakat mengenai hak-haknya, serta minimnya mekanisme penyelesaian sengketa yang cepat dan transparan. Oleh karena itu, diperlukan penguatan sistem pengawasan serta edukasi hukum bagi masyarakat agar prinsip keadilan, kepastian hukum, dan kemaslahatan dalam transaksi gadai syariah dapat terwujud secara menyeluruh.

The armed conflict between Israel and Palestine, particularly in the Gaza Strip, has caused severe humanitarian impacts and raised strong allegations of violations of International Humanitarian Law (IHL). Israel’s military attacks on civilians, hospitals, and public infrastructure demonstrate breaches of the principles of distinction, proportionality, and humanity as stipulated in the 1949 Geneva Conventions and the 1977 Additional Protocol I. This study aims to analyze the forms of violations committed by Israeli forces and examine their legal accountability under international law and the International Criminal Court (ICC). The research employs a normative juridical method using statutory and case approaches, with primary legal materials from international treaties and secondary materials from academic journals and human rights reports. The findings indicate that Israel’s actions in Gaza constitute grave breaches and war crimes, as they deliberately target civilians and obstruct humanitarian assistance. This study emphasizes the urgency of enforcing international law and ensuring global accountability for perpetrators while encouraging member states of the Rome Statute to support ICC-led investigations into the ongoing violations

This study examines the effectiveness of law enforcement regarding violations of Article 287 paragraph (2) of Law Number 22 of 2009 on Road Traffic and Transportation, particularly concerning red-light violations (APILL). Although the legal provisions are clearly formulated, practical implementation reveals a gap between the normative expectations (das Sollen) and actual conditions (das Sein). This research employs a normative juridical method supported by secondary empirical data, analyzed through Lawrence M. Friedman’s legal system theory and Satjipto Rahardjo’s theory of law enforcement. The findings show that the effectiveness of enforcing red-light regulations is influenced by structural aspects of law enforcement agencies, the community’s weak legal culture, and supporting facilities such as the uneven distribution of ETLE systems. The study concludes that the enforcement of Article 287 paragraph (2) remains suboptimal, and therefore requires strengthening ETLE infrastructure, improving officer professionalism, reassessing the proportionality of sanctions, and enhancing public legal education to increase traffic compliance.

The Family Welfare Empowerment (PKK) is a vital community organization with a significant role in addressing social issues. One such issue is the increasing number of juvenile delinquency cases in schools, which has become a major concern for both educational institutions and parents. Schools must be proactive in monitoring their students to address this problem effectively. However, traditional manual monitoring processes are inefficient and time-consuming. To overcome this, there is a need for an efficient, user-friendly, and multi-user monitoring system that enables both schools and parents to access information about their children's behavioral violations. This student violation monitoring system is designed to be web-based, utilizing UML (Unified Modeling Language) for system design and employing the Waterfall development method. The goal of this system is to provide an effective solution for managing and tracking student violations, allowing for better control and prevention of delinquent behavior within the school environment. By implementing this system, both school authorities and parents will be able to collaborate more effectively in monitoring and addressing student behavior.

The Rp 300 trillion tin trade mega-corruption case is one of the largest corruption scandals in the history of Indonesian natural resource management. This study aims to analyze violations of Pancasila principles and ethical governance in the tin trade mega-corruption case, and to identify threats to Indonesian natural resource management. The study uses a qualitative approach with descriptive methods. Data were collected through documentary studies of law enforcement reports, government documents, media reports, and related literature. Data analysis was conducted thematically within the theoretical framework of Pancasila, good governance, and public ethics. The findings indicate that this case violates all of Pancasila's tenets, particularly the second (Just and Civilized Humanity) and fifth (Social Justice for All Indonesian People). There were violations of governance principles including transparency, accountability, participation, the rule of law, and effectiveness. The modus operandi involved collusion between business actors, state officials, and law enforcement officers. The mega-allegations reflect a systemic failure in natural resource management that contradicts the constitutional mandate and Pancasila values. Structural reforms are needed in mining governance, enforcement of the integrity of the apparatus, and public participation in supervision.

Fiduciary duty breaches and misappropriation are serious issues in corporate governance that can result in significant losses for companies and the state. This study aims to analyze the forms and mechanisms of legal accountability for fiduciary duty breaches and misappropriation through a comparative study of the cases of PT Asabri in Indonesia and Barclays v Singularis in the UK. The research method used is normative legal research with a conceptual, statutory, and comparative legal approach. The analysis was conducted on primary, secondary, and tertiary legal materials which were then presented qualitatively in the form of exploratory and argumentative descriptive narratives. The results of the study indicate that fiduciary duty is recognized in both legal systems but with different scopes. Where the English legal system can apply this obligation to third parties such as banks through the Quincecare duty, while in Indonesia it is limited to internal parties of the company. The concept of misappropriation is not explicitly mentioned in Indonesian law but is covered in various regulations through the terms embezzlement and abuse of authority. The PT Asabri case demonstrated systematic violations by internal management, resulting in losses reaching Rp 23.7 trillion, while the Barclays v. Singularis case demonstrated the bank's negligence in preventing misuse of client funds. The implications of this research highlight the need for regulatory harmonization and strengthened oversight mechanisms to prevent similar violations in the future.

Traffic violations are one of the serious problems frequently occurring in various regions, including Binjai City. Various types of violations, such as disobeying road signs and markings, incomplete vehicle documents, and violations that threaten the safety of drivers and other road users, continue to increase despite preventive and repressive efforts carried out by the authorities. This condition indicates that handling traffic violations cannot rely solely on field enforcement but also requires the support of technology capable of analyzing data more comprehensively. This study aims to predict the level of traffic violations by applying the Naïve Bayes method through data mining techniques. The dataset used consists of traffic violation records in 2023 from the Binjai City Police Department, with the main variables including violations of traffic signs and markings, document completeness, and safety-related violations. The Naïve Bayes method was selected because of its ability to perform classification with good accuracy, simplicity, and efficiency in processing large amounts of data. The implementation of this research is realized by developing a web-based application using Visual Studio Code as the development environment and MySQL as the database system. The results of this study are expected to provide structured information regarding traffic violation patterns, support authorities in making more effective decisions, and serve as an alternative solution in the prevention and handling of traffic violations in Binjai City.

This study examines organizational communication within the General Election Supervisory Body (Bawaslu) of Pasuruan Regency in handling violations during the 2024 Regional Elections (Pilkada). Using a qualitative case study approach, data were obtained through in-depth interviews, observation, and documentation involving Bawaslu members, technical staff, and the Integrated Law Enforcement Center (Gakkumdu). The results show that vertical and horizontal communication flows are generally effective in supporting internal coordination and violation handling, despite challenges such as limited human resources, high workloads, and inter-agency coordination gaps. To address these, Bawaslu strengthens internal meetings, leverages digital media, provides technical training, and enhances external collaboration and public outreach. The study concludes that effective organizational communication significantly improves election monitoring performance and offers insights for communication strategies in other supervisory bodies.To address these issues, Bawaslu has taken several proactive steps. These include strengthening internal meetings to improve coordination and decision-making, leveraging digital media for more efficient communication and reporting, providing technical training to staff to enhance their skills in violation detection and reporting, and fostering stronger collaboration with external agencies such as Gakkumdu for coordinated law enforcement. Additionally, Bawaslu has focused on improving public outreach through social media campaigns to increase awareness of the electoral process and violations. The study concludes that effective organizational communication significantly improves election monitoring performance and offers insights for communication strategies in other supervisory bodies. It recommends that other institutions facing similar challenges in managing complex, multi-agency processes adopt similar strategies to improve both internal and external communication for more efficient operations and outcomes.

Social media has become one of the main media for distributing various advertising content in today's digital era. However, the spread of advertising content on social media also brings new challenges. Social media, especially TikTok, has a high virality rate, which means that content can spread quickly, both positively and negatively. The TikTok account @ngobrolsantaiindonesia uploaded a promotional advertisement for Borobudur Temple. The entire narrative in the advertising content openly alludes to other religions, namely Islam. This study uses a research approach in the form of a literature study or can be called library research. Indonesia has guidelines that must be respected, namely the Indonesian Advertising Ethics or abbreviated as EPI. The EPI contains a system of values ​​and integrated guidelines for manners (code of conducts) and procedures (code of practices) that apply to all advertising actors in Indonesia. According to the Indonesian Advertising Ethics, advertisements must be honest, correct, and responsible. It was concluded that the violation committed by the TikTok account @ngobrolsantaiindonesia was offending SARA, more specifically other religions.

PT. PLN (Persero) UP3 Binjai faces challenges in handling electricity usage violations that increase every year. Lack of utilization of data violations that can be utilized to produce useful information in supporting strategic decision making by PLN, especially in the implementation of Electricity Usage Control (P2TL) activities. This study aims to identify customer violation patterns based on rayon, power, and type of violation with data mining methods using the K-Means Clustering algorithm. The results of the study show that the 3rd cluster represents the most violation-prone area, namely in the West Binjai Rayon, with a power of 450 VA and the most frequent type of P2 violation. The results of the study show that the K-Means algorithm with the Elbow method is able to systematically group data violations based on certain characteristics. The results of this study can provide recommendations to PLN UP3 Binjai to improve the effectiveness of monitoring and enforcement strategies through a more targeted approach.

This research analyzes the ethics of broadcasting advertisements on television media, especially related to  broadcasting time regulations. The significant role of television in shaping people's thoughts and  behaviors, coupled with the proliferation of potentially unethical and inappropriate broadcasts, highlights  the urgency of this issue. Such violations, especially those concerning children and adolescents, pose  significant risks due to exposure to inappropriate content and the normalization of unethical behavior. This  study emphasizes the importance of media commitment to the Broadcasting Behavior Guidelines and  Broadcast Program Standards (P3SPS) and Law No. 32 of 2002, which aims to protect viewers from  harmful information. This study uses a library observation method with a qualitative approach, analyzing  existing reports, research, and written sources. Data analysis uses Miles and Huberman's qualitative  decomposition technique, which includes data reduction, data presentation, and drawing conclusions. The  findings of the study are in line with previous studies, indicating that violations of broadcasting ethics and  broadcasting hours are systemic problems that have not been resolved. This underlines the need for stricter  supervision, sanctions, re-evaluation of broadcasting time classifications, and media literacy education for  the community.

Notaris atau PPAT dalam jabatannya tidak terlepas dari sebuah kesalahan dan pelanggaran. Salah satu yaitu kasus dalam Putusan Nomor 1379K/Pid/2023 diketahui dalam kasus bahwa MVS selaku Notaris atau PPAT dititipi uang pembayaran uang tanah oleh SRW selaku pembeli. Uang tersebut tidak diberikan kepada pihak yang berhak yaitu 19 ahli waris selaku penjual maupun BA selaku kuasa jual, Namun diberikan kepada EW. Pokok permasalahan dalam penelitian ini yaitu :1). Bagaimana proses pelaksanaan jual beli tanah dalam Putusan Nomor 1379K/Pid/2023. 2). Bagaimana tanggung jawab Notaris atau PPAT terhadap jual beli tanah dalam Putusan Nomor 1379K/Pid/2023 3).Bagaimana akibat hukum terhadap Notaris atau PPAT yang turut serta dalam proses jual beli tanah dalam Putusan Nomor 1379K/Pid/2023. Metodologi penelitian yang digunakan adalah yuridis normatif, sumber data yaitu data sekunder, metode pengumpulan data dengan studi kepustakaan, metode analisis data menggunakan analisis data kualitatif. Hasil dari penelitian ini bahwa, 1).  Proses jual beli tanah ada tiga tahapan yang harus dilalui yaitu tahapan pengecekan data, tahapan persiapan dan perpajakan, terakhir tahapan jual beli dan balik nama. 2). Sikap Notaris atau PPAT dalam Putusan Nomor 1379K/Pid/2023 merugikan bagi pihak penjual dan pembeli sehingga Notaris atau PPAT bertanggung jawab secara perdata, pidana, dan Adminitratif. 3). Notaris atau PPAT dengan menerima uang titipian dari SRW dinilai menjadi pihak yang ikut serta Notaris atau PPAT dalam jual beli tanah tersebut dan hal itu telah melanggar Pasal 52 UUJN, maka akibat dari keikutsertaan menerima sanksi pidana yaitu penjara selama tujuh bulan.

OJK melaksanakan Pemeriksaan terhadap Bank melalui pemeriksaan secara berkala paling sedikit 1 (satu) tahun sekali untuk setiap Bank dan pemeriksaan sewaktu-waktu apabila terdapat laporan dari masyarakat terkait adanya dugaan pelanggaran kewajiban bank. Pemeriksaan meliputi pemeriksaan terhadap aspek kegiatan usaha Bank. Pemberian sanksi terhadap Penyelenggara Laku Pandai yang tidak melaksanakan kewajiban perlindungan data nasabah diatur dalam POJK Nomor 22 Tahun 2023, dimana akan dikenai sanksi administratif, denda administratif dan sanksi pidana sebagaimana diatur dalam UU P2SK. OJK harus melakukan pemeriksaan secara berkala dan terus memperhatikan peraturan perundang-undangan yang terbit sehingga dapat melakukan sinkronisasi dalam penerbitan POJK demi memberikan perlindungan kepada nasabah yang menitipkan uangnya kepada Penyelenggara Laku Pandai. OJK harus mensosialisasikan POJK yang baru diterbitkan kepada masyarakat dengan harapan masyarakat luas paham dan mengerti bagaimana melindungi hak-hak mereka selaku nasabah. Masyarakat harus berperan aktif sehubungan dengan adanya dugaan penyelewengan tindakan oleh Penyelenggara Laku Pandai dengan cara melakukan pelaporan kepada OJK sehingga OJK dapat segera melakukan pemeriksaan

The conflict involving Armed Criminal Groups (KKB) in Papua presents a serious dilemma between law enforcement and the protection of human rights. On one hand, KKB’s actions—such as attacks on civilians and security personnel—are classified as gross human rights violations, posing threats to national security and obstructing regional development. On the other hand, law enforcement efforts by state authorities are often criticized for alleged human rights abuses, especially in military operations that may involve excessive use of force. This study aims to analyze the conflict from both legal and human rights perspectives using a normative juridical approach. The analysis is based on relevant legal frameworks, including the 1945 Constitution of the Republic of Indonesia and Law Number 39 of 1999 concerning Human Rights. The article proposes strategic measures to achieve a balanced resolution, such as inclusive dialogue with Papuan communities, human rights-based training for security forces, independent oversight of security operations, and adherence to humanitarian principles. These approaches are expected to foster stability and peace while ensuring the protection of human rights. Ultimately, this study emphasizes that the resolution of the Papua conflict must not rely solely on repressive measures but must also prioritize justice, humanity, and long-term sustainability.

This study aims to analyze the violation of accounting professional ethics in the PT Asuransi Jiwasraya scandal, one of the biggest financial cases in Indonesia. The main focus of this study is to identify the forms of ethical violations that occur, analyze the principles of the code of ethics that are violated, and understand the impact and causal factors of manipulative actions in the company's financial statements. This study uses a descriptive qualitative approach based on the theory of Accounting Professional Ethics and Fraud Triangle Theory. The results of the analysis show that in the Jiwasraya case there was a violation of the principles of integrity, objectivity, professional competence, confidentiality, and professional behavior. Manipulation of financial statements was carried out to cover up the company's actual loss, which caused state losses of up to trillions of rupiah and damaged public trust in the financial industry. Stricter supervision, consistent application of professional ethics, and improvement of governance are needed so that similar cases do not recur in the future.
