This study focuses on the elements of gharar (uncertainty), tadlis (fraud), and breach of contract in examining multiple transactions of a single land object from the standpoint of Islamic economic law. The rising frequency of disagreements over land purchases and sales brought on by the same seller engaging in overlapping transactions, unclear ownership status, and a lack of transparency has prompted this research. This study aims to investigate the effects of these activities on Indonesian positive law and Islamic economic law. This case study employed an empirical legal approach and was carried out in Grogol Village, Tulangan District, Sidoarjo Regency. Data was gathered through observation, interviews, and documentation by the buyer, seller, and local authorities. The findings indicate that due to unclear land boundaries and ownership status, the transaction contained significant elements of gharar and tadlis because the seller concealed important information about the previous transaction. Furthermore, the seller's failure to fulfill obligations stipulated in the contract constitutes a breach of contract under positive law. This study demonstrates that these practices not only violate legal regulations but also contradict the principles of Islamic economic law such as justice, transparency, and good faith. According to this study, legal awareness, administrative accuracy, and institutional oversight are vital to prevent such issues in the future.

Nowadays, people are more likely to make transactions online. Online transactions are the same as offline transactions, only the online buying and selling process is carried out via the internet rather than offline, where sellers and buyers meet.  In fact, when carrying out online transactions, some customers become disappointed and disadvantaged, such as when the product ordered is not suitable or is not sent by the seller, especially for customers who experience fraud with large amounts of money.  As a result, it is very important to follow Islamic business ethics when making transactions on Tokopedia.  This research uses qualitative descriptive research where researchers use the literature study method to obtain data.  The research results show that Islamic business ethics at Tokopedia fulfill several Islamic ethical principles

The rapid development of e-commerce in Indonesia makes transactions easier for consumers, but also presents various losses, such as fraud, goods that do not match the description, leaks of personal data, and problems with returning goods. In this context, Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE) exists as a legal basis which is expected to provide protection for consumers in online buying and selling transactions. This research aims to explore and analyze the effectiveness of the legal protection provided by the ITE Law for consumers, with a focus on protection for detrimental transactions, consumer personal data, as well as dispute resolution mechanisms. The research method used is a normative approach with a literature study of statutory regulations and related legal literature. The research results show that the ITE Law provides quite comprehensive legal protection, including the obligation of electronic system operators to ensure the security of transactions and personal data, as well as regulating sanctions for perpetrators of fraud. However, even though regulations already exist, implementation and consumer understanding of their rights is still a major challenge.

The development of information technology has transformed trade from traditional markets to digital platforms, including Cash on Delivery (COD) payment systems. This study analyzes the integration of the COD system with the istishna contract in online transactions (specifically on Shopee), its implementation mechanisms, and its validity according to Islamic jurisprudence (fiqh muamalah). The research method used a descriptive qualitative approach through digital observation and literature review. The focus of the study was on pre-order or custom product transactions made after a specification agreement between the buyer (mustashni') and seller (shani'). The results showed that the COD system is valid in the istishna contract because it allows for final payment upon receipt of the goods. This is in accordance with Sharia law as long as the product specifications are clear, the price is transparent, and the buyer's right to khiyar is fulfilled to ensure the goods conform to the contract. As long as it is free from riba (usury), gharar (gharar), and tadlis (tadlis), the COD method in istishna transactions reflects fairness, openness, and benefits for both parties in the digital economy ecosystem.

This study analyzes the influence of Islamic business ethics principles on online buying and selling transactions in the predominantly Muslim community of South Sumatra. Using a quantitative approach through a survey of 200 respondents in Palembang with a Likert scale questionnaire, the data were analyzed using multiple linear regression with SPSS 26. The results showed that the principle of honesty (sidq) had the strongest significant influence (β = 0.029, p = 0.002), followed by unity (tawhid) (β = 0.016, p = 0.049), while other principles such as balance, free will, and responsibility showed a positive but insignificant influence. The regression model explained 10.3% of the variation in transaction behavior (R² = 0.103). This study concluded that the application of Islamic ethics can increase trust and sustainability in e-commerce in the region, with implications for the development of halal businesses. In the future, the application of these principles is expected to mitigate ethical issues in e-commerce, such as fraud and uncertainty that often occur, as well as strengthen transparency and fairness in online transactions.

Aktivitas ekonomi mempunyai hubungan yang erat dengan transaksi antara entitas ekonomi, yang terkadang menyebabkan sengketa. Dalam konteks ekonomi syariah, sengketa muncul karena perselisihan antara pelaku ekonomi yang berbisnis berdasarkan hukum ekonomi syariah terkait hak atau kepentingan. Sengketa ini bisa diputus dengan instrumen hukum yang berbagai, baik litigasi di pengadilan agama maupun metode non-litigasi seperti negosiasi, mediasi, dan konsiliasi. Penyelesaian sengketa di pengadilan agama bertujuan agar terjaminlah keadilan dan keteguhan hukum sesuai prinsip syariah. Namun, dengan semakin meningkatnya tuntutan keadilan, penyelesaian sengketa melalui pengadilan relatif lama dan kurang efektif, maka alternatif penyelesaian di luar pengadilan semakin relevan. Negosiasi sebagai salah satu proses tawar-menawar dalam sengketa ekonomi syariah sangat memfokuskan pada persiapan dan komunikasi efektif kedua belah pihak. Salah satu penyebab sengketa ekonomi pada ekonomi syariah adalah wanprestasi dalam transaksi jual beli, terutama transaksi tanah. Oleh karena itu, regulasi ekonomi syariah yang mengatur prinsip keadilan dan keseimbangan hak dan kewajiban sangatlah perlu untuk menyelesaikan sengketa tersebut secara adil dan damai. Penelitian ini bertujuan untuk menggali penerapan regulasi ekonomi syariah dalam penyelesaian sengketa wanprestasi, khususnya yang berhubungan dengan sengketa tanah, dengan mengidentifikasi metode penyelesaian sengketa yang sesuai dalam hukum Islam dan hukum positif Indonesia. Penelitian ini diharapkan memberikan wawasan mengenai relevansi dan penerapan hukum Islam dalam menyelesaikan sengketa ekonomi syariah, serta menyoroti pentingnya penyelesaian sengketa melalui metode yang mengedepankan keadilan dan perdamaian.

Tanah adalah objek vital yang bernilai tinggi sehingga transaksi jual beli tanah menuntut kepastian hukum agar tidak menciptakan sengketa. Namun, praktik membeli atau menjual tanah secara tunai tanpa melalui PPAT dan tanpa memiliki sertifikat kepemilikan masih banyak terjadi, sehingga menimbulkan berbagai masalah terkait keabsahan dokumen, perlindungan hukum, serta risiko terjadinya sengketa. Latar belakang inilah yang melandasi penelitian dengan judul Perlindungan Hukum bagi Pembeli atas Tanah dalam Perjanjian Jual Beli: Studi Putusan Nomor 1990/K/PDT/2025. Penelitian ini ditulis guna menganalisis kekuatan hukum perjanjian jual beli tanah di bawah tangan dan menilai pertimbangan hakim dalam memberikan perlindungan hukum kepada pembeli. Metode penelitian yakni yuridis normatif dengan pendekatan perundang-undangan. Hasilnya ditemukan dalam Putusan Nomor 1990/K/PDT/2025, perjanjian yang telah dibuat oleh para pihak terkait jual beli tanah adalah sah dan bersifat mengikat. Para Tergugat dinyatakan wanprestasi atas mengurus penerbitan sertifikat pengganti maupun proses peralihan hak atas tanah. Selain itu, Majelis Hakim memerintahkan agar sertifikat pengganti segera diterbitkan, dilakukan pemecahan bidang tanah, dan dilaksanakan proses balik nama. Untuk menjamin kepastian pelaksanaan putusan, hakim memberikan kewenangan kepada pembeli untuk mengurus sendiri seluruh proses tersebut apabila penjual tetap lalai. Pertimbangan hukum ini mencerminkan sikap hakim yang berorientasi pada perlindungan hak pembeli beritikad baik sekaligus sebagai upaya menegakkan prinsip kepastian hukum dan rasa keadilan.

In this thesis, the researcher intends to find out the Default in the case of Default in the Sale and Purchase of Land. In this case, the buyer feels disadvantaged by the Seller who has committed an act in the case of default. This study uses a Sale and Purchase Agreement between the Seller and the Buyer with the object of Residential Land. The seller in this case is in the position of Land Owner. (developer). And the buyer in this case is in the position of buyer in the sale and purchase of the land. This study uses a normative juridical method, namely research using a case approach accompanied by the Law. There are three forms of default, namely carrying out what has been agreed, but not as agreed and carrying out what has been agreed, but late in carrying out something that according to the agreement should not be carried out. So in the case of the case entering into one form of default, namely carrying out what has been agreed but not as agreed. The occurrence of a non-compliance with the agreement between the seller and the buyer, namely in the land sale and purchase agreement, in which the initial agreement stated the land area was 20,000M2. If the certificate is broken, the land area exceeds what was agreed upon, the buyer is obliged to pay Rp. 5,000,000 to the buyer.

The rapid growth of online commerce in Indonesia has significantly transformed the way people fulfill their daily needs by providing easier, faster, and more flexible access to goods and services through digital technology. Despite these advantages, the development of e-commerce also presents serious challenges, including rising cases of online fraud, discrepancies between advertised and delivered products, failed transactions, and personal data breaches that threaten consumer privacy. These issues create imbalances in digital contractual relationships, undermining trust and legal certainty for buyers. This study aims to analyze the implementation of the principle of fairness for consumers in e-commerce practices in Indonesia, while also identifying regulatory weaknesses and existing dispute resolution mechanisms. Using a normative legal research approach supported by case studies, the study examines the effectiveness of relevant legal frameworks, particularly the Consumer Protection Law (UUPK) and the Electronic Information and Transactions Law (UU ITE). The findings reveal that although these regulations provide a legal basis for consumer protection, their implementation remains inadequate. Weak supervision of online business actors, limited accountability of platform providers in ensuring transaction security, and complex, costly compensation procedures continue to hinder consumer rights protection. These conditions highlight the urgent need to strengthen consumer protection systems that are more adaptive, efficient, and oriented toward public interest. The study emphasizes the importance of improving online dispute resolution mechanisms, enhancing transparency and responsibility of digital platforms, and expanding digital literacy among consumers. Such measures are essential to ensure that fairness in e-commerce is not only guaranteed normatively, but also effectively realized in everyday digital transactions.

The purpose of this study is to determine the factors that cause business actors (kiosks) to reject coins as a means of payment in sale and purchase transactions at Oeba Traditional Market, Fatubesi Urban Village, Kota Lama Subdistrict, Kupang City and the legal consequences of such rejection in terms of Law Number 7 of 2011 concerning Currency. The benefits of this research are to provide information and knowledge that enriches the study of law and as a consideration or input for the government and information for the community. This research is a type of empirical legal research. The results of this study show: (1) The factors causing business actors (kiosks) in Oeba Traditional Market to reject coins with denominations of Rp200.00 and Rp100.00 as a means of payment in sale and purchase  transactions are community perception factors, refund factors, and practicality factors. (2) The legal consequences of this rejection in terms of Law Number 7 of 2011 concerning Currency are that the sale and purchase agreement can be cancelled because there is no agreement between the parties and the business actor (kiosk) can be punished. The conclusions of this study are (1) The factors causing business actors (kiosks) in Oeba Traditional Market to reject coins with denominations of Rp200.00 and Rp100.00, namely the public perception factor, the refund factor, and the practicality factor. (2) The legal consequences of the rejection are that the sale and purchase agreement can be cancelled and the business actor (kiosk) can be punished. Suggestions from the author are, for the government, it is expected to be more aggressive in conducting socialisation about money and for business actors (kiosks) and the public are expected to treat money properly.

This study employs a qualitative library research method with the aim of analyzing fiqh muamalah in the practice of online buying and selling transactions from the perspective of Islamic law and sharia. The development of digital technology has given rise to various new models of transactions that require Islamic law to remain adaptive and relevant. Online trade is one form of contemporary muamalah that raises several issues, such as the validity of contracts, price transparency, clarity of goods, and the potential for fraud. In fiqh muamalah, the validity of a sale and purchase contract is determined by the fulfillment of its pillars and conditions, namely the presence of contracting parties, a clearly defined object of transaction, and a legitimate agreement. The findings indicate that online buying and selling transactions are valid as long as they comply with sharia principles such as justice, transparency of information, clarity of goods, and the absence of gharar (uncertainty), maysir (gambling), or riba (usury). Thus, Islamic law does not reject technological innovation as long as the substance of the contract remains in line with sharia. This research emphasizes that fiqh muamalah is capable of providing practical and relevant solutions in addressing the challenges of the modern digital economy.

This study examines two main issues related to palm oil trading transactions in Kuala Keritang Village, Indragiri Hilir Regency, Riau Province. The first issue concerns the analysis of pricing mechanisms in palm oil trading, while the second focuses on the review of Islamic business ethics in such transactions. The objective of this research is to understand in detail how the price determination system operates in the local palm oil market and to assess the extent to which these trading practices align with the principles of Islamic business ethics. To address these issues, a qualitative descriptive method was employed. This approach was chosen because it allows for a comprehensive description of facts, data, and trading mechanisms while providing space for critical analysis in relation to Islamic values. Data were obtained through observation, interviews, and documentation, which were then described, analyzed, and discussed in order to answer the research questions thoroughly. The findings indicate that, in general, palm oil trading practices in Kuala Keritang Village are similar to other common trading systems, but they differ in terms of price-setting mechanisms. In practice, the price of palm oil is largely determined by buyers based on market conditions, which often creates injustice for farmers as sellers. From the perspective of Islamic business ethics, this practice does not fully comply with the principles of fairness, honesty, and mutual benefit, which are essential foundations of Islamic economic transactions. The study concludes that violations of Islamic business ethics principles, particularly regarding fairness in pricing, still occur in palm oil trading within the village. Therefore, improvements are needed in the transaction system so that palm oil trading in Kuala Keritang can be carried out in accordance with sharia principles, ensuring justice and mutual benefit for both sellers and buyers.

Penelitian ini membahas Implementasi Konsep Hak Khiyar dalam transaksi jual beli modern, dengan fokus pada transaksi istishna, Cash on Delivery (COD), dan sistem jual beli online melalui e-commerce. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan deskriptif. Hasil penelitian menunjukkan bahwa penerapan Hak Khiyar dilakukan dengan cermat dan sesuai dengan prinsip-prinsip syariah Islam. Konsumen merespons positif terhadap Implementasi Hak Khiyar karena memberikan rasa kepercayaan dan keamanan dalam bertransaksi. Namun, masih terdapat tantangan terkait kurangnya sosialisasi informasi mengenai Hak Khiyar kepada konsumen dan perbaikan dalam efisiensi proses pengembalian barang. Disarankan agar terus meningkatkan upaya sosialisasi dan edukasi tentang Hak Khiyar kepada konsumen untuk memberikan pengalaman berbelanja yang lebih baik dan memuaskan. Kesimpulannya, Implementasi Konsep Hak Khiyar memberikan manfaat dalam membangun hubungan bisnis yang saling menguntungkan antara penjual dan pembeli, sejalan dengan prinsip-prinsip syariah yang mengedepankan keadilan dan kepentingan bersama dalam transaksi.

Sertifikat tanah berfungsi sebagai alat bukti yang sah. Sertifikat memberikan perlindungan hukum bagi pemegang hak, dengan syarat data fisik dan data yuridis tercantum di dalamnya. Terutama dalam jual beli dengan penjual yang tidak diketahui keberadaanya. Penelitian ini menggunakan metode yuridis normatif dengan spesifikasi deskriptif analitis. Penelitian ini mengenai perlindungan hukum bagi pembeli untuk balik nama sertifikat yang penjualnya tidak diketahui keberadaannya dan dasar pertimbangan hukum hakim dalam memberikan putusan terkait perlindungan hukum bagi pembeli serta akibat hukumnya dinyatakan dalam putusan Pengadilan Negeri Tarakan No.57/Pdt.G/2022/PN Tar. Perlindungan hukum dilakukan melalui peradilan sebagai upaya menuntut hak. Majelis Hakim mempertimbangkan dengan adanya bukti surat dan saksi yang dihadirkan. Akibat hukum tergugat terbukti melakukan perbuatan melawan hukum Pasal 1365-1367 KUHPerdata, yang merugikan penggugat dengan menghalangi haknya sebagai pemilik. Kesimpulan 1)pembeli dapat menggunakan sertifikat sebagai alat bukti hak atas tanah meski tanpa bukti lengkap. Serta, pihak dirugikan dapat mengajukan eksekusi rill Pasal 1241 KUHPerdata. 2)majelis hakim mempertimbangkan jual beli sah berdasarkan bukti dan keterangan saksi. 3)Majelis hakim menetapkan tergugat melakukan perbuatan melawan hukum Pasal 1365-1367 KUHPerdata. Tindakan tergugat melanggar hak subjektif, kewajiban hukum, serta asas kepatutan. Saran 1)masyarakat perlu memahami prosedur legal kelengkapan dokumen dalam transaksi tanah untuk mencegah masalah dikemudian hari. 2)majelis hakim harus mencerminkan keadilan, kemanfaatan, dan kepastian hukum melalui pertimbangan serta pengembangan peraturan yang relevan. 3)majelis hakim harus mengutamakan keadilan, kepastian hukum serta mempertimbangkan aspek sosial dan kepentingan umum dalam perkara hal ini peralihan hak atas tanah.

Technological advancements in the financial sector have led to various innovations, one of which is the SPayLater service, which allows consumers to make purchases using a deferred payment or installment system. In practice, this system raises various questions regarding the validity of transactions from the perspective of Islamic Economic Law, particularly in terms of compliance with the principles of sale and purchase contracts, as well as the potential presence of riba (usury) and gharar (uncertainty).This study aims to examine the validity of SPayLater transactions by analyzing the contracts used, potential violations of the principles of murabahah, ijarah, or qardh, and the extent to which this service complies with the conditions and pillars of sharia-compliant sale and purchase. The approach used is qualitative, analyzing Islamic legal literature, fatwas issued by Indonesia’s National Sharia Council (DSN-MUI), as well as case studies of SPayLater services in Indonesia. The findings indicate that SPayLater transactions have the potential to involve riba if there are non-transparent additional charges. Furthermore, late payment penalties and unclear contracts may give rise to gharar, which could render the transaction invalid under Islamic law. Therefore, it is necessary to modify the contracts to better align with sharia principles and to enhance transparency in the payment mechanisms in order to avoid elements of riba and gharar.

The land transfer process in Batam City requires a transfer permit from the Batam Supervisory Agency (BP Batam), considering that all land rights in the city are under the Land Management Rights (HPL) regulated by BP Batam based on Presidential Decree Number 41 of 1973. Land that falls into this category requires strict procedures and regulations, including the transfer of rights through a sale and purchase involving authorized parties. This study aims to identify weaknesses in regulations related to the transfer of joint assets, especially inherited land, through current sale and purchase. This study uses a normative juridical approach with a descriptive analysis of applicable laws and regulations, to explore issues related to the transfer of joint assets in the form of inherited land. The main focus of the study is to identify weaknesses in the regulations governing the transfer of rights to inherited land through sale and purchase transactions. The results of the study indicate that the regulations governing the transfer of joint assets in the form of inherited land through sale and purchase have several weaknesses that require attention. These weaknesses consist of three aspects: weaknesses in legal substance, weaknesses in legal structure, and weaknesses in legal culture. In terms of substance, existing regulations do not provide clear and firm provisions regarding the distribution of inherited land rights within the family. Meanwhile, in terms of legal structure, there is still a discrepancy between applicable regulations and current practices. Weaknesses in the legal culture include a lack of understanding and legal awareness in society regarding the transfer of joint property. Therefore, this study emphasizes the need for the state to play a role in protecting the legitimacy of joint property within families, particularly regarding the transfer of inherited land through sale and purchase in Batam City.

Drivers who frequently experience fictitious orders face significant psychological impacts. Stress and frustration are common reactions when they have to face situations where they have used time and resources to respond to orders that are not taken or canceled without clear reasons. The research methodology used in this study is a qualitative approach with a case study method. The qualitative approach was chosen because it aims to understand in depth the legal impact of combining sales and purchase agreements and debts on fictitious online motorcycle taxi order transactions, especially from the perspective of online motorcycle taxi drivers. The case study method was chosen because it allows researchers to investigate in depth one particular case, namely online gofood drivers in Desa Tengah, Pancur Batu, who experienced financial losses due to fictitious orders. Based on the findings of this study, it can be concluded that fictitious orders in online motorcycle taxi services, as analyzed in the context of combining sales and purchase agreements and debts according to Islamic jurisprudence, have significant impacts both in terms of law and psychology. Legally, this practice violates the principle of a valid contract according to the fiqh of Al Masyqhul la Yusyghal, because it involves elements of fraud that are detrimental to drivers. Psychologically, drivers experience stress, frustration, and anxiety that have the potential to disrupt their overall well-being.

Law Number 5 of 1960 concerning the Basic Agrarian Principles Article 5 states that customary law in the context of land sale and purchase adheres to the principles of clarity and cash payment. Therefore, the drafting of a land sale and purchase deed is not mandatory to require full payment as long as both parties agree. However, this often leads to legal issues later, including cases where the seller commits a breach of contract (default). For this reason, the author conducted this study with the following research questions: 1. What are the legal consequences of the sale and purchase deed concerning default in land sale and purchase transactions carried out by the buyer? 2. How is the legal protection for the seller in the event of a default in a land sale and purchase transaction? The theories used to address these research questions are, first, the theory of agreements, and second, the theory of legal protection. This study employs normative legal research. The research approaches used include a legislative approach and a case approach. The legal material collection technique involves identifying and inventorying positive legal regulations, books, journals, and other legal material sources. Legal material analysis techniques are conducted through grammatical interpretation and legal construction methods. The research findings indicate that land sale and purchase transactions under the principles of clarity and cash payment allow for the drafting of sale and purchase deeds even though the transaction has not been fully paid by the buyer. This creates an opportunity for the seller to commit a breach of contract in such transactions, revealing a lack of preventive legal protection for the buyer. The legal consequence of the sale and purchase deed is that it lacks legal force if it can be proven that a breach of contract occurred during its drafting.

Proses transaksi jual beli tanah sering dilakukan dengan cara mengangsur, maka dibuatlah suatu terobosan dengan dibuatnya akta perjanjian pengikatan jual beli (PPJB) sebagai perjanjian pendahuluan. Namun dalam pelaksanaannya sering terjadi Wanprestasi yang dilakukan oleh pembeli. Permasalahan dalam penelitian ini dirumuskan dalam bentuk pertanyaan penelitian yaitu: 1. Bagaimana kepastian hukum dari Akta Perjanjian Pengikatan Jual Beli (PPJB) yang dibuat dihadapan Notaris?. 2. Bagaimana pertimbangan hukum majelis hakim dalam memutuskan perkara wanprestasi pada Putusan Mahkamah Agung RI Nomor: 1650 K/Pdt/2015? 3. Bagaimana perlindungan hukum bagi penjual dalam perkara wanprestasi pada Putusan Mahkamah Agung RI Nomor: 1650 K/Pdt/2015?. Penelitian ini merupakan penelitian hukum normatif atau disebut juga penelitian hukum kepustakaan (library research). Hasil penelitian: 1. Perjanjian Pengikatan Jual Beli yang dibuat dihadapan Notaris merupakan akta otentik sehingga memiliki kekuatan pembuktian yang sempurna dan tidak perlu dipermasalahkan lagi sehingga terjamin kepastian hukumnya, hal ini sesuai dengan ketentuan Pasal 15 ayat (1) UUJN dan Pasal 38 UUJN. 2. Berdasarkan pertimbangan hukum majelis hakim Mahkamah Agung RI Nomor: 1650 K/Pdt/2015, dalam pertimbangan hukumnya menyebutkan bahwa perkara sengketa Akta Perjanjian Pengikatan Jual Beli yang mengandung unsur wanprestasi yang dilakukan oleh pihak pembeli (HENDRA PANGESTU). 3. Perlindungan hukum bagi penjual setelah pembeli dinyatakan wanprestasi pada akta pengikatan jual beli yaitu mengacu pada putusan Mahkamah Agung RIyaitu dibatalkannya Akta Perjanjian Pengikatan Jual Beli tersebut, maka Penggugat secara hukum memiliki hak atas objek sengketa tersebut dan uang pembayaran tahap I (pertama) dan tahap II (kedua) menjadi milik pihak penjual selaku Penggugat dan tidak dapat diminta kembali.

With increasingly sophisticated technological developments, all sales and purchase transactions can be carried out online through various platforms including websites, social media, e-commerce and other platforms. However, online transactions can cause legal problems. One of the legal problems that often involves the sale and purchase agreement between the seller and the buyer is a breach of contract. Court Decision Number 629/Pdt.G/2020/PN Jkt.Sel is one of the cases of online sale and purchase breach involving Celvin as the buyer as the Plaintiff with Satrya as the owner of the brand "Namastudios" as the Defendant. This article raises the formulation of the problem regarding the legal remedies available to the injured party in the case of an obligation in the decision Number 629/Pdt.G/2020/PN Jkt.Sel involving default in online buying and selling transactions and the implications of the decision Number 629/Pdt.G/2020/PN Jkt.Sel on consumer protection in online buying and selling transactions in Indonesia.
