Hikmah : Jurnal Studi Pendidikan Agama Islam 2025 Asosiasi Riset Ilmu Pendidikan Agama dan Filsafat Indonesia

This study analyzes the implementation of Islamic inheritance law (mawaris) in contemporary Muslim society as a means to realize justice and blessing (barakah) in the distribution of inherited wealth. The research is motivated by the growing number of inheritance disputes caused by limited understanding of faraid principles, the persistence of customary inheritance practices, and the coexistence of national legal systems that often diverge from Islamic inheritance regulations. These conditions frequently lead to unequal distribution and family conflicts. The study aims to examine the relevance of mawaris in modern contexts and to explore how its application, when aligned with the objectives of Islamic law (maqasid al-shariah), can address current social challenges. Employing a qualitative method with a normative library research approach, the study draws on primary sources such as the Qur’an, Hadith, and classical fiqh texts, as well as secondary sources including contemporary books and scholarly journal articles. Data were analyzed through content analysis to identify key concepts and arguments regarding the contemporary application of mawaris. The findings show that proper implementation of Islamic inheritance law fosters justice, minimizes family disputes, strengthens kinship ties, and safeguards the blessing of wealth. Nevertheless, insufficient public literacy on Islamic inheritance law and the dominance of non-sharia considerations remain significant barriers. Therefore, the study underscores the need for enhanced public education, greater involvement of religious scholars in inheritance mediation, and contextual integration of Islamic legal principles to ensure fair and beneficial inheritance distribution in modern Muslim families.

AL-MUSTAQBAL: Jurnal Agama Islam 2024 STIKes Ibnu Sina Ajibarang

Education plays a crucial role in optimally developing and directing students' potential. In the current educational context, learning outcomes are assessed based on students' abilities to solve problems, reason, communicate, and demonstrate knowledge and attitudes. However, preliminary studies at MAN 1 Banjarmasin revealed that only 62.85% of the XI Agama class students met the Minimum Completeness Criteria (KKM) of 75 in Fiqh subjects, while the rest failed. This study aimed to improve learning outcomes in the topic of Mawaris by using an Android-based learning media, the "Kalkulator Waris" application. This Classroom Action Research (CAR) was conducted through two cycles following the model proposed by Arikunto, comprising planning, action, observation, and reflection phases. In the first cycle, the average student score was 73.63 with a 62.85% success rate. After refining the learning process, the second cycle showed significant improvement: the average score rose to 88.17, and all students (100%) achieved mastery. The use of the "Kalkulator Waris" application facilitated students’ understanding of complex inheritance calculations, enhanced learning engagement, and fostered a more active, creative, and problem-solving learning environment. The findings suggest that appropriate use of Android-based educational applications can significantly enhance learning outcomes, particularly in complex subjects like Islamic inheritance law.

This research aims to determine the heirs in the żawil arḥȃm group according to Islamic law. And to find out the position of żawil arḥȃm in inheritance from the perspective of Islamic law. This research was carried out using library research and paying attention to the field (Field Research). Literature study is a process of searching for various literature, the results of studies related to the research to be carried out. Literature study can be likened to a key that will open everything that can help solve research problems. The results of the research show that the heirs in the żawil arḥȃm group are (1) maternal grandfather, (2) every grandfather or grandmother who dies gets an inheritance, (3) grandchildren from the daughter's side, (4) daughters from the brother's side. son, (5) Sister's son, (6) Mother's brother's son, (7) Mother's uncle, (8) Uncle's daughter, (9) Father's aunt (father's sister), ( 10) Maternal uncles and aunts (mother's brothers and sisters). This is explained by Imam Nawawi in the book Raudhatut Thâlibîn, and Wahbah Zuhaili in the book al-Fiqhul Islam wa Adillatuhu. Meanwhile, according to the Malik and Syafi'i schools of thought, dzawil arham does not inherit. If someone dies without leaving dzawil furudh or ashabah, while he has żawil arḥȃm, then tirkah is given to Baitul mal. Because in the verses Mawaris only explains the ashabul furudh and ashabah parts. Allah does not mention the żawil arḥȃm part at all. Meanwhile, Abu Hanifah and Ahmad are of the opinion that żawil arḥȃm was given a will based on the word of Allah SWT, Surah Al-Ahzab verse 6. And the position of żawil arḥȃm in inheritance is as a non-permanent heir (outside of fardhu and ashobah experts), and as a place to resolve inheritance problems when there are no fardhu and ashobah experts. And those who do not make the dzawil arham an irregular heir, then the settlement is through radd to the żawil furudh which takes precedence over the inheritance of the żawil arḥȃm, but they inherit together with the person who does not get the radd, namely husband and wife.

Tabsyir: Jurnal Dakwah dan Sosial Humaniora 2023 STAI YPIQ BAUBAU, SULAWESI TENGGARA

This journal reviews the problems that occurred in Pulau Rakyat District regarding the marital law contained in surah An-Nisa' verses 7.8 and 11.12. 'Ulumul Qur'an as one of the sciences in the study of the Qur'an has been well established since the 7th-9th century Hijriyah. Munasabah science (knowledge of the relationship between one sura/verse and another sura/verse) is part of the 'ulumul qur-an. This knowledge is quite urgent in order to make all the verses of the Qur'an as a unified whole. Starting from Az-Zarqashi's opinion that the Koran is not a word that was revealed by accident, by accident, and without a specific goal and purpose. Thus, every use and arrangement of words, construction of verses and surahs (munasabah) and the transition of themes contained therein have the power of the concept as a complete sentence. By using a qualitative research method that focuses on search libraries, the problem that is being discussed in this research becomes a complex matter. Where also presenting resource persons who know in this field. The population in this study are residents who lack knowledge of inheritance law. This study aims to determine the increase in student learning outcomes after using learning media based on the android application "Heritage Calculator". Based on the results of student learning in the previous school year, it was seen that the learning outcomes were low, especially in rosette material. Therefore the authors conducted classroom action research using learning media based on the Android application "Inheritance Calculator". Mawaris learning is fiqh science material that requires accuracy and numeracy skills, so that students are able to apply each part of the heir according to predetermined rules. This study uses action research which consists of two cycles with four steps: planning, implementing, observing and reflecting. The subjects of this study were students of class 9A for the 2022/2023 school year. The research data were obtained from the results of formative tests and observation sheets. From the analysis of student learning outcomes about rose material, it was obtained an increase in learning outcomes from before, namely 62.50% in cycle 1 to 100% in cycle 2 of students who had exceeded the minimum completeness score (KKM) or increased 37.50% with an average learning outcome 73.63 in cycle 1 to 88.17 in cycle 2 or an increase of 14.53 points. The conclusion from this study is that scientific learning using learning media based on the android application "inheritance calculator" can improve student learning outcomes in the science subject in class 9A class 9A MTs Al-Ma'arif Rancalutung.
