Deposisi: Jurnal Publikasi Ilmu Hukum 2025 International Forum of Researchers and Lecturers

Law Number 35 of 2009 concerning Narcotics in Indonesia provides a strong legal basis for regulating the use of narcotics in the medical field. This regulation aims to ensure that the use of narcotics is carried out safely, in a controlled manner and in accordance with the interests of health services. This research aims to analyze legal aspects related to the use of illegal drugs in the medical field, identify challenges in implementing regulations, and provide policy recommendations to overcome existing obstacles. The research method used is normative juridical, with a legal approach and literature studies from various legal and health journals. The research results show that although regulations have been prepared comprehensively, their implementation in the field faces obstacles, such as complicated bureaucracy, lack of education for medical personnel, and social stigma against narcotics use. This hampers patient access to treatment, especially for palliative therapy needs and chronic pain management. The conclusions of this research emphasize the need for strategic steps to increase understanding of medical personnel, simplify administrative procedures, and educate the public to reduce stigma. Thus, existing regulations can be implemented optimally to support public health goals without ignoring aspects of supervision. It is hoped that this recommendation can strengthen the legal system and health services in Indonesia, so that patients' rights to health can be fulfilled more effectively.

This study uses a descriptive qualitative method, with a systematic literature review approach. Data collection techniques are based on literature studies. With this, the collection of research data using literature studies through literature studies from various appropriate reference sources from journals, books, and internet sources to conduct analysis and classification of the issues or topics being studied. This study uses evaluation theory, because it focuses on the extent to which the policy of Law No. 13 of 2003 has been achieved regarding the protection of labor rights in Banten Province. The results of the study related to the Evaluation of Law No. 13 of 2003 Regarding the Protection of Labor Rights in Banten Province show that it has not been running well and is also not optimal. Where there are still many obstacles that occur in implementing the Law as a legal basis for meeting the needs of the workforce as the purpose of the implementation of Law No. 13 of 2003.

The 2024 simultaneous elections in Indonesia are a major challenge in harmonizing regulations covering legislative and executive elections. The background of this research is the existence of overlapping regulations, norm gaps, and technical obstacles in implementation, which have the potential to affect the quality of democracy. This study aims to analyze the effectiveness of harmonization of electoral regulations, identify obstacles in implementation, and provide recommendations for improvement. The type of research used is normative juridical with statutory and conceptual approaches. The results show that regulatory harmonization can be achieved through synchronization between Law No. 7/2017 and implementing regulations, optimizing the role of EMBs, and applying digital technology for transparency and efficiency. The conclusion of this study is that regulatory harmonization is not only important to ensure fairness and equality in the electoral process, but also to increase public confidence in the integrity of elections in Indonesia. The findings are expected to serve as a reference for policymakers in facing the challenges of the 2024 simultaneous elections.

Campus autonomy in Indonesia provides good hope, but there are also many basic problems that disturb the hearts of the people, Especially those related to financial allocation. This study aims to examine the impact of campus autonomy on the implementation of the Single Tuition Fee (UKT) at the State Islamic University of Jakarta, community absorption of UKT, and its adaptation process. The research methodology will involve an in-depth analysis of campus autonomy policies and UKT implementation using naturalistic qualitative methods focused on a case study approach. Data was collected through in-depth interviews with key informants, namely university leaders, lecturers, students, and related stakeholders (n = 19). The data obtained are analyzed thematically. The results of the study are expected to provide a deeper understanding of the relationship between campus autonomy and UKT policies, community absorption, and its adaptation process to higher education accessibility and student experience. Data analysis will include stakeholder perceptions, changes in administrative policies and practices, and the social and economic impacts of UKT implementation. This study will summarize the main findings and their implications for the implementation of higher education management at UIN Jakarta. This research explains important implications for improving the effectiveness of campus autonomy implementation and UKT policies and provides guidance for decision-making at the institutional and government levels.

This article explores the strategic implementation of financial and fiscal policies aimed at enhancing community welfare. It begins by defining key concepts and the importance of sustainable economic growth for societal well-being. The study highlights the role of government spending and taxation in redistributing resources to underserved populations. By analyzing case studies from various countries, the article illustrates successful policy frameworks that have led to improved living standards. Furthermore, it discusses the challenges policymakers face in balancing economic efficiency with equity. The significance of stakeholder engagement in policy formulation is also emphasized, showcasing how community input can lead to more effective outcomes. Additionally, the article examines the impact of social safety nets and public services on reducing poverty and inequality. It advocates for a holistic approach that integrates both financial and fiscal measures to create a comprehensive strategy for welfare enhancement. Ultimately, the findings suggest that well-designed policies can significantly improve the quality of life for all citizens. The article concludes with recommendations for future research and policy development aimed at fostering inclusive growth.

The Bali Concord II Declaration became the basis for the establishment of the ASEAN Economic Community (AEC) which aims to create a single market with five freedoms, including skilled labor mobility. However, Indonesia faces challenges in improving the quality of its human resources to compete in the regional market. Indonesia-Germany cooperation, in terms of vocational education development in Indonesia, offers a strategic opportunity to produce competent graduates according to international standards. Policy support such as Presidential Regulation No. 68 of 2022 on the revitalization of vocational education strengthens this effort, enabling technology transfer, strengthening industry-based curriculum, and improving the quality of teaching staff. Effective implementation is expected to make Indonesia one of the leading countries in skilled labor exports in ASEAN, while strengthening national economic competitiveness in the era of regional integration.

In the implementation of the manufacture of BioSolar or BioDiesel fuel, the government uses a hybrid concept which is by mixing diesel from petroleum with Crude Palm Oil (CPO), this policy is useful in saving the country's foreign exchange where the government reduces the amount of petroleum imports and replaces it with CPO from within the country. Because Indonesia is one of the largest CPO producing countries in the world, through this policy the government can make better use of Indonesia's natural resources. This study uses a qualitative research method with a descriptive approach where researchers observe a phenomenon of increasing levels of palm oil (CPO) in current diesel fuel, namely from B30 to B35.

This paper analyzes the implementation of citizenship rights in Indonesia, focusing on the interaction between public officials and the public. The important role of officials in policy making and implementation, as well as the active role of the public in participation and oversight, are discussed in depth. In addition, the article also presents some solutions to overcome these problems, with the aim of improving the quality of citizens' rights implementation. The implementation of citizenship rights between officials and the public in Indonesia is a complex and dynamic process. Despite the challenges, a commitment to democratic principles and the protection of citizens' rights can strengthen the relationship between officials and communities. With an inclusive and participatory approach, Indonesia can build a more just, transparent and sustainable society. The value of equality means that every citizen has equal rights, equal obligations, and equal standing before the law and government. This value in this reform era is very decisive for the journey of life in society, nation and state, as a signpost in achieving national ideals and national goals. Public participation in the political and decision-making process is essential to maintain the sustainability of democracy. People have the right to be involved in the discussion and determination of policies that affect their lives. Through elections, public forums and various other participatory mechanisms, people can express their aspirations and control public officials. This study analyzes the level of political participation in general elections in rural Indonesia. Through a survey of a number of respondents, this research identifies factors that influence political participation, such as education level, political awareness, and access to information. The results show that the level of political participation in rural areas is still low and is influenced by several obstacles. This research suggests the importance of improving the quality of political education and providing adequate infrastructure to increase people's political participation. As the subject of citizens' rights, the community has a very important role in ensuring these rights are realized. This paper discusses how the community can play an active role in political participation, oversight of the government, and in demanding their rights. The challenges faced by the community in carrying out this role, as well as efforts to increase community participation, are also reviewed.

Sexual violence in the university environment is a significant challenge in creating a safe and supportive educational atmosphere. This phenomenon is influenced by unequal power relations, patriarchal culture, and lack of understanding and application of legal protection. Regulation of the Minister of Education, Culture, Research and Technology Number 30 of 2021 is presented as a legal framework to prevent and handle sexual violence in higher education, with strategic steps such as the formation of the Task Force for the Prevention and Handling of Sexual Violence (PPKS Task Force). This research aims to examine the juridical aspects of protecting students and teaching staff from sexual violence, analyze the implementation of regulations, and identify obstacles faced in their implementation. This research uses a normative-juridical method, which prioritizes the analysis of laws and regulations, legal documents, and related legal theories. The results show that although the regulation has provided quite detailed guidelines, its implementation still faces challenges in the form of social stigma, lack of resources, and gaps between policy and practice. The conclusion of this study emphasizes the importance of continuous evaluation and education to improve the effectiveness of regulations and encourage universities to become agents of change in the fight against sexual violence.

Electronic Health Records (EHRs) have become an important component in the digital transformation of the healthcare system in Indonesia. However, EHR implementation in many health facilities in Indonesia is still fragmentary and not fully integrated. The main challenges in integrating health data into the national health system are issues of interoperability, data security, and inter-institutional coordination. This study aims to identify and analyze the main challenges in integrating health data from various EHR systems into Indonesia's national health system and its impact on the quality of health services, operational efficiency, and data security. The research method used was a descriptive qualitative approach, which combined literature study and in-depth interviews with experts in the field of health information technology and health policy. A literature study was conducted to identify technical, operational, and policy challenges faced in EHR implementation in Indonesia. Expert interviews were used to validate the findings obtained from the literature and provide additional insights into the local context. Thematic analysis techniques were used to organize and interpret the data. The results showed that the lack of common data standards is a major obstacle in the integration of EHR systems in Indonesia.A total of 45% of healthcare facilities adopt HL7 standards, 30% adopt FHIR, and 25% use proprietary systems, leading to the inability to efficiently share data between institutions. In addition, data security issues are also a major concern, with many healthcare facilities yet to implement adequate security protocols. Limited coordination between health institutions also hinders wider integration. Nonetheless, EHR integration has the potential to improve operational efficiency, with up to 25% reduction in administrative time in institutions that have integrated their systems.

This study critically examines access to justice for minors who are victims of rape in the context of the Indonesian criminal justice system, with a special focus on the human rights (HAM) perspective. This study is motivated by the high number of cases of sexual violence against children and the complexity of handling them in the Indonesian legal system. The research problem is how to protect human rights for minors who are victims of rape in the law enforcement system in Indonesia. The research method uses qualitative normative legal research by analyzing legal doctrine and related legislation. The research method used is qualitative normative legal research, namely examining various laws and regulations and related literature to understand legal principles and their implementation in the field. The results of the study show that in terms of legal-normative, the protection of children's human rights is regulated in various national and international laws and regulations. However, there are several challenges in its implementation in the field such as limited understanding of law enforcement officers, facilities, and implementing regulations. For this reason, it is necessary to strengthen socialization, legal frameworks and implementation facilities, and continuous evaluation in order to realize universal protection of children's human rights. This study identifies systemic challenges faced by victims in seeking justice, including child-unfriendly legal procedures, lack of psychosocial support, and persistent social stigma. The main findings of this study indicate a significant gap between international human rights standards on child protection and practice on the ground. This study argues for a comprehensive reform of the Indonesian criminal justice system to better accommodate the needs and rights of child victims, including the provision of specialized legal assistance, increased sensitivity of law enforcement officers, and the development of a justice mechanism that focuses on recovery. This study offers concrete recommendations for system improvement, which are expected to serve as a reference for policymakers, legal practitioners, and other stakeholders in efforts to improve access to justice for child rape victims in Indonesia.

Perspektif Administrasi Publik dan hukum 2025 Asosiasi Peneliti Dan Pengajar Ilmu Sosial Indonesia

This study aims to analyze the legal protection of workers' rights due to unilateral termination of employment (PHK) in outsourcing companies in Gorontalo City. The focus of the study covers two main aspects, namely the form of fulfillment of workers' rights affected by layoffs and the inhibiting factors of the Gorontalo City Manpower, Cooperatives, and SMEs Office in providing legal protection. The research method used is an empirical legal approach with data collection through interviews, document studies, and observations. The results of the study indicate that the fulfillment of workers' rights includes severance pay, long-service bonus money, and replacement money in accordance with applicable regulations. In addition, the relevant agencies play a role in providing mediation services and facilitating dispute resolution. However, the implementation of this legal protection faces various obstacles, such as low legal awareness of workers, limited human resources and budget in the Manpower Office, and weak supervision of outsourcing companies. This study emphasizes the need to strengthen labor regulations and increase the effectiveness of supervision to ensure optimal protection of workers' rights. The results of the study are expected to be a reference for policy makers and related parties in improving the legal protection mechanism for workers affected by layoffs.

Changes in the health insurance system in Indonesia continue to evolve, one of which is implementing the Standard Inpatient Class (KRIS) policy as a replacement for the BPJS Health class system based on Presidential Regulation (Perpres) Number 59 of 2024. This policy is designed to unify healthcare classes to reduce disparities in healthcare access and quality in Indonesia. However, its implementation is faced with key challenges, including hospital infrastructure readiness, limited human resources, and criticism from various parties, including patients and healthcare providers. This study uses a qualitative approach with descriptive methods to review various policy documents, relevant literature, and legal and social perspectives related to policy implementation. The results show that although KRIS has the potential to reduce disparities in access to health services, its implementation requires more attention to the readiness of health facilities, strengthening management systems, and budget adjustments to support optimal operations. Furthermore, this policy requires the active involvement of the community and health workers in the evaluation and decision-making process so that the policy is more responsive to the real needs in the field. The theoretical approaches used, such as public policy theory and progressive law, highlight the importance of cooperation between the government, healthcare providers, and communities to ensure effective and equitable implementation of KRIS. This research suggests improving hospital infrastructure, continuous training for health workers, and strengthening a transparent monitoring system to ensure the success of this policy. This research is expected to make a positive contribution to the formulation of health policies that are more inclusive and sustainable and can serve as a reference in efforts to realize a more equitable and fair health service system for all Indonesians.

The development of communication and information technology currently has a major impact on the pattern of public complaints about public services which in the era of digital democracy are inseparable from the dynamics of regional government. The presence of regulations regarding public services through Law Number 25 of 2009 and various derivative regulations in the implementation of regional government is an important part of moving towards a more democratic life. This study aims to discuss the policy of the South Sumatera Provincial Government in handling public service complaints through electronic communication media in the era of digital democracy from a political and public policy perspective. The study uses a combination of normative legal methods and secondary data analysis. The study concludes that politically, handling public complaints about regional government services is a positive thing. In the context of digital democracy and the quality of public services, the response of the regional government to public complaints is a measure of good governance. The issuance of Regional Regulation Number 3 of 2013, Governor Regulation Number 26 of 2016, and Governor Regulation Number 9 of 2022 are concrete manifestations of public policy. As a product of the political process, this is substantively related to public services and public complaints in the digital era. The existence of an electronic complaint channel regarding public services opens up space for increasing public awareness of their rights. Political life will be more democratic when communication between the government and the people runs functionally. There are several regional policy substances that need to be improved.

Based on the author's initial observations, it is known that the Public Works, Transportation, Communication and Informatics Agency of Pangandaran Regency in implementing the waste/cleanliness service policy is not optimal. The research method used in this study is a descriptive research method with a qualitative approach. The primary data in this study is data obtained from interviews with informants directly. While secondary data sources are data collected from other sources which can be in the form of documents related to the problem being studied, The Public Works, Transportation, Communication and Informatics Agency in Pangandaran District, Pangandaran Regency has not been able to implement policies on waste management properly. This can be seen in the implementation of waste management which is not in accordance with the waste management mechanism according to Law of the Republic of Indonesia Number 18 of 2008 concerning Waste Management. The obstacles faced in the implementation of waste management policies by the Public Works, Transportation, Communication and Informatics Agency of Pangandaran Regency are as follows: The technology for waste management is not yet available, Waste sorting has not been carried out by separating organic and non-organic waste, and The place and machine for recycling waste are not yet available. Efforts made to overcome obstacles in the Implementation of Waste Management Policies by the Public Works, Transportation, Communication and Informatics Agency in Pangandaran District, Pangandaran Regency, namely: Submitting an application to the local government so that waste shredding and recycling machines are budgeted in the upcoming APBD, Cooperating with third parties (private sector) in terms of waste management and sorting, and Designing a place to recycle waste.

This research aims to analyze and develop a community satisfaction survey work system carried out by the Tanjung Tiram District Head Office, Batu Bara Regency. Community satisfaction surveys are one way to measure the extent to which public services provided by government agencies, in this case the sub-district office, meet the needs and expectations of the community. This research includes the design, implementation, and evaluation of the system used to collect and analyze survey data. Through representative and systematic data collection, it is hoped that the survey results can provide constructive input for improving the quality of public services in the region. It is hoped that the results of this research can provide useful recommendations for policy makers in optimizing the public service system based on community satisfaction in Batu Bara Regency

The COVID-19 pandemic severely impacted Indonesia, leading to substantial socio-economic disruptions and widespread social anxiety. In response, the government implemented a range of measures, including restrictions and mandatory health protocols, to control the virus. Although the pandemic is officially declared over, the risk of infection remains. Therefore, continued adherence to health protocols is essential. This study aimed to identify the key factors driving public compliance with health protocols in the post-pandemic period within Indonesia, providing valuable insights for policymakers to prevent future outbreaks. The findings revealed that knowledge emerged as the most significant determinant of community adherence to ongoing health protocol implementation. Consequently, the government must consistently emphasize the importance of adhering to health protocols whenever individuals are outside their homes.

One of the government's steps to achieve quality public services is the implementation of Regional Regulation of Domestic Affairs No. 4 of 2010 concerning Guidelines for Integrated Regional Administration Services (PATEN). The report of the Minister of Home Affairs No. 318/312/PUM dated February 28, 2011, outlines the implementation of Integrated Regional Administration Services (PATEN). PATEN is carried out with the aim of making cities the center of community services and serving as service points for subdistrict offices within the regencies/cities, ensuring that the geographical areas can be served more effectively and efficiently. This study is a qualitative research aimed at providing a general or descriptive overview of the researched topic. To offer a general or descriptive overview, the researcher relies on field data. The findings of this study solely describe or frame in-depth interviews with research subjects to provide a clear understanding of the analysis of the implementation of Integrated Administration Policy in Tempe Subdistrict, Wajo Regency. With the steps that have been taken, it is expected that PATEN in Tempe Subdistrict can operate more effectively, efficiently, and transparently, in line with its objective of delivering optimal services to the community.

This research examines the formulation of restorative justice-based law enforcement policies for children in conflict with law, focusing on the development and implementation challenges within the juvenile justice system. Using a qualitative descriptive-analytical approach, the study analyzes current policy frameworks, implementation practices, and systemic challenges through comprehensive literature review, in-depth interviews with key stakeholders, and focus group discussions with legal practitioners and child protection experts. The findings reveal that while the legal framework for restorative justice exists, implementation faces significant challenges including limited understanding among law enforcement officers, inadequate infrastructure, and insufficient inter-agency coordination. The study also identifies successful practices and proposes a comprehensive policy framework that emphasizes capacity building, institutional strengthening, and community engagement. This research contributes to the development of more effective and child-centered approaches in juvenile justice systems, providing practical recommendations for policy makers and law enforcement agencies in implementing restorative justice principles for children in conflict with law.

This study aims to describe the Analysis of the Implementation of Policy and Integrated Transportation of Bus Rapid Transit (BRT) in Medan City. The qualitative research method is also known as a method where the research is conducted under natural conditions. This research method is a scientific procedure or approach to obtain data with specific objectives. Data analysis is the process of systematically searching for and organizing data. The data collection techniques used in this study are observation, interviews, and documentation studies. The data obtained are then analysed through three stages: data reduction, data presentation, and verification. The results of the study show that the Medan City Government is currently implementing significant development in urban mobility with two main activities: the development of Bus Rapid Transit (BRT) and the development of Kesawan and Merdeka Square areas. Both activities emphasize the importance of developing pedestrian and cyclist facilities while facilitating the people of Medan City in accessing public transportation. These efforts are positive actions taken by the Medan City Government toward the development of sustainable urban mobility while ensuring that all corners of Medan City can be reached by quality public transportation.
