The policy plan to integrate parking fees into the Vehicle Registration Certificate (STNK), scheduled for nationwide implementation in 2027, has generated debate regarding contractual validity and fiscal justice. From the perspective of Islamic Economic Law, the transformation from a conventional pay-per-use retribution system to an annual prepaid system raises issues related to mutual consent (an-taradin) and the certainty of service benefits. This study aims to analyze the 2027 subscription parking policy using the framework of Maslahah Mursalah and the principle of distributive economic justice to assess its legitimacy as an instrument of public welfare. This research uses a normative legal method with conceptual and statutory approaches. Literature data are analyzed qualitatively through deductive reasoning to derive legal conclusions from general principles of Islamic economics in relation to contemporary fiscal policy. The findings indicate that the policy contains elements of Maslahah Mursalah, particularly in improving bureaucratic efficiency and preventing state revenue leakage (sadd adz-dzari'ah). However, from the perspective of distributive justice, the policy may contain elements of dzulm (injustice) if it is not supported by fair tariff segmentation. Without guaranteed service availability for all payers, mandatory annual parking fees risk being categorized as akl al-amwal bi al-bathil (unlawful appropriation of wealth). Therefore, a zoning-based tariff system is recommended to ensure fairness between obligations and benefits.

This study analyzes the gap between legal certainty and justice in patent protection in Indonesia through a case study of the transfer of patent rights for the Spider Nest Construction. The problem formulation includes two things. First, what is the form of distortion of legal certainty in the transfer of patent rights. Second, how is the violation of the inventor's moral and economic rights and the institutional factors that cause it. The method used is normative juridical with a statutory, case, conceptual, and comparative approach. The results of the study indicate that the distortion of legal certainty occurs because the registration of the transfer of rights only uses a Power of Attorney without an authentic deed, which violates Article 11 of the Patent Law. In addition, the unilateral action of the Directorate General of Intellectual Property to freeze and revoke the freezing of patents without a court decision violates Article 132 of the Patent Law. Violation of moral rights is manifested in the form of false attribution in the JALLA patent. Economic rights are ignored through embezzlement of royalties. The peak of injustice is the accusation of plagiarism against the original inventor for his own development invention. Inhibiting factors include institutional weaknesses within the Directorate General of Intellectual Property, excessive judicial intervention, low human resource capacity, regulatory disharmony, and an unsupportive legal culture. Strengthening strategies include institutional reform, revision of the Patent Law, ratification of international conventions, digitalization, international certification, and the establishment of a specialized intellectual property court. In conclusion, without strengthening integrated intellectual property legal policy, the gap between procedural legal certainty and substantive justice will continue to weaken the national innovation ecosystem.

The principle of justice constitutes the core of debates regarding the permissibility of polygamy in Islamic law; however, the standards used to assess justice in judicial practice still vary between countries. This study comparatively examines how the Malaysian Syariah Court and the Indonesian Religious Court implement the concept of justice as the primary requirement for granting polygamy permits in judicial practice. The research employs a comparative legal approach and normative-juridical analysis of court decisions and statutory regulations applicable in both countries. The findings reveal that although both judicial systems refer to Qur’an Surah An-Nisa verse 3 as the normative foundation, significant differences exist in the mechanisms for proving justice, the consideration of the interests of existing wives, and the role of judges in assessing the feasibility of polygamy applications. Malaysia tends to apply a more structured standard of justice through strict technical regulations, while Indonesia provides broader judicial discretion by considering sociological aspects. Both countries also face similar challenges in translating immaterial justice into objective, consistent, and measurable legal decisions.

This study aims to analyze the position and function of the principle of good faith in the international contract law system and analyze its role in providing legal protection for parties in international business transactions, especially in the context of the free market era. This study uses a normative juridical method with a statutory and conceptual approach to examine the legal provisions related to this principle. The results of the study indicate that the principle of good faith is not only understood as a moral value in contractual relations, but has also developed into a legal norm recognized in various international legal instruments, such as the UNIDROIT Principles of International Commercial Contracts, Principles of European Contract Law (PECL), and the United Nations Convention on Contracts for the International Sale of Goods (CISG). This principle includes subjective aspects in the form of honest intentions of the parties and objective aspects in the form of internationally applicable fairness standards. The principle of good faith plays an important role in the formation, implementation, and resolution of international business contract disputes. Although there are differences in acceptance between civil law and common law systems, the application of this principle can be harmonized through international legal instruments and soft law.  Thus, the principle of good faith is an important basis for realizing fair, balanced and sustainable international business transactions.

This paper attempts to explore the theological meaning of the Book of Job, particularly in the context of Job's suffering and God's justice. The author focuses this writing on understanding faith in suffering, with the aim of providing a deep interpretation of faith in suffering. The Book of Job is part of the Wisdom Books group consisting of 42 chapters, which discuss the suffering experienced by Job himself, and how he responded to the trials given to him by Satan with God's permission. This writing uses qualitative methods and a library research approach. This paper explains that the Book of Job provides a complex picture of the relationship between human suffering and God's justice. The main finding in this writing is highlighting the urgency of deep reflection on trust, tests of faith, and the meaning of life, leading to the conclusion that suffering is interpreted as an instrument of refining faith in God, then guiding believers towards His will and providence. Therefore, the conclusion of this paper is that suffering is interpreted as an instrument of priesthood of God, which then guides humans who believe in God's will and providence.

This study aims to critically examine the concept of economic justice proposed by Abu Ubaid al-Qasim bin Sallam in his work Al-Amwal and to evaluate its relevance to contemporary economic dynamics. The research applies a qualitative approach using a library research method, in which Al-Amwal serves as the primary source, supported by various secondary references related to Islamic economics and theories of distributive justice. The data were analyzed through content analysis to identify Abu Ubaid’s core ideas, followed by a comparative approach to relate his framework to modern economic principles and practices. The findings reveal that Abu Ubaid’s concept of economic justice is both distributive and structural in nature. It not only emphasizes equitable wealth distribution but also highlights the importance of systemic regulation and public policy oriented toward social welfare. Zakat is positioned as a central instrument for wealth redistribution aimed at reducing social inequality and alleviating poverty. Furthermore, the state plays a strategic role in managing public resources transparently and fairly to ensure collective prosperity. Ethical values are also fundamental in economic activities to prevent exploitation, injustice, and imbalance. Overall, Abu Ubaid’s economic thought remains highly relevant in addressing modern challenges, particularly issues of income inequality, social justice, and sustainable development in today’s global economic system.

Qanun Jinayah Aceh is a form of application of Islamic law in the regional legal system which is based on the principle of amar ma'ruf nahi munkar. This principle aims to uphold moral values ​​and prevent deviant acts in society. However, its implementation cannot be separated from containing the limits of sharia enforcement, protection of human rights, and the realization of social justice. This condition shows the need for a critical study of the application of the principles of amar ma'ruf nahi munkar in the Aceh Qanun Jinayah. This study aims to analyze the implementation of the principle of amar ma'ruf nahi munkar in the Aceh Qanun Jinayah and assess its conformity with the principles of social justice. The research method used is normative juridical with a statutory, conceptual, and sociological approach, through a literature study of regulations, Islamic legal literature, and related scientific studies. The results of the study indicate that the principle of amar ma'ruf nahi munkar has become the normative basis for enforcing the Qanun Jinayah, but in practice it still faces challenges in the form of law enforcement that is not fully fair, potential discrimination, and a weak perspective on social justice. Therefore, the implementation of these principles must be proportional, contextual, and oriented toward the public interest. The implications of this research emphasize the importance of integrating the enforcement of Islamic law with the principles of social justice so that the Aceh Qanun Jinayah can be implemented fairly, humanely, and sustainably.

This article explores the concept and implementation of restorative justice in Indonesia, an approach currently at a crucial crossroads within the criminal justice system. Rather than solely focusing on punishment, restorative justice offers a path towards repairing relationships between victims, offenders, and the community, seeking solutions oriented around conflict resolution. Through comprehensive analysis, this paper identifies the philosophical foundations and regulations supporting the adoption of restorative justice, while dissecting the dynamics of its application across various levels of legal processes in Indonesia. However, this noble endeavor is not without its challenges, ranging from institutional resistance and uneven understanding to harmonization with the conventional criminal law framework. Behind every case lies a human story yearning for more substantive justice. Therefore, this article argues that the success of restorative justice does not merely lie in its legal umbrella, but in our ability to understand and embrace the human dimension in every dispute resolution process. Consequently, this paper recommends adaptive and collaborative strategies to strengthen the role of restorative justice, ensuring it can guide our criminal justice system towards a more just and dignified future for all parties.

The legal relationship between doctors and patients is essentially based on an obligation of effort (inspanningverbintenis), rather than an obligation of result (resultaatverbintenis). In practice, however, dissatisfaction with the outcomes of medical services often leads to criminal reports alleging medical negligence, which implies the criminalization of healthcare professionals. On the other hand, Law Number 17 of 2023 concerning Health and the Regulation of the National Police of the Republic of Indonesia Number 8 of 2021 provide broader opportunities for the application of restorative justice in resolving criminal cases, including medical negligence. This research aims to analyze the criteria for applying restorative justice in medical negligence cases at the investigation level, examine resolution patterns oriented toward recovery and justice for all parties, and identify the obstacles faced by investigators in implementing this mechanism. The research method used is normative legal research with a statutory approach and a conceptual approach, conducted through a review of legislation, legal doctrines, and expert opinions in the fields of health law and criminal law. The results indicate that the application of restorative justice in medical negligence cases can, in principle, be carried out as long as it meets the formal and material requirements as regulated in Police Regulation No. 8 of 2021, and aligns with the restorative resolution paradigm promoted by Law No. 17 of 2023 concerning Health. Resolution patterns oriented toward mediation, reconciliation, and reparation are considered more capable of achieving substantive justice for victims while providing protection for medical personnel who lack mens rea. Nevertheless, the implementation of restorative justice at the investigation level still faces various obstacles, including subjectivity in determining compensation, differing understandings among law enforcement officers regarding the boundary between professional error and criminal offense, disagreement between parties, and the pressure of public opinion and social media. Therefore, it is necessary to strengthen regulations, increase the capacity of investigators, and harmonize understanding among stakeholders to optimize the application of restorative justice in medical negligence cases.

Penyuluhan hukum ini bertujuan membangun kesadaran hukum melalui penguatan “konstitusi batin”, yaitu kesadaran nilai moral, etika, dan tanggung jawab dalam diri individu sebagai dasar berperilaku dalam kehidupan pribadi dan sosial. Bagi anak-anak dan remaja di panti sosial, kesadaran hukum tidak cukup hanya melalui pemahaman aturan, tetapi perlu ditumbuhkan melalui pembentukan karakter, kedisiplinan, serta penghargaan terhadap nilai-nilai Pancasila dan norma kehidupan bersama. Melalui pendekatan edukatif dan dialogis, kegiatan penyuluhan hukum oleh Fakultas Hukum UNTAG Semarang di Panti Sosial Pelayanan Anak Tawangmangu Karanganyar ini diharapkan mampu menanamkan pemahaman bahwa hukum hadir untuk melindungi, membimbing, dan menciptakan ketertiban serta keadilan. Dengan terbentuknya konstitusi batin yang kuat, anak-anak diharapkan tumbuh menjadi pribadi berintegritas, sadar hukum, dan bertanggung jawab dalam kehidupan bermasyarakat, berbangsa, dan bernegara.

Abstrak. Penelitian ini bertujuan untuk menganalisis perspektif perempuan dalam kebijakan lingkungan di Indonesia, serta mengidentifikasi sejauh mana perspektif tersebut telah terakomodasi dalam berbagai regulasi dan implementasi kebijakan. Mengingat perempuan memiliki peran strategis dalam pengelolaan sumber daya alam dan menghadapi dampak perubahan lingkungan secara berbeda dibanding laki-laki, maka keterlibatan perspektif mereka menjadi keniscayaan dalam mewujudkan kebijakan lingkungan yang berkeadilan gender. Penelitian ini menggunakan pendekatan kualitatif dengan metode analisis wacana kritis terhadap dokumen kebijakan lingkungan nasional, seperti Undang-Undang Perlindungan dan Pengelolaan Lingkungan Hidup, Kebijakan Strategis Nasional tentang Pengarusutamaan Gender, serta dokumen Rencana Pembangunan Jangka Menengah Nasional. Data juga diperoleh melalui wawancara mendalam dengan para aktivis lingkungan perempuan, akademisi, dan pembuat kebijakan. Hasil penelitian menunjukkan bahwa meskipun secara normatif kebijakan lingkungan di Indonesia telah mengakui pentingnya partisipasi perempuan, namun dalam praktiknya perspektif perempuan masih sering terpinggirkan dan belum menjadi pertimbangan utama dalam penyusunan kebijakan. Beberapa faktor penyebabnya antara lain: dominasi narasi teknokratis yang maskulin, lemahnya mekanisme partisipasi publik yang sensitif gender, serta masih adanya bias budaya dalam kelembagaan. Penelitian ini merekomendasikan perlunya reformasi kebijakan yang secara eksplisit mengintegrasikan perspektif perempuan, penguatan kapasitas kelembagaan dalam pengarusutamaan gender, serta peningkatan ruang partisipasi publik yang setara bagi perempuan dalam setiap tahapan kebijakan lingkungan.

The application of a uniform pattern in center-periphery relations is frequently entrapped in a rigidity of uniformity that neglects the sociological and historical complexities of Indonesian society. This study aims to analyze the juridical construction of asymmetric decentralization within the framework of the Pancasila Rule of Law, as well as its implications for the management of diversity and national integration. Employing a normative legal research method with conceptual and statutory approaches, this study reveals that asymmetric decentralization is not merely an administrative deviation, but rather an imperative manifestation of substantive justice and the politics of recognition towards regional particularities. Although this policy has been effective in mitigating disintegration potential in special regions such as Aceh and Papua, its implementation leaves residual issues regarding sharp disparities in authority, potential legal fragmentation, and inter-regional jealousy. This study concludes that the sustainability of special autonomy necessitates a governance reconstruction that is not solely oriented towards temporary political accommodation, but must be coherently integrated with Pancasila values. The theoretical implications of this study underscore the necessity for harmonization between national legal supremacy and the flexibility of regional autonomy to foster sustainable social cohesion within the Unitary State of the Republic of Indonesia.

This research explores how monopoly markets operate in the context of a sharia-based microeconomy, with a primary focus on how prices are regulated based on the principle of adl or justice. Unlike traditional monopolies, which often create inefficiencies in resource allocation and exploit consumers, Islamic teachings require fair prices, in accordance with the Quran's prohibition of gharar (uncertainty) and zulm (oppression). Referring to the theories of Ibn Taymiyyah and modern thinkers such as Chapra, we examine how monopoly companies can achieve maslahah or mutual benefit through profit restrictions, combining prices with zakat, and supervision by a sharia council. Through a simple mathematical model, we prove that monopolies regulated by justice produce better Pareto outcomes than equilibria that only maximize profits, by reducing social losses while still encouraging innovation. Empirical data from Islamic markets in Indonesia, such as halal commodities, support these findings, where regulations can stabilize prices at 15-20% lower. The conclusion of this study highlights the importance of Sharia principles in managing sustainable markets in developing countries, with policy recommendations to reform antitrust rules to align with the maqasid al-Shariah.

Penelitian ini dilatarbelakangi oleh munculnya persoalan yuridis dalam pelaksanaan mekanisme Agunan yang Diambil Alih (AYDA) oleh perbankan, terutama terkait validasi Pajak Penghasilan atas Pengalihan Hak atas Tanah dan/atau Bangunan (PPh TB). Kasus BPR RAY memperlihatkan kebuntuan administratif akibat penolakan validasi pajak oleh DJP, yang menimbulkan ketidakpastian hukum dalam penyelamatan kredit bermasalah. Rumusan masalah mencakup: (1) bentuk pertentangan norma antara POJK 33/2018 dan PMK 261/2016; (2) penyebab disharmonisasi norma; dan (3) akibat hukumnya terhadap pelaksanaan AYDA. Penelitian ini bertujuan mengidentifikasi bentuk, penyebab, dan akibat hukum dari disharmonisasi tersebut. Metode yang digunakan ialah yuridis normatif dengan spesifikasi deskriptif-analitis melalui studi pustaka dan wawancara. Hasil penelitian menunjukkan bentuk pertentangan antara PMK 261/2016 yang mengedepankan pendekatan formal kepemilikan dan POJK 33/2018 yang menekankan substansi penguasaan aset. Disharmonisasi ini disebabkan oleh pengambilalihan AYDA secara sukarela, penafsiran subjek pajak penghasilan, serta ketiadaan regulasi penghubung antarregulator. Akibat hukum disharmonisasi ini terjadi di sektor perbankan, perpajakan dan pertanahan. Hasil penelitian kemudian dianalisis menggunakan teori sistem hukum, teori hukum responsif dan teori keadilan distributif. Dari hasil penelitian ini dapat disimpulkan disharmonisasi norma menimbulkan hambatan dalam praktik AYDA dan menimbulkan akibat hukum di berbagai sektor. Di akhir, peneliti memberikan saran akademik mendorong penelitian AYDA yang multi kasus dengan teori hukum yang lebih variative. Untuk saran praktis penelitian ini menegaskan pentingnya harmonisasi antar regulator sehingga pengaturan AYDA tidak saling bertentangan. Beban pajak sebaiknya disesuaikan dengan prinsip keadilan dan kemampuan membayar. BPR maupun masyarakat dapat menempuh judicial review ke Mahkamah Agung untuk menjamin kepastian hukum dan keseragaman tafsir regulasi

Indonesia’s civil dispute resolution system remains dominated by an adversarial litigation model that prioritizes legal certainty but often neglects the relational and emotional dimensions underlying conflicts. Yet, in many cases such as family, inheritance, or neighborhood disputes the restoration of social relationships is as crucial as formal legal resolution. This study explores the potential integration of restorative justice principles into Indonesia’s civil procedural law as an alternative approach centered on dialogue, accountability, and reconciliation. Employing a normative-juridical approach and qualitative analysis of primary and secondary legal sources, the research finds that restorative justice values align not only with Indonesia’s living law traditions such as musyawarah (deliberative consensus) and customary dispute resolution but also with existing provisions in civil procedure codes. Accordingly, the study proposes the Structured Restorative Mediation (SRM) Model, a procedural framework that embeds restorative principles into both court-annexed and community-based mediation. This model prioritizes relational healing while upholding legal certainty and procedural fairness. Its successful implementation requires regulatory support, enhanced mediator training, and institutional strengthening of community-based dispute resolution bodies. Thus, integrating restorative justice is not merely an innovation but a structural necessity for a more humane, inclusive, and holistically just legal system.

Injustice against women in contemporary Islamic law practice is still a serious problem, especially in cases of divorce, child custody, and the division of common property, which are often decided textually without considering the social, economic, and psychological aspects of women. This phenomenon shows that the application of Islamic law is still normative and does not fully reflect substantive justice as the purpose of maqāṣid al-syarī'ah. This research aims to analyze the nature of justice for women in the modern era, identify the steps needed to realize this justice, and formulate Islamic legal solutions based on maqāṣid al-syarī'ah that can be applied contextually in the religious justice system. The research method used is qualitative with a normative-empirical approach through literature analysis, case studies, and empirical data from religious court decisions and reports of official institutions such as Komnas Perempuan. The results of the study show that justice for women can only be achieved through a dynamic maqāṣid approach, by placing the interests of women and children above the legal-formalities of classical fiqh. The efforts needed include the integration of empirical data in judges' decisions, reform of religious justice policies, increasing the capacity of judges in understanding maqāṣid, and empowering women through legal literacy.

Tanah adalah objek vital yang bernilai tinggi sehingga transaksi jual beli tanah menuntut kepastian hukum agar tidak menciptakan sengketa. Namun, praktik membeli atau menjual tanah secara tunai tanpa melalui PPAT dan tanpa memiliki sertifikat kepemilikan masih banyak terjadi, sehingga menimbulkan berbagai masalah terkait keabsahan dokumen, perlindungan hukum, serta risiko terjadinya sengketa. Latar belakang inilah yang melandasi penelitian dengan judul Perlindungan Hukum bagi Pembeli atas Tanah dalam Perjanjian Jual Beli: Studi Putusan Nomor 1990/K/PDT/2025. Penelitian ini ditulis guna menganalisis kekuatan hukum perjanjian jual beli tanah di bawah tangan dan menilai pertimbangan hakim dalam memberikan perlindungan hukum kepada pembeli. Metode penelitian yakni yuridis normatif dengan pendekatan perundang-undangan. Hasilnya ditemukan dalam Putusan Nomor 1990/K/PDT/2025, perjanjian yang telah dibuat oleh para pihak terkait jual beli tanah adalah sah dan bersifat mengikat. Para Tergugat dinyatakan wanprestasi atas mengurus penerbitan sertifikat pengganti maupun proses peralihan hak atas tanah. Selain itu, Majelis Hakim memerintahkan agar sertifikat pengganti segera diterbitkan, dilakukan pemecahan bidang tanah, dan dilaksanakan proses balik nama. Untuk menjamin kepastian pelaksanaan putusan, hakim memberikan kewenangan kepada pembeli untuk mengurus sendiri seluruh proses tersebut apabila penjual tetap lalai. Pertimbangan hukum ini mencerminkan sikap hakim yang berorientasi pada perlindungan hak pembeli beritikad baik sekaligus sebagai upaya menegakkan prinsip kepastian hukum dan rasa keadilan.

Penelitian ini membahas secara mendalam mengenai perlindungan hukum bagi nasabah dalam sengketa gadai syariah, khususnya yang berkaitan dengan pengembalian barang jaminan setelah pelunasan utang. Perkembangan industri gadai syariah di Indonesia yang sangat pesat menunjukkan adanya peningkatan kepercayaan masyarakat terhadap lembaga keuangan berbasis syariah. Namun, di sisi lain, dinamika ini juga memunculkan tantangan baru dalam aspek perlindungan konsumen, terutama ketika terjadi wanprestasi, kesalahan administrasi, atau kelalaian lembaga gadai dalam menjaga serta mengembalikan barang jaminan milik nasabah. Melalui pendekatan yuridis normatif dan studi kasus terhadap Putusan Pengadilan Agama Banjarmasin Nomor 1112/Pdt.G/2021/PA.Bjm, penelitian ini berupaya menganalisis bentuk tanggung jawab hukum lembaga gadai serta perlindungan yang seharusnya diterima oleh nasabah sebagai pihak yang dirugikan. Hasil kajian menunjukkan bahwa dalam perspektif hukum syariah, barang gadai (marhun) memiliki kedudukan hukum sebagai amanah yang wajib dijaga dengan penuh tanggung jawab oleh pihak penerima gadai (murtahin). Apabila lembaga gadai lalai dalam menjaga atau gagal mengembalikan barang tersebut, maka tindakan tersebut dapat dikategorikan sebagai wanprestasi sekaligus pelanggaran terhadap prinsip keadilan dan hak-hak konsumen. Perlindungan hukum terhadap nasabah diatur dalam berbagai peraturan, antara lain Kitab Undang-Undang Hukum Perdata (KUHPerdata), Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, serta pengawasan yang dilakukan oleh Otoritas Jasa Keuangan (OJK) terhadap lembaga keuangan syariah. Namun demikian, efektivitas implementasi peraturan tersebut masih menghadapi berbagai kendala, seperti lemahnya pengawasan, kurangnya pemahaman masyarakat mengenai hak-haknya, serta minimnya mekanisme penyelesaian sengketa yang cepat dan transparan. Oleh karena itu, diperlukan penguatan sistem pengawasan serta edukasi hukum bagi masyarakat agar prinsip keadilan, kepastian hukum, dan kemaslahatan dalam transaksi gadai syariah dapat terwujud secara menyeluruh.

Perjanjian kredit antara lembaga perbankan dan pelaku usaha mikro, kecil, dan menengah (UMKM) merupakan instrumen penting dalam mendukung pertumbuhan ekonomi. Namun, dalam praktiknya, tidak jarang terjadi wanprestasi dari pihak debitur  yang  berdampak  pada  hubungan  hukum  dan keberlangsungan  usaha.  Penelitian  ini  bertujuan  untuk mengkaji: 1) bagaimana proses pengajuan dan pelaksanaan perjanjian kredit antara Bank BRI dan UMKM Konveksi Parasit di Daerah Istimewa Yogyakarta; 2) apa saja faktor yang menyebabkan terjadinya wanprestasi oleh debitur; dan 3) bagaimana mekanisme penyelesaian wanprestasi yang dilakukan oleh pihak bank. Metode penelitian yang digunakan adalah pendekatan yuridis normatif yang didukung oleh data primer. Spesifikasi penelitian bersifat deskriptif analitis dengan jenis dan sumber data berupa data sekunder yang diperoleh melalui studi pustaka, serta data primer yang diperoleh melalui wawancara dengan pihak terkait. Teknik analisis data dilakukan secara kualitatif untuk menginterpretasikan norma hukum dan fakta empiris secara sistematis. Hasil penelitian menunjukkan bahwa: 1) proses pengajuan kredit dilakukan melalui prosedur formal dengan dokumen pendukung yang sah, dan dituangkan dalam Surat Pengakuan Hutang; 2) wanprestasi terjadi karena kombinasi faktor internal seperti pengelolaan usaha yang kurang optimal dan faktor eksternal seperti penurunan permintaan pasar; dan 3) penyelesaian wanprestasi dilakukan melalui eksekusi agunan, pelaporan ke otoritas keuangan, serta pendekatan persuasif seperti restrukturisasi kredit. Penelitian ini menegaskan pentingnya edukasi hukum bagi pelaku UMKM dan penerapan prinsip keadilan dalam penyelesaian sengketa kredit.
