The rapid development of information technology has brought significant changes to various aspects of life, including business and law. One of the key innovations in this context is Blockchain technology. Blockchain has revolutionized information storage and exchange, particularly in the realm of Indonesian contract transactions. It is a decentralized technology that allows for transactions between two parties who do not trust each other, without the need for a third party. The data in Blockchain is stored across the entire network, ensuring that it cannot be altered by a single party without the agreement of the entire network. Furthermore, Blockchain enhances transparency and accountability in data management. This study employs a normative legal research method with a descriptive approach. The findings reveal that Blockchain technology has significant implications for the protection of personal data and the validity of evidence in civil cases. As the technology continues to evolve, its potential to transform legal transactions in Indonesia is undeniable.

This article examines Indonesia’s public policy on personal data protection in light of Law No. 27/2022, which mandates the establishment of an independent Personal Data Protection Authority (PDP Authority). Despite this legal requirement (Article 58 UU PDP), no such institution has been formed. As a result, there is currently no supervisory authority with the mandate to audit compliance, impose administrative sanctions, or resolve data protection disputes. Enforcement of the law has thus remained reactive rather than preventive, with violations prosecuted only after harm occurs. Experts warn that without a strong implementing agency, deterrence is weak: administrative sanctions cannot be effectively applied and punished violations continue unchecked. Cybersecurity analysts even describe this gap as a national digital protection crisis, as personal data leaks (e.g. millions of citizens’ records exposed in recent breaches) continue unabated. Using a normative legal research approach and literature review, this study analyzes how the lack of the mandated PDP Authority undermines the effectiveness of data protection in Indonesia. The article reviews relevant legal theory on regulatory independence and deterrence, and compares with international best practices (e.g. EU/GDPR). We find that the absence of the agency creates serious implementation gaps, and we urge the government to immediately form the PDP Authority and clarify its powers.

This research is motivated by the importance of preserving the authenticity of the Qur’an as the primary source of Islamic teachings and law, which serves as the foundation for legal certainty within the Islamic Family Law system. Historical records show that the codification process of the Qur’an carried out by Zaid bin Tsabit during the caliphates of Abu Bakr and Uthman bin Affan played a crucial role in ensuring the integrity and uniformity of the revealed text, thereby having significant implications for the validity of Islamic legal arguments. This study aims to critically analyze the role of Zaid bin Tsabit in the Qur’anic codification process and its implications for the certainty of the textual basis (nash) in Islamic family law. Using a qualitative method with a historical-normative approach, this research combines chronological and normative analyses of primary sources such as the works of as-Suyuthi and az-Zarkasyi, as well as secondary sources in relevant academic literature. The findings indicate that the codification process of the Qur’an holds not only historical value but also juridical significance, as it ensures the authenticity of the text as the foundation of Islamic law. Therefore, integrating historical and normative aspects is essential to maintaining the authority of Islamic legal sources in the contemporary era.

This study aims to analyze the legal consequences arising from changes to personal data made by data subjects on the validity of collateral that has been used as security for credit, as well as to examine the forms of legal protection that may be granted to creditors. Changes to personal data such as identity, address, and the debtor’s legal status may lead to legal uncertainty regarding the validity of credit security agreements, particularly those involving Hak Tanggungan (mortgage rights). In this research, the author employs a normative juridical method using statutory and conceptual approaches. The findings of this study show that changes to personal data without notification or updates to the security documents have the potential to create administrative discrepancies and legal risks for creditors during the execution of the collateral. Legal protection for creditors needs to be strengthened through the regulation of the debtor’s obligation to report any changes in personal data, updates to the security certificates, and clear provisions outlined in the credit agreement. Accordingly, legal certainty between the creditor and the debtor can be maintained in line with the implementation of Law Number 27 of 2022 on Personal Data Protection.

Marriage is a physical and emotional bond between a man and a woman recognized by law and religion. In practice, issues often arise regarding the status of joint property acquired during marriage, especially in the event of divorce. To anticipate such disputes, a prenuptial agreement serves as a legal instrument that provides certainty and legal protection for both husband and wife in managing and dividing joint assets, either during the marriage or after divorce. This study aims to analyze the urgency of drafting a prenuptial agreement, identify the legal aspects that need to be included in the deed, and examine its juridical implications. This research employs a normative legal method with a conceptual and statutory approach, using descriptive-analytical techniques, secondary data sources, and qualitative analysis. The findings indicate that a prenuptial agreement has significant urgency in protecting the rights of both spouses in case of divorce. Furthermore, it holds binding legal force and creates juridical implications by clarifying the separation between personal and joint property, thereby ensuring legal certainty for both parties.

This research explores the legal protection of domestic doctors in Indonesia in response to the increasing utilization of foreign doctors (FDs) within the framework of knowledge transfer aimed at improving healthcare services. With the enactment of Law No. 17 of 2023 on Health, the Indonesian government provides space for foreign doctors to practice with simplified licensing procedures, raising legal concerns regarding legal certainty, professional equality, and the rights of patients to clear and honest communication. This study uses normative juridical methods with statutory and conceptual approaches to analyze the legal framework surrounding this issue. The findings show that the implementation of simplified requirements for foreign doctors potentially threatens the professional standing of local doctors and risks violating patient rights. Recommendations include strengthening legal instruments and monitoring mechanisms to ensure that knowledge transfer objectives are met without compromising legal protection and healthcare quality. The legal framework provided by Law No. 17 of 2023 allows foreign doctors to practice with more straightforward licensing processes, but it raises concerns regarding the adequacy of regulatory oversight. Local doctors fear that the simplified procedures for foreign doctors may not guarantee the same level of competency, accountability, and ethical standards. Furthermore, the presence of foreign doctors could lead to a disparity in professional treatment and recognition, undermining the integrity of the medical profession in Indonesia. This study explores how these legal issues intersect with the broader goals of patient protection, ensuring that all medical practitioners, regardless of nationality, adhere to the highest standards of care and ethical conduct. The role of patient rights in this context is critical, as patients must receive clear and honest communication about the qualifications of the doctors treating them, ensuring their right to informed consent is upheld.

The COVID-19 pandemic has accelerated the vaccination program in Indonesia as an effort to mitigate the health crisis. However, this emergency has also opened up opportunities for the widespread circulation of illegal and counterfeit vaccines, threatening public safety. This article aims to analyze the legal implications of this phenomenon through a normative-empirical approach using case studies. Three main cases are analyzed: the 2016 national counterfeit vaccine case, the 2021 illegal COVID-19 vaccine sales case in North Sumatra, and the falsification of COVID-19 vaccine certificates that occurred between 2021 and 2022. The analysis focuses on identifying legal loopholes, weaknesses in the oversight system, and their consequences for human rights protection and the integrity of public health programs. The results show fragmented oversight of vaccine distribution, weak transparency in the vaccine supply chain, and legal sanctions that have not provided a significant deterrent effect on perpetrators of health crimes. These conditions not only threaten individual safety but also undermine public trust in the national vaccination program. Inconsistent law enforcement and weak inter-agency coordination have exacerbated the situation. Therefore, efforts are needed to strengthen stricter regulations, increase synergy between supervisory and law enforcement agencies, and secure an integrated and transparent health information system. These measures are expected to ensure the security of vaccine distribution and enhance the accountability of the vaccination program in Indonesia, thus optimally protecting the public's right to health.

The obligation to seek knowledge holds a central position in Islamic law, grounded in strong normative and theological principles. Islam classifies the pursuit of knowledge as fardhu ‘ain (an individual duty) for essential religious and worldly knowledge, and fardhu kifayah (a collective duty) for broader societal needs. This article explores the legal foundations of this obligation in Islamic jurisprudence and examines its relevance in the context of contemporary education. Using a normative-juridical method, this study analyzes primary Islamic sources such as the Qur’an, Hadith, and the views of classical and modern scholars. The findings show that Islam does not treat knowledge merely as a tool for personal development, but as a moral and spiritual responsibility. In modern educational systems, these values remain highly relevant, particularly in addressing ethical decline and the loss of purpose in learning. This article recommends the integration of Islamic legal perspectives on knowledge into educational curricula to help restore the spiritual and moral aims

The concept of ‘abandoned land’ in the Basic Agrarian Law (UUPA) No. 5 of 1960 faces interpretation challenges that impact the effectiveness of the management of unproductive Cultivation Rights (HGU). This research aims to analyse the reconstruction of the concept of abandoned land in UUPA and its implications for the management of unproductive HGU to support the optimisation of agricultural land use. This research is conducted through normative juridical with qualitative descriptive analysis of laws and regulations, court decisions, and related literature. The research findings show that the concept of abandoned land in the UUPA is still multi-interpretive, especially regarding the criteria of ‘not being cultivated according to the circumstances or nature and purpose of the right’. This has led to inconsistencies in the application of sanctions against HGU holders who leave their land unproductive. Concept reconstruction is needed by clarifying the objective parameters of productivity, the period of neglect, and law enforcement mechanisms. The implications of this research indicate the need for regulatory revisions to strengthen legal certainty in HGU management, as well as the development of more effective policy instruments to prevent abandonment of agricultural land to support national food security and social justice in agrarian reform.

Default, or breach of contract, is a common problem in business transactions and can have significant impacts, both financially and non-financially. This article analyzes the various forms of default, such as failure to fulfill obligations, delays, or non-performance in accordance with the agreement. The impact of default is not only directly related to financial losses—for example through fines or damages—but can also damage business relationships and the company's reputation. Therefore, good contract design is very important in reducing this risk. Effective contract design should include clear clauses regarding obligations, deadlines, and sanctions that apply in the event of a breach. Penalty clauses are often used to provide incentives for the parties involved to fulfill their obligations. Furthermore, in the context of globalization and international transactions, it is important for contracts to include clear dispute resolution mechanisms, such as mediation or arbitration, to avoid escalation of problems. This article aims to provide practical guidance for companies in designing contracts that not only reduce the risk of default, but also ensure the sustainability of mutually beneficial business relationships. The uniqueness of the Sasak community in preparing for the departure of prospective pilgrims to carry out the Hajj can attract the attention of researchers. So this research attempts to look at the traditions that the community carries out when carrying out the Hajj as well as the implications of the Hajj for the Sasak community. This study uses qualitative research using descriptive qualitative analysis by first collecting data through observations regarding what is happening in society, then conducting interviews. Documentation and individual experience to add data about Hajj. The results of this research show that the traditions before going on the pilgrimage for the Sasak people are still preserved today, because this tradition has existed since ancient times, from the time of our ancestors until now, it has been preserved from generation to generation. like tradition. Begawe, the opening of the pilgrimage, selararan and yasinan. The existence of this tradition has implications for the Sasak community, namely that the community has a stronger sense of solidarity, the community can build its social welfare. And for Hajj pilgrims it will be easy for them to return home.

Kematian orangtua akibat COVID-19 dapat menimbulkan rasa kehilangan yang mendalam sehingga menyebabkan remaja yang ditinggalkan harus melalui proses grief hingga mampu mencapai penerimaan. Penelitian ini bertujuan untuk memahami gambaran grief dan proses grief serta faktor-faktor yang mempengaruhi grief pada remaja perempuan pasca kematian orangtua akibat COVID-19. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kasus dan teknik analisis theory driven. Responden dalam penelitian ini berjumlah 3 (tiga) remaja perempuan berusia 18-20 tahun dan telah kehilangan orangtua akibat COVID-19 yang terjadi 1-2 tahun yang lalu. Teknik pengumpulan data menggunakan wawancara mendalam. Hasil penelitian menunjukkan bahwa gambaran grief responden terdiri atas berbagai gejala grief yang menyangkut aspek fisik, sosial, spiritual dan  psikologis. Proses grief melalui 5 tahap yaitu denial, anger, bargaining, depression dan acceptance, tetapi proses yang dialami responden tidak terjadi secara berurutan dan bersifat dinamis menuju penerimaan. Hal tersebut terjadi karena terdapat faktor pendukung antara lain kemampuan menguatkan diri, memiliki cita-cita dan harapan yang kuat, dukungan dari keluarga dan teman serta faktor penghambat antara lain hubungan emosional dengan orangtua yang meninggal, grief yang tidak terantisipasi, lapisan kehilangan, tidak menyaksikan orangtua meninggal hingga dimakamkan, isolasi mandiri setelah kehilangan dan stigma sosial yang negatif. Implikasi penelitian ini yaitu menambah khazanah kajian ilmu psikologi khususnya psikologi klinis, psikologi perkembangan dan secara lebih spesifik mengenai grief pada remaja pasca kematian orangtua akibat COVID-19.

Pengadaan barang dan jasa di pemerintahan desa menjadi kegiatan yang rutin dalam setiap tahun anggaran. Kegitan rutinan yang diselenggrakan untuk segala kegiata pemerintahan di pemerintahan desa menjadi sangat urgen karena berbagai faktor. Salah satunya karena pagu anggaran dari APBN 2022 sangatlah besar. Pagu anggaran tersebut sebesar enam puluh delapan triluin (Rp 68 triliun). Dari pagu tersebut, terdapat porsi besar untuk kegiatan pengadaan barang dan jasa di pemerintahan desa. Adapun rumusan masalah dalam penelitian ini hendak mengkaji bagaimana konsep atau aspek hukum pengadaan barang dan jasa di pemerintahan desa. Metode yang digunakan adalah yuridis normatif. Dari penelitian ini, dapat diperoleh kesimpulan bahwa pengadaan barang dan jasa di pemerintahan desa berbeda dengan pengadaan barang dan jasa di pemerintahan seca umum. Dikecualikannnya pengadaan tersebut tentu meiliki implikasi hukum yang berbeda pula sehingga perlu dilakukan penelitian yang mendalam supaya para pemangku kebijakan di tingkat pemerintahan desa, tidak terjebak pada kasus-kasus hukum di kemudian hari.

Ketentuan Pasal 24C ayat (1) UUD NRI Tahun 1945 memberikan wewenang pada Mahkamah Konstitusi untuk mengadili sengketa kewenangan lembaga negara yang kewenangannya diberikan oleh UUD. Sedangkan sengketa kewenangan antarlembaga negara yang tidak diatur dalam UUD NRI Tahun 1945 mengalami vacuum of norm. Hasil penelitian menunjukkan bahwa: pertama, perlunya diatur  sengketa kewenangan antarlembaga negara yang tidak diatur dalam UUD NRI Tahun 1945 karena Indonesia adalah negara hukum, karena belum tuntasnya pembahasan dalam Perubahan UUD NRI Tahun 1945, karena adanya potensi sengketa kewenangan antarlembaga negara. Kedua, implikasi hukum  penyelesaian kewenangan antarlembaga negara yang tidak diatur dalam UUD NRI Tahun 1945 yang dilakukan oleh Presiden melalui instruksi-instruksi terselesaikannya sengketa. Ketiga, dalam perspektif kehidupan kenegaraan, formulasi pengaturan penyelesaian sengketa kewenangan antarlembaga negara dapat dilakukan melalui tiga opsi : (1) memperluas kewenangan Mahkamah Konstitusi (2) memperluas kewenangan Mahkamah Agung (3) memberikan kewenangan pada lembaga negara lain.

Pasca Amandemen UUD 1945 terjadi perubahan yang mendasar dalam kehidupan ketatanegaraan di Indonesia. Salah satu bentuk perubahan tersebut adalah dikembangkannya prinsip checks and balances. Dengan prinsip ini, setiap lembaga negara memiliki posisi yang sejajar, sehingga dimungkinkan terjadi perbedaan penafsiran dan berimplikasi terjadinya sengketa kewenangan antar lembaga negara yang kewenangnnya diberikan oleh UUD 1945. Sengketa kewenangan antara Presiden dengan DPR dn BPK merupakan contoh konkrit sengketa kewenangan antar lembaga negara yang kewenangnnya diberikan oleh UUD 1945. Metode yang diterapkan dalam penelitian ini adalah yuridis normatif, artinya penelitian ini menggunakan putusan Mahkamah Konstitusi Nomor 2/SKLN-X/2012 dan perundang-undangan sebagai bahan hukum utama dalam penelitian ini. Analisis secara mendalam dilakukan dengan metode penafsiran konstitusi. Hasil penelitian menunjukkan bahwa putusan MK yang menyatakan menolak permohonan I Pemohon dan tidak dapat menerima permohonan II Pemohon adalah tepat menurut konstitusi. Putusan MK tersebut lebih brperspektif hukum daripada politik.
