The legislative body is an institution or council that has the duty and authority to make laws and constitutions in a country. In the general explanation of Law Number 23 of 2014, it is stated that the Regional People's Representative Council, hereinafter abbreviated as DPRD, is a Regional People's Representative Institution which serves as an organizing element of the Regional Government. This research using a qualitative descriptive analysis method, namely by explaining or describing the data obtained by providing logical and correct interpretations in accordance with existing facts and or legal rules that are closely related to this research. So this research is a research that is sourced from primary and secondary data using an empirical juridical approach. Based on the research results, the use of the initiative right of Sikka DPRD members in making local regulations in 2018-2021 is still less than optimal. This can be seen based on data on the number of draft local regulations passed in 2018-2021. The number of local regulations produced by Sikka Regency is 34 (thirty-four) local regulations, including 4 (four) local regulations initiated by the DPRD and 30 local regulations initiated by the Regional Government. DPRD tends to be considered passive in contrast to the Local Government which is more pro-active because the proposal of local regulations (Perda) is more dominated by the regional legislative body than the executive body. The obstacles in the implementation of the legislative function of the DPRD of Sikka Regency are caused by internal factors such as level of education and experience, as well as external factors such as lack of political communication between the DPRD and the Local Government. Based on the results of the study, the author's suggestion is that the proposed local regulations be examined and scrutinized in depth to ensure their legal content and impact on society. The DPRD of Sikka Regency needs to improve the capacity of human resources through training and technical guidance related to the formation of initiative local regulations by involving academics and experts.

In the process of forming a law or legislation, the DPD does not have the power to decide or play a role in the decision-making process at all. Even though there are support requirements to become a member of the DPR. This means that the quality of the legitimacy of DPD members is not at all balanced by the quality of their authority as representatives of the regional people. The aim of this research is to analyze the function and authority of the Regional Representative Council in the Structural Institution of the Republic of Indonesia State Legislative Institution and how to optimize the function and legislative authority of the Regional Representative Council. The type of research we use is normative legal research, namely research carried out by examining the body of literature or secondary data. Strengthening the authority of the DPD by consistently incorporating the Constitutional Court's decisions into statutory regulations and other regulations under it. This is being done pending the issuance of the fifth amendment to the 1945 Constitution. The current revision of the MD3 Law has not yet adopted the authority of the DPD in accordance with the Constitutional Court's decision. The need for the fifth amendment is to reorganize the function of legislation firmly and clearly in the 1945 Constitution, because by reorganizing the function of legislation it will touch all institutions, including the DPR, DPD, President and other institutions.

The administration of government in Indonesia is based on a systemic approach which includes a central government system, called the government, as well as a regional government system. In the practice of government administration, there are concepts of centralization and decentralization that regulate the relationship between central and regional governments. The concept of centralization reflects the characteristic where all authority for administering government is centered in the central government, while the concept of decentralization shows the characteristic where some authority for government affairs, which was previously the responsibility of the central government, is delegated to regional governments . According to Law Number 23 of 2014 concerning Regional Government, the Regional People's Representative Council (DPRD) has a clear position as an integral regional people's representative institution in the administration of government at the local level. DPRD is not just a representative institution, but is also an inseparable part of the regional government structure. The function of the DPRD includes three main aspects, namely legislation, budgeting and supervision. (Kasenda et al., 2020). In an effort to realize this target, the Regional People's Representative Council (DPRD) needs to take concrete steps that can optimally strengthen its role in the context of regional government. The APBD is the implementation of the people's wishes for the government through the DPRD to improve welfare and services to the community. APBD is also the regional government's annual financial planning which is approved by the DPRD and made into policy through regional regulations. As a legislative institution, the DPRD has the responsibility to supervise the use of the budget and the implementation of regional government programs. Effective supervision is expected to increase transparency, accountability, and ensure that the benefits of the programs designed are truly felt by the community, especially those who need it most. Based on this description, the author is interested in conducting further research on the function of the Deli Serdang Regency DPRD in implementing the Regional Revenue and Expenditure Budget in the Development Sector. In formulating regional government policies, both from the executive and legislative branches, the orientation is to pay attention to the welfare of the people. Based on the results of the analysis and discussion, the conclusion is that direct supervision has a positive and significant effect on the effectiveness of supervision. Direct supervision has a positive and significant effect on APBD implementation. Indirect supervision has a positive and significant effect on the effectiveness of supervision. Indirect supervision has a positive and significant effect on APBD implementation. The effectiveness of supervision has a positive and significant effect on APBD implementation. Direct supervision has a positive and significant effect on APBD implementation through the effectiveness of supervision. Indirect supervision has a positive and significant effect on APBD implementation through the effectiveness of supervision.

The journey of the Regional Representative Council (DPD) in the constitution is considered to still not compensate for the dynamics of proliferation of legislation. The reason is that the function of the DPD with the DPR in the field of legislation has been tugging and there has been intense competition in the formation of legislation, on the one hand the existence of the DPR as an institution holding a legislative function born earlier is considered to dominate the formation of legislation. On the other hand, the existence of the DPD as a new institution that is also given a legislative function, its authority is considered to be too small when compared to the authority of the DPR in the process of establishing legislation. Even the DPD is considered to add to the problem of over regulation in Indonesian legislation. Borrowing the term Richard Susskind mentions that hyper regulations or obesity are legal and over regulation. This situation led to the implementation of the DPD's legislative function not being optimal because it tends to be half-hearted. In other words, the existence of the DPD as the holder of legislative power is still under the shadow of the DPR, so it has not been taken into account in the process of establishing legislation in Indonesia, even though it has been corrected by the Constitutional Court through Decision of the Constitutional Court Number 92/PUU-X/2012 and Decision Constitutional Court Number 15/ PUU-XIII/2015, but the decision was ignored.
