Maintenance neglect is a fundamental marital violation and a primary factor in high divorce rates. Currently, normative clashes exist between the classical fiqh approach in the Compilation of Islamic Law, such as the nusyuz concept, and the absolute penal regime in the Elimination of Domestic Violence Act. Furthermore, wives forced to file for divorce lawsuits often face post-divorce financial injustice. This normative research aims to analyze the integration of fiqh and Indonesian positive law to provide comprehensive legal protection for wives. Utilizing statutory and conceptual approaches based on Maqashid al-Shari'ah, the findings highlight the urgency for a gender-neutral reconstruction of nusyuz that includes the husband's nusyuz. Criminal proceedings for economic neglect under the Domestic Violence Act must also be synergized with a restorative justice approach. In the courts, protection can be optimized through the application of judges’ ex officio rights based on Supreme Court Regulation No. 3 of 2017 to secure post-divorce maintenance. The implication of this research demands national regulatory harmonization and the reformulation of court executory instruments to ensure the fulfillment of victims’ rights.

Public legal awareness is an important element in realizing an orderly, just, and law-based social life, as it enables citizens to understand and properly carry out their rights and obligations. In Mekarjaya Village, Gantar District, Indramayu Regency, a low level of public understanding of the hierarchy of laws and regulations is still evident, which has the potential to cause errors in the application of law within families and communities. This condition indicates the need for systematic, contextual, and easily understood legal socialization. This Community Service Program aims to improve the understanding of members of the Paguyuban Istri Peduli regarding the hierarchy of laws and regulations, while strengthening their role as agents for disseminating legal information within the surrounding community. The method employed is descriptive qualitative with a participatory approach through the delivery of materials, interactive discussions, question-and-answer sessions, and joint reflection. Data were collected through direct observation, oral question-and-answer sessions, and participant feedback forms. The results show an increase in participants’ understanding, high levels of participation in discussions, and the ability to relate legal concepts to real conditions. These findings confirm that participatory-based legal socialization is effective in enhancing public legal awareness and encouraging active community involvement at the local level.

Marriage is a basic human need that involves an official agreement between husband and wife, regulating rights and obligations, including the ownership and management of joint property. Under Indonesian law, property acquired during marriage is considered joint property, which often becomes a source of conflict during divorce. To prevent this, Indonesian law recognizes the existence of a marital separation of property agreement, which regulates the separation of assets between spouses from the beginning, whether before or during marriage. A separation of property agreement provides legal protection for personal assets, protects one party from being liable for the partner’s debts, and reduces the potential for disputes during divorce. Therefore, it is important for the public to receive socialization and legal education about the separation of property agreement in marriage to increase understanding of its benefits and protect the rights of married couples in both marriage and divorce. Legal education on this matter can help reduce disputes over joint property and offer better protection for couples who wish to clearly and legally manage their assets.
