This study delves into the philosophical foundations of natural law, contrasting the irrational theories of Thomas Aquinas with the rational perspectives of Hugo Grotius and Immanuel Kant, examining their relevance within Indonesia’s deeply religious and pluralistic context. Aquinas argues that natural law is divinely ordained and serves as a universal moral guide, where law and morality are intrinsically linked. On the other hand, Grotius proposes that while natural law originates from divine will, human reason enables individuals to comprehend it, even without divine revelation. Kant’s philosophy shifts the focus to moral autonomy and the freedom of individuals, emphasizing that legitimate law must be based on principles of universal morality that respect human dignity. In the context of Indonesia, with its diverse religious landscape, integrating these philosophical ideas provides a balanced approach to the interaction between secular law, religious teachings, and moral values. The research adopts a juridical-normative methodology with a conceptual and legislative approach, analyzing secondary legal sources to explore how natural law influences Indonesia's legal system. The findings indicate that while Indonesia's legal system primarily follows positive law, it would benefit from incorporating the moral and spiritual aspects derived from natural law theory. The study concludes that Indonesia’s legal system can achieve a more substantive form of justice by integrating the principles of Aquinas, Grotius, and Kant, thus ensuring a more harmonious blend of legal certainty, moral integrity, and religious principles in the country’s laws.

This paper examines the evolution of international law from its early foundations to its contemporary form. Starting with the basic legal principles, it highlights significant milestones, such as the Peace of Westphalia in 1648, which established the concept of state sovereignty. The study also explores the contributions of Hugo Grotius, who is often regarded as the "Father of International Law," whose work significantly shaped the modern legal framework that governs relations between states. In addition, he analyzed the development of global institutions such as the United Nations, which emerged after World War II and played a crucial role in encouraging international cooperation and advancing international law in the 20th century. Particular attention is paid to treaty law, emphasizing how treaties between countries are important for maintaining global order. Using a qualitative research approach, this study provides a comprehensive understanding of historical and contemporary shifts in international law. It discusses how countries have balanced their sovereignty by pursuing global cooperation and broader peace. These findings underscore important moments in the evolution of international law, offering insights into the ongoing challenges and opportunities for global governance in the modern era.

Salah satu kontroversi yang dominan pada dekade terakhir abad ke-20 ialah pertanyaan: “Apa yang komunitas internasional atau negara lain harus lakukan ketika sebuah negara tidak dapat atau tidak mau menghentikan pelanggaran HAM secara masif dan sistematis dalam wilayahnya (contohnya: perang sipil di Liberia pada tahun 1990, penindasan suku Kurdi di Irak Utara sejak tahun 1990, penindasan sipil di Provinsi Kosovo pada tahun 1999)? Apakah komunitas internasional memiliki kewajiban moral untuk mengintervensi negara itu, yang memiliki kedaulatannya sendiri, melalui intervensi kemanusiaan (humanitarian intervention) untuk mengakhiri pembantaian itu?” Walaupun ada konsensus umum tentang pentingnya intervensi kemanusiaan, tetapi aksi militer ini banyak diperdebatkan dalam bidang moral, hukum, politik, filsafat di dunia internasional. Dalam bidang moral, artikel sederhana ini mencoba mencari dasar moral dari intervensi kemanusiaan menurut teori dari Hugo Grotius. Metode yang digunakan dalam artikel ini adalah studi pustaka.
