The Indonesia Pintar Program (PIP) serves as a strategic state instrument to ensure equitable access to education for children from low-income families, in accordance with the constitutional mandate. However, the prevalence of fund embezzlement poses a severe threat to the fulfillment of these educational rights. This study aims to analyze the structural and institutional dynamics triggering fund misappropriation, evaluate the effectiveness of current oversight mechanisms, and formulate strategies to mitigate such violations. This research employs a normative legal method with a descriptive-analytical approach, utilizing statutory and socio-legal analysis to examine regulations such as Law No. 20 of 2003 and relevant ministerial decrees. The findings reveal that embezzlement is driven by complex structural factors, including data asymmetry between Dapodik and DTKS, weak internal supervision, and a lack of transparency in fund distribution. Furthermore, legal enforcement remains suboptimal, often limited to administrative sanctions due to difficulties in proving mens rea and poor coordination among law enforcement agencies. The study concludes that current oversight mechanisms are insufficient to curb corruption in the education sector. Therefore, comprehensive reform is urgently needed, focusing on the integration of digital data systems, the implementation of e-audits, and the enhancement of civil society participation to ensure accountability. These measures are essential to protect the constitutional rights of children and ensure that education funds reach their intended beneficiaries without leakage.

Public service quality plays a crucial role in ensuring that social assistance is delivered effectively to vulnerable communities. This study aims to analyze the quality of public services in the distribution of social assistance by the Social Service Office of Kerinci Regency and to identify improvement efforts undertaken by the institution. This research employed a descriptive qualitative approach using observation, interviews, and documentation techniques. Informants consisted of Social Service officials, social facilitators, and beneficiary communities. Service quality analysis was conducted using the SERVQUAL dimensions: tangible, reliability, responsiveness, assurance, and empathy. The findings indicate that the social assistance distribution service in Kerinci Regency is generally adequate, particularly in the assurance and empathy dimensions. Beneficiaries feel that services are delivered fairly, transparently, and without discrimination. However, obstacles remain in the tangible, reliability, and responsiveness aspects, including limited service facilities, inaccurate beneficiary data due to incomplete DTKS updates, and delays in assistance distribution in remote areas caused by geographical constraints. To address these challenges, the Social Service Office has implemented periodic data validation, strengthened coordination with village administrations, and optimized digital-based social service information systems. This study provides empirical evidence that can serve as an evaluation reference for local governments in improving transparent, effective, and equitable social assistance services.

This research examines the implementation of social welfare through social assistance funds in Indonesia during the Covid-19 pandemic within the framework of the welfare state theory. Using a normative juridical approach with a descriptive-normative character, the study analyzes the legal foundations, the theory of justice, and utilitarianism as conceptual bases. Two approaches Statute Approach and Conceptual Approach are employed to review key regulations (Law No. 13/2011, Law No. 11/2009, Government Regulation No. 39/2012, and other implementing regulations) as well as the concepts of distributive justice, utility, and the capability principle. Secondary data consists of primary, secondary, and tertiary legal materials collected through literature study and qualitatively analyzed. The findings reveal that programs such as Direct Cash Assistance (BLT), the Family Hope Program (PKH), and the Staple Food Card (Kartu Sembako) represent state interventions aimed at correcting inequality and ensuring citizens’ social rights. The application of the principles of social justice, utility, transparancy, accountability, participation, and sustainability has strengthened the legitimacy of social assistance as a redistributive instrument. However, the main challenges lie in the accuracy of the Integrated Social Welfare Data (DTKS), overlapping recipients, limited public participation, and long-term planning that remains reactive to crises. Evaluation of alignment with welfare state principles reveals that social assistance interventions have helped reduce short-term economic burdens but are not yet optimal in empowering recipients toward self-reliance. Based on these findings, it is recommended to regularly update the DTKS, enhance digitalization and data transparancy, expand participatory mechanisms, and integrate social assistance policies into long-term national development strategies. Thus, social assistance funds can serve not only as emergency aid but also as sustainable instruments to realize social justice and inclusive growth.

This research entitled “Implementation of the Tangerang Smart Scholarship Program Fund Management Year 2023”. The objectives are the effectiveness of fund management and the impact of the of the scholarship program on access and quality of education for students from underprivileged families underprivileged families. The method used is a qualitative approach with data collection through interviews, observation, and literature study. The government makes a program with the aim of prospering the community, one of these programs is the Family Hope Program, where the community receiving the assistance is called KPM, this study aims to answer about the effectiveness of the family hope program that has been made by the government, especially in East Tanjungpinang District. The research method uses a descriptive method with a qualitative approach, using the theory put forward by Sutrisno (2010) which includes program understanding, target accuracy, timeliness, achievement of goals and real changes. The results of the research on the effectiveness of the Family Hope Program for Beneficiary Families in the East Tanjungpinang District of Tanjungpinang City seen from the target of the program policy are correct in accordance with the regulations made, because they follow the DTKS which will be identified in accordance with the data submitted, the timing of the implementation of PKH assistance has indeed been determined by the central government, when it will be disbursed, but overall it can be said that the timeliness of the distribution of assistance has not been maximized, because sometimes the assistance disbursed by the government can advance from the date set by the government. The overall goal of the program to improve the welfare of KPM can be said to be ineffective because the achievement of numbers in 2023 can be said to have not been achieved.  Because it is seen from the direct field that there are still many people who need assistance, and most likely if it is recorded in detail, it falls into the category of those entitled as KPM participants, seen from the real changes provided by the program, it has not been optimal, but it has been enough to help the KPM community with the assistance provided, it can be seen that there are several communities as KPM who are able to manage the assistance provided by PKH for entrepreneurship. The suggestions that can be submitted are, the government, especially the East Tanjungpinang District government and PKH supervisors to continue to strive to advance the community.
