The purpose of this study is to analyze digital transformation in notary services, namely the validity of electronic deeds and the responsibilities of notaries in the era of e-government. This study uses a normative juridical method with a legislative and conceptual approach based on an analysis of relevant regulations, scientific literature, and other legal sources. Data was obtained through literature study and analyzed qualitatively and descriptively to assess the legal certainty and responsibility of notaries in preparing electronic deeds in the era of digital transformation in notarial practice. The results show that digital transformation in the notary field is an impact of information technology developments and e-government policies that change the notary's work processes, including administration, deed preparation, identity verification, and document storage. However, digitization must still comply with the principles of authenticity, legality, data security, and legal certainty in accordance with the characteristics of the notary's position as a public official. This study also found that the implementation of cyber notary in Indonesia still faces normative, technical, and ethical obstacles, such as the absence of comprehensive regulations, limited digital infrastructure, and the risk of identity abuse. Therefore, regulatory harmonization, capacity building for notaries, technology standardization, and effective supervision are needed so that the digitization of notary services can be implemented safely while maintaining the integrity of the profession.

Penelitian ini menganalisis dasar hukum dan tanggung jawab notaris dalam tindak pidana pemalsuan akta otentik berdasarkan Kitab Undang-Undang Hukum Pidana (KUHP) dan Undang-Undang Jabatan Notaris (UUJN). Notaris memiliki kewenangan membuat akta otentik yang berkekuatan hukum sempurna, namun hal ini juga menciptakan celah bagi pemalsuan yang merugikan. Pemalsuan akta termasuk tindak pidana pemalsuan surat, menimbulkan kompleksitas dalam menentukan batas tanggung jawab notaris karena kewajiban verifikasi notaris yang terbatas dalam investigasi materiil, serta adanya perbedaan pendekatan antara KUHP dan UUJN. Penelitian ini menggunakan metode hukum normatif dengan pendekatan statute dan conceptual, mengkaji peraturan dan literatur hukum. Hasilnya menunjukkan bahwa notaris dapat dikenakan sanksi pidana jika terbukti sengaja terlibat dalam pemalsuan. Kesimpulannya, diperlukan harmonisasi antara KUHP dan UUJN untuk memastikan kepastian hukum bagi notaris dan masyarakat, dengan penekanan pada pembuktian unsur kesengajaan (dolus) notaris.

This research examines the implementation of electronic signatures and e-notarization within Indonesia's notarial legal framework, analyzing the tensions between technological innovation and traditional notarial principles. Indonesia has established basic legal recognition for electronic signatures through Law No. 11/2008 on Electronic Information and Transactions (as amended by Law No. 19/2016) and conceptually acknowledged cyber notary in the explanation of Article 15(3) of Law No. 2/2014 on Notary Positions which mentions "the authority to certify transactions conducted electronically". However, significant regulatory and practical challenges persist due to contradictions between digital concepts and traditional notarial requirements such as physical presence during the notarial process. The research reveals Indonesia lags behind many jurisdictions with similar civil law traditions in e-notarization implementation where the integration of digital elements into notarial systems has enhanced efficiency while maintaining security standards. This study proposes a balanced implementation approach that preserves essential notarial functions of authentication and legal certainty while leveraging technology to enhance accessibility and efficiency, requiring legislative reforms, technical standardization, institutional development, and professional training to create a comprehensive e-notarization framework suited to Indonesia's legal context.

In maintaining the security of personal data in the digital era, it is very important to remember that personal data can be used by unauthorized parties for various purposes. This is like the notary profession which is now required to be able to maintain the security of each client's data. Notaries can participate in recording important digital documents, such as deeds and contracts, which can help prevent manipulation. Due to the problems that occur, of course the role of the notary in maintaining data security must be considered, especially in transactions and legal documents. Even though the digital world has changed the way many transactions are carried out, the role of notaries still plays an important role in ensuring the validity, integrity and security of digital documents. Notaries can witness and certify contracts and digital legal documents, making them legally valid. The aim of this research is to explain and analyze the role of notaries in maintaining the security of personal data in the digital era. The approach used in this research is a juridical-empirical approach. The results of this research are that the role of notaries in maintaining data security in the digital era has an important role in validating digital signatures. By verifying identity and ensuring that digital signatures are valid, notaries help ensure security in digital transactions. In addition, notaries can also provide digital certificates that confirm the validity of digital signatures and electronic documents. This certificate is a strong proof of authentication. This is proof that the Notary ensures that digital transactions comply with applicable laws, including data privacy regulations and cyber security regulations. This helps keep data secure.

Online transactions know no boundaries, just use a smartphone or computer connected to the internet so that everyone can search and find what they want. Electronic transactions involving Notaries can be seen in the elucidation section of Article 15 paragraph (3) of Law Number 2 of 2014 concerning the Position of Notary, Notaries have the authority to certify transactions conducted electronically. Cyber Notary has the main function of certifying and authenticating electronic transaction activities. Cyber notary is the concept of utilizing technological developments used by Notaries in carrying out their duties and authorities, such as document digitization, electronic signing of deeds etc. Even though it is stated in the Elucidation of the Notary Office Law, there is still confusion in meaning, a question arises that needs to be studied from this problem, namely how the implementation of electronic transaction certification is carried out by a Notary.

Perkembangan teknologi informasi ini telah memberikan dampak yang cukup signifikan yang memberikan kemudahan dan efisiensi antara manusia tidak terbatas. Salah satu aspek yang terdampak adalah di bidang hukum terutama di bidang Kenotariatan. Salah satu pemanfaatan teknologi dalam peningkatan pelayanan publik adalah adanya Cyber Notary. maka penulis tertarik melakukan penelitian dengan judul “Penerapan Cyber Notary Dalam Pembuatan Akta Autentik Menurut UUJN” permasalahanna Bagaimana pengaturan pelaksanaan keabsahan Akta Autentik yang terbit melalui praktik Cyber Notary, Bagaimana penerapan konsep Cyber Notary Dalam Pembuatan Akta Autentik menurut UUJN dan Bagaimana hambatan dan upaya dalam mengatasi penerapan Cyber Notary di Indonesia. Notaris Menurut Pasal 1 (1) UUJN ialah pejabat umum yang memiliki wewenang membuat akta otentik yang tidak dimilik pejabat yg lain. Cyber Notary adalah konsep yang memanfaatkan kemajuan teknologi bagi para Notaris untuk membuat akta otentik dalam dunia maya serta menjalankan tugasnya setiap hari. penelitian ini menggunakan Pendekatan Normatif Empiris, Spesifikasi penelitian deskriptif analisis berfokus pada sumber data primer dengan Teknik pengambilan Non-Random Sampling. sumber data ini menggunakan data sekunder. Penelitian dapat disimpulkan bahwa Pengaturan Pelaksanaan Keabsahan Akta Autentik Yang Terbit Melalui Praktik Cyber Notary secara umum telah diatur di dalam ketentuan UU ITE). Namun secara khusus berkaitan dengan pelaksanaan cyber notary belum terdapat UU yang mengaturnya. Penerapan Konsep Cyber Notary Dalam Pembuatan Akta Autentik Menurut UUJN menjadi sebuah keharusan. Hal ini dikarenakan perkembangan ITE telah memberikan dampak ke berbagai aspek, salah satunya adalah di bidang Notaris. penerapan cyber notary akan lebih memudahkan bagi Notaris maupun para pihak yang lain terutama jika terdapat kondisi seperti adanya pandemi. Hambatan dalam penerapan cyber notary di Indonesia adalah tidak adanya aturan yang secara khusus tentang cyber notary terutama dalam pembuatan akta otentik dan keabsahannya menjadi alat bukti
