Marriage is the only way to legalize the relationship between men and women in order to realize the happiness of family life. Marriage is also a complement to the religion of Muslims. However, because marriage basically unites two different individuals, it certainly does not rule out the possibility of differences of opinion and other problems. Divorce is the last resort for a marital relationship that can no longer be maintained, divorce can occur for several reasons, including because the couple has changed religions, as contained in the Compilation of Islamic Law Article 116 letter H. Divorce certainly causes a legal consequence, one of which is the effect on children. If the divorce occurs because the wife or a mother has changed, then how is the determination of custody of a child who has not been mumayyiz. The purpose of this study is to find out the judge's considerations in determining child custody due to divorce because the couple changed religion in the decision Number 1515/Pdt.G/2015/PA.Smn. This research is a normative-empirical legal research, this research data uses secondary data consisting of primary, secondary and tertiary legal materials. To complete the secondary data, interviews were also conducted with the judge at the Sleman Religious Court. Based on the results of the research and analysis that has been carried out, it can be concluded that the judge's consideration in deciding the case of determining child custody due to divorce caused by a couple converting (apostasy) at the Sleman Religious Court was given to the Applicant as his father in order to maintain the safety of his child's faith and the best interests for his child and for the sake of the child's future.

Marriage or Marriage is a very strong contract (misaqon ghalidzan) to justify a sexual relationship between a man and a woman for the sake of realizing a happy family life, which is filled with a sense of peace and affection according to the rules approved by Allah.  In legal research, there are two types of research, namely normative (doctrinal) research and empirical research. The type of research used in preparing this thesis is a combination of normative (doctrinal) research and empirical research. The location for data collection in this research was at the Lubuk Pakam Religious Court, Jalan Mahoni No.3 Komp. Deli Serdang Regency Government Offices. The technique of designating a word that is abstract and not manifested in objects, but its use can only be seen through: questionnaires, interviews, observations, exams (tests), documentation, etc. The data analysis technique used in this legal research uses qualitative analysis Based on research results, the factors that cause divorce fall into various categories such as adultery, drunkenness, madness, gambling, leaving one of the parties, prison law, polygamy, domestic violence (KDRT), constant disputes and quarrels, apostasy, and economic problems. In resolving divorce case Number 1255/Pdt.G/2023/PA.Lpk at the Lubuk Pakam Religious Court, the Panel of Judges put forward in-depth legal considerations in deciding the divorce case between Kiki Andriani Binti Giarno (Plaintiff) and Juliandi Nasution Bin Sabran Nasution (Defendant) . The following is a comprehensive explanation of the considerations made by the Panel of Judges in the decision-making process: Based on the process of resolving divorce cases, this shows how the legal system functions to handle domestic disputes by considering various legal factors and relevant facts. So it can be concluded that the factors causing divorce at the Lubuk Pakam Religious Court. In this research, an analysis of the divorce case decision at the Lubuk Pakam Religious Court with Number 1255/Pdt.G/2023/PA.Lpk between Kiki Andriani Binti Giarno as the Plaintiff and Juliandi Nasution Bin Sabran Nasution as Defendant. Based on this decision, there are several main factors that led to the divorce, which reflect the dynamics of the couple's domestic life and are relevant in the general context of divorce at the Lubuk Pakam Religious Court. Changing religions in Arabic is called Riddah. Meanwhile, apostate refers to the perpetrator, namely the person who is an apostate. Riddah linguistically means Ar-rujū'u 'ani al sya'i ilā ghairihi (turning from one thing to another). According to the term, it means leaving Islam to disbelief, either through actions, words, i'tiqad or doubt. Such as believing that Allah SWT, the Creator of Nature, does not exist, Muhammad SAW's apostolate is not true, it justifies actions that are haram, such as adultery, drinking alcohol and wrongdoing, or forbids things that are halal, such as buying and selling, marriage, or denying obligations that agreed upon by the entire Muslim community, such as denying the five daily prayers, or showing behavior that shows that the person concerned has left the Islamic religion, such as throwing the Koran into a landfill, worshiping idols and worshiping the sun.

This research aims to explore theological views on apostasy in the context of Christianity. Apostasy is defined as an act of rejection of one's faith and religious teachings, with a focus on serious spiritual consequences. The main source of insight is the Bible, which provides strong warnings against apostasy, highlighting specific passages such as Hebrews 6:4-6. This verse reflects the theological view that for those who consciously abandon the Christian faith, repentance may no longer be possible. This view reflects the serious spiritual consequences that can separate an individual from the presence of God. Although the Bible provides a strong warning against apostasy, the theological perspective also highlights God's grace and forgiveness. The Bible shows that repentance is always open to those who sincerely desire to return to God. In Luke 15:7, Jesus emphasizes the joy in heaven over one sinner who repents, providing hope that despite the seriousness of the apostasy, God always provides a way for repentance and restoration of a spiritual relationship with Him. Overall, the theological view of apostasy reflects a balance between stern warnings about the spiritual consequences and God's gracious mercy that is always open to those who return to Him.

The laws regulated by Allah in the Qur'an, basically have the aim of realizing and protecting human benefit, both individually and collectively. The Qur'an presents various forms of jinayat, and one of them is jinayat hudud. Shaykhul Islam Ibn Taymiyah Rahimahullah stated that hudud punishment comes from Allah's grace for the welfare of His creatures. The research method used is Library Research. Library Research (Library Research) is research in which data collection is carried out by collecting data from various literature. Etymologically, hudud is defined as a separation or barrier that cannot be crossed because of certain offenses that have punishment. Terminologically, hudud is defined as Allah's prohibition which commands humans to observe it and not approach it. This includes orders to abstain from certain acts that have been regulated and have predetermined penalties. Various Types of Violations of Hudud: Fiqhi scholars understand hudud in a limited and specific sense, which includes categorization of offenses such as adultery, accusation of adultery, theft, vandalism, rebellion, apostasy, and alcohol drinking. Hudud for each of these violations has a predetermined penalty.

The certainty of of being saved is the most important thing that God has given to humans.  However, people often refuse to be led and enter into God’s plan.  As a result of refusing to be led by God, many of God’s people fall away and ultimately turn against God.  Man leaves God and turns to truths outside God considered more correct. Same people think that God is all-loving and forgiving and cannot possibly bear to punish people who believe Him, even though they refuse to be led by God.  How is the salvation of people who refuse to be led by God and even then fall away ? The research in this thesis begins by studying and explaining the meaning of apostasy and the reasons why someone can become apostate.  Continuing with the possibility of whether or not sameone can apostate from God.  To complete it, the author raises several views of theological figures regarding the possibility of apostasy.  The author describes with an exegetical study parts of the Bible verse in the book of Hebrew 5:11 -6:8 which are often used as an cirgue for theological controversy, regarding the possibility of apostasy and loss safety. Conclusions are obtained by comparing, analyzing and provides an interpretation based on the analogy method of faith, the Bible as a basis for measuring truth.  Realizing that humans are obliged to submit themselves to God and obey God’s statements, the author also used methods Neo-Supernatural dialectics. From the results of research exegetically and by proposing premises so the author can conclude that if sameone who has believed in the Lord Jesus Christ then apostatizes, then the certainty of his salvation will be lost.
