Abortion is prohibited under the Indonesian criminal law system. In fact, it is categorized as a crime against life, regulated by several laws and regulations, including the Criminal Code and the Health Law. Indonesian criminal law defines abortion as "Termination of Pregnancy," which is regulated by Articles 299, 346, 347, 348, and 349 of the Criminal Code. These articles clearly and unequivocally prohibit abortion for any reason, including abortion for emergency (forced) reasons, such as rape. This type of research is normative legal research (normative legal research method). The normative legal research method is a library legal research conducted by examining legal literature materials such as Legislation, Judge's Decisions, Books, Journals, Theses and Legal Dictionaries. The results of the study indicate that (1) The Judge imposed a sentence of 2 (two) years. This seems light and unfair because the defendant's actions should have been given a heavier sentence as stated in the case that the defendant had committed his crimes seven times. (2) The judge's considerations in imposing criminal sanctions in Decision Number 1224/Pid.Sus/PN.Mks, concluded that the judge's decision to sentence the defendant to two years in prison was lenient and did not reflect the sense of justice that should have been upheld. This was because the defendant's actions were classified as a serious crime that had a widespread moral and social impact on society.

This study discusses the role of Christian ethics in shaping attitudes towards abortion in Indonesia, which has led to moral, social, and legal debates. The main issues examined are how the biblical view and Christian ethical teachings assess the act of abortion and how the attitude of the church and believers in responding to this phenomenon. The aim of this study is to understand theologically and ethically the position of the Christian faith on abortion, while offering a compassionate pastoral approach to women facing such moral dilemmas. The research method used is descriptive qualitative method, by examining various theological, social, and legal sources to describe in depth the views of Christian ethics on abortion. The results showed that in the view of Christian ethics, human life is a holy gift of God from the womb, so abortion is considered contrary to his will. However, the church and believers are called not only to reject abortion in a normative way, but also to provide mentoring, moral education, and spiritual support for those affected. This study confirms the importance of balance between truth and love in dealing with the issue of abortion as a concrete manifestation of the application of Christian ethics in society.

Aborsi merupakan salah satu isu etis paling kompleks yang terus menjadi perdebatan dalam diskursus publik dan keagamaan, termasuk dalam konteks Indonesia. Penelitian ini bertujuan untuk menganalisis dan membandingkan bagaimana prinsip-prinsip deontologi dan teleologi dalam etika Kristen membentuk pandangan terhadap praktik aborsi. Penelitian ini menggunakan pendekatan kualitatif jenis studi pustaka normatif-deskriptif dengan analisis etika komparatif melalui kajian literatur teologi dan dokumen gereja. Hasil penelitian menunjukkan bahwa pandangan deontologis menekankan nilai intrinsik kehidupan sejak konsepsi berdasarkan perintah ilahi yang mutlak, sementara teleologi mempertimbangkan konsekuensi aborsi bagi individu maupun masyarakat guna mencapai kebaikan terbesar atau mengurangi penderitaan. Kedua pendekatan ini saling melengkapi, meski sering menciptakan ketegangan dalam menentukan sikap. Penelitian ini berkontribusi dalam memperkaya diskursus etika Kristen di Indonesia serta menawarkan kerangka analitis bagi pelayanan pastoral dan pendidikan teologi.

Abortion is a contentious legal and moral issue, as it involves two equally important rights: the right to life of the fetus and a woman's right to bodily autonomy and reproductive health. Under Indonesian criminal law, abortion is generally classified as a criminal offense, as stipulated in the Criminal Code (KUHP). However, exceptions are recognized under specific conditions such as medical emergencies and pregnancies resulting from rape, in accordance with Law Number 17 of 2023 on Health. This study aims to examine the legal boundaries between prohibited and permitted abortions and to analyze the challenges of implementing these provisions in practice. The findings indicate that despite the existence of legal exceptions, implementation remains difficult due to complex procedures, limited facilities, and inadequate understanding among law enforcement and health workers. Therefore, clear technical regulations and cross-sectoral education are essential to ensure fair legal protection for both women and medical professionals.

This research analyzes the legalization of abortion for rape victims in Indonesia from a human rights perspective, based on Law Number 36 of 2009 concerning Health and Government Regulation Number 61 of 2014 concerning Reproductive Health. The study aims to identify the forms of legal protection for rape victims who undergo abortion and to evaluate the extent to which its implementation aligns with human rights principles, particularly the rights to health, security, and dignity. Using a normative legal research method with a literature review, this study found that existing regulations have provided a legal basis for abortion in rape cases as a form of protection. However, its implementation still faces significant obstacles such as social stigma and limited access, which potentially hinder the fulfillment of victims' human rights.

The level of knowledge about abortion attitudes among adolescents in Indonesia is still minimal about abortion knowledge the number of unwanted pregnancies in Indonesia is around 17.5% in adolescents aged 14-19 years, and 20% of abortions are carried out by adolescents. The purpose of this study was to determine the relationship between the level of knowledge and abortion attitudes in female adolescents at SMA X. this study is a type of quantitative research with a cross sectional approach. Data collection was carried out using a questionnaire. The number of respondents was 91 people with a proportional sampling technique, one of which is simple random sampling. The data obtained were processed statistically using the chi-square formula. Based on the results of the analysis, 91 research respondents were obtained, most of whom had age characteristics of adolescents aged 10-18 years, the gender in this studi was female, the results of the study also showed that 91.2% had high knowledge, 8.8% had sufficients knowledge, 2.2% had negative abortion attitudes, 97.8% had positif abortion attitudes. The consclusion of of this study is that there is a relationship between the level of knowledge and attitudes towards abortion in female adolescents at SMA X. With p-value of 0.03˂0.05.

The Timorese tribe has a pamali or prohibition not to be related or marry the same clan in one tribe or blood relations for people who are related by blood will be subject to customary sanctions by the traditional chief. The case of incest rape occurred in Nuapin Village, Fatumnasi District, South Central Timor Regency, this rape resulted in the victim experiencing an unwanted pregnancy by the victim and her family because the victim was pregnant with a child from her blood family which is prohibited in Timorese customary law, so she chose to have an abortion. Law No. 36 of 2009 concerning health and its Implementing Regulations excludes the act of abortion due to rape even though it is prohibited in the Criminal Code. In this case, the act of abortion is carried out as a result of incest rape and will be reviewed based on customary criminal law. The type of research used in this study is empirical research with a sociological juridical approach, namely field research whose object is about events and phenomena that occur in society. Data collection was carried out with two events, namely interviews with 4 people and literature studies. The data obtained were then presented in a qualitative descriptive manner. The results of this study show that: (1) The existence of criminal law prohibits the legalization of abortion due to incest rape, abortion is only allowed in emergency medical conditions in accordance with Law Number 36 of 2009 and Government Regulation Number 61 of 2014. (2). The legality of customary criminal law for abortion due to incest is carried out in Nuapin Village because it is considered to violate customary and pamali law.

The right to life is one of the human rights stated in the constitution of the Republic of Indonesia. In Indonesia, abortion is generally prohibited by law. However, for rape victims, abortion is considered an option that needs to be considered to protect the victim. However, until now there is still legal uncertainty regarding the gestational age limit for abortion for rape victims. The problem formulated is how the law protects victims and the implications of regulatory inequality. Using a normative legal approach, the theoretical study examines human rights, reproductive health, and feminism, which emphasizes the victim's right to choose abortion to reduce suffering. The results of the discussion show the unclear rules on gestational age in the Health Law and PP No. 28 of 2024, which differs from the 14-week limit in the Criminal Code. In conclusion, harmonization of regulations is needed to provide legal certainty for victims and medical personnel in carrying out abortions.

Abortion is a controversial issue that involves debates across various sectors, including legal, religious, ethical, and health aspects. Defined as the termination of pregnancy before the fetus can survive outside the womb, abortion in Indonesia is regulated by Health Law No. 36 of 2009, Article 75, which allows the procedure only in cases of medical emergencies and pregnancies resulting from rape. Despite these regulations, illegal abortions still occur frequently, driven by unwanted pregnancies, economic issues, and social stigma. This paper will discuss various aspects, including the causes of abortion, health impacts, types of abortion in special cases, and the Christian ethical perspective. The research method employed is literature review. The findings indicate that abortion can occur due to various factors such as fear, health issues, socio-economic conditions, and misunderstandings about its consequences. Illegal abortions pose serious risks to women's physical and mental health, including infections, bleeding, emotional trauma, and even death. Medically, abortion may be performed to protect the mother’s life in high-risk pregnancies, such as in cases of uterine cancer or rape. However, from the Christian ethical perspective, abortion is viewed as contrary to God's will, as the fetus is considered a living being that must be protected from conception.

This research aims to analyze efforts to overcome the law of abortion killings committed by children on unborn babies. The type of research used is yuridis normative doctrinal. Data sources were obtained from journal and library sources. The results of the analysis show that the crime of abortion murder was committed by a child. In this case, the judge sentenced the child perpetrator to imprisonment for 6 (six) months and 3 (three) months of work training. And whether the judge's decision is in accordance with the objectives of the sentence, what is certain is that in this case there are 3 theories that contain the judge's decision that fulfills the objectives of the sentence, namely the Absolute Theory, the Relative Theory and the Combined Theory.

Abortion or the scientific language is Abortus Provocatus, is the method most often used to end an unwanted pregnancy, even though it is the most dangerous method. Abortus Provocatus is divided into two types, namely Abortus Provocatus Therapeuticus and Abortus Provocatus Criminalis. Abortus Provocatus Therapeuticus is an abortion provocatus carried out on the basis of medical considerations and carried out by personnel who have received special education and can act professionally. Meanwhile, Abortus Provocatus Criminalis is an abortion provocatus that is done secretly and usually by personnel who are not specially educated, including pregnant women who want to carry out the abortion provocatus. Abortus Provocatus Criminalis is one of the causes of death of women during their fertile period in developing countries.

This study aims to compare the legal framework governing the criminal offense of abortion in Indonesia with the policy on abortion practices in Canada. Using the comparative law method, this analysis investigates aspects of the law relating to abortion, including laws, regulations, and court decisions in both countries. Cultural, religious and social factors are also considered in the context of the different legal approaches to abortion in the two countries. The results highlight significant differences in legal approaches and societal views towards abortion between Indonesia and Canada. The implications of this comparison are discussed to enrich the understanding of abortion law and generate ideas for policy reforms or adjustments appropriate to each country's context. This research contributes to a global understanding of the legal and moral issues related to abortion and provides a foundation for further discussion in developing more effective and humane policies related to abortion at the national and international levels.

Technological advances in all fields always have an impact on society in a nation. Likewise for the Indonesian people. One of the population problems facing the Indonesian nation today is the social behavior of the younger generation, which today is very free. In fact, they will be the next generation of the nation's ideals. This research method was carried out using a statute approach and a conceptual approach containing descriptions of theories, findings and other research materials obtained from reference materials to serve as a basis for research activities. This approach is also known as the literature approach, the judge's consideration in imposing a crime on abortion committed by the defendant is based on the legal basis used by the judge, namely Article 77 A of the Republic of Indonesia Law No. 35 of 2014 concerning the stipulation of government regulations in lieu of Law No. 1 of 2016 concerning the second amendment to Republic of Indonesia Law no. 23 of 2002 concerning child protection became law in conjunction with Article 55 Paragraph 1 to 1 of the Criminal Code. The Panel of Judges in deciding this case looked at the facts at trial and declared the Defendant legally and convincingly guilty of committing a criminal act "participating in committing an act with intentionally carrying out an abortion on a child who is still in the womb for reasons and procedures that are not justified by the provisions of the laws and regulations, based on the judge's considerations, namely the public prosecutor's indictment, witness statements, defendant's statements, evidence, and articles in criminal law regulations. , as well as positive legal considerations, namely the reasons why the defendant committed the act and the consequences of the defendant's actions.

Abortion is a complex issue involving moral, legal and health considerations. Legal exceptions to abortion are a key focus in unraveling the dynamics of this complexity. Legal views and norms regarding abortion have undergone significant changes, reflecting social changes and understandings of women's reproductive rights. This study aims to analyze the regulations and legal views that define legal exceptions to abortion in Indonesia and how they relate to mitigating women's health risks. The research method involved a literature review and juridical analysis. The results show that the Health Law and Criminal Code provide exceptions for abortion under certain medical conditions, but the 40-day maximum time limit has been criticized. The role of certified health workers and constantly updated regulations play an important role. Implementation of legal exceptions remains challenging, especially in remote areas. In responding to this debate, regulations need to consider the humanitarian and psychological aspects of rape victims.

ABSTRAK   Tujuan dilakukan penelitian ini adalah untuk mengetahui kajian tentang tindakan aborsi apabila ditinjau dari perspektif hukum Islam serta mengetahui kajian tentang tindakan aborsi apabila ditinjau dari peraturan perundang-undangan di Indonesia. Penelitian menggunakan metode yuridis. Hasil penelitian menunjukkan bahwa kajian tentang tindakan aborsi apabila ditinjau dari perspektif hukum Islam menunjukkan bahwa tahun 2005 Majelis Ulama Indonesia mengeluarkan Fatwa MUI 4/2005 atas pertimbangan bahwa dewasa ini semakin banyak terjadi tindakan aborsi yang dilakukan oleh masyarakat tanpa memperhatikan tuntunan agama. MUI menyatakan bahwa: a) Aborsi haram hukumnya sejak terjadinya implantasi blastosis pada dinding rahim ibu (nidasi); b) Aborsi dibolehkan karena adanya uzur, baik yang bersifat darurat ataupun hajat; Aborsi yang dibolehkan karena uzur sebagaimana dimaksud pada angka 2 hanya boleh dilaksanakan di fasilitas kesehatan yang telah ditunjuk oleh pemerintah; serta d) Aborsi haram hukumnya dilakukan pada kehamilan yang terjadi akibat zina. Hasil penelitian juga menunjukkan bahwa kajian tentang tindakan aborsi apabila ditinjau dari peraturan perundang-undangan di Indonesia meunjukkan bahwa peraturan perundang-undangan di Indonesa yang mengatur tentang tindakan aborsi yakni pada Kitab Undang-undang Hukum Pidana (KUHP) dan Undang-Undang Nomor 36 tahun 2009 Tentang Kesehatan.   Kata kunci: Aborsi, Hukum Islam, Undang-Undang                                                                 ABSTRACT   The purpose of this research is to find out the study of abortion when viewed from the perspective of Islamic law and to know the study of abortion when viewed from the laws and regulations in Indonesia. The study used juridical methods. The results showed that the study of abortion when viewed from the perspective of Islamic law showed that in 2005 the Indonesian Ulema Council issued MUI Fatwa 4/2005 on the consideration that today there are more and more abortions carried out by the community without regard to religious guidance. MUI states that: a) Abortion is illegal since the implantation of blastocyst in the mother's uterine wall (nidation); b) Abortion is permissible due to old age, whether emergency or emergency; Abortions that are permitted due to old age as referred to in number 2 may only be carried out in health facilities that have been designated by the government; and d) Unlawful abortions are performed in pregnancies resulting from adultery. The results also show that the study of abortion when viewed from the laws and regulations in Indonesia shows that the laws and regulations in Indonesia that regulate the act of abortion are in the Criminal Code (KUHP) and Law Number 36 of 2009 concerning Health.   Keywords: Abortion, Islamic Law, Law

Pregnancy can be good or bad depending on the condition of the mother. Some mothers who do not want their babies choose to have illegal abortions. This has led to the proliferation of illegal abortion clinics that perform abortions not in accordance with the law.  Although the law provides for some justifiable cases of abortion, there is debate about the consequences of punishing abortionists. Judges' verdicts in abortion cases often do not fulfil the purpose of punishment to provide a deterrent and corrective effect. The purpose of this research is to analyse the Case Study of Central Jakarta District Court Decision Number 1140/pid.sus/2020/Pn Jkt Pst on the act of carrying out illegal abortion in accordance with Article 75 of Law Number 36 of 2009 concerning health in relation to the purpose of punishment. This research method is a normative juridical approach. The research specifications used are descriptive analysis. The result of this research is that the Panel of Judges in this case can be considered lacking in considering the mitigating or aggravating circumstances of the defendant when compared to other cases. Consideration of judges who are less mature can lead to unclear objectives of punishment in cases of abortion. The clarity of the human rights of a foetus is questionable in this abortion case. More research and careful consideration by judges is needed to ensure fair and balanced sentencing in abortion cases.

Remaja merupakan kelompok usia yang sangat rentan terhadap resiko triad kesehatan reproduksi antara lain kehamilan yang tidak diinginkan, aborsi, perkawinan dan pernikahan dini, Narkoba, dan HIV/AIDS. Masalah kesehatan reproduksi siswa terkadang diperparah dengan kurangnya pengetahuan mereka tentang kesehatan reproduksi yang sehat. Salah satu cara pemerintah menangani masalah kesehatan reproduksi adalah melalui pendidikan. Remaja akan mendapatakan informasi yang akurat tentang kesehatan reproduksi melalui edukasi. Tujuan penelitian ini adalah mengetahui efektivitas edukasi media vidio terhadap tingkat pengethauan kesehatan reproduksi remaja. Metode yang digunakan yaitu kuantitatif dengan pendekatan penelitian quasy eksperimen dengan metode one group pre-test  dan post-test, responden penelitian ini sebanyak 64 responden. Teknik sampel yaitu menggunakan Random sampling. Hasil penelitian di dapatkan bahwa ada peningkatan penegtahuan sebelum dan sesudah diberikan edukasi media vidio kesehatan reproduksi remaja. Berdasarkan uji statistic marginal homogenity diketahui bahwa p-value =0,0001 (<0,05) yang bermakna terdapat efektivitas edukasi media vidio terhadap peningkatan tingkat pengetahuan kesehatan reproduksi remaja. Berdasarkan penelitian ini,edukasi kesehatan repdroduksi remaja melalui vidio dapat digunakan dalam meningkatkan pengetahuan pemahaman kesehatan reproduksi remaja.

.Penyalahgunaan zat terkait aborsi adalah masalah utama dengan risiko kesehatan dan etika. Praktek ini melibatkan penggunaan obat-obatan yang tidak diatur dan dilakukan tanpa pengawasan medis yang ketat. Fokus utama artikel ini adalah pada penyalahgunaan obat-obatan yang digunakan sebagai alat aborsi. Artikel ini menyajikan ketentuan hukum penyalahgunaan narkoba sebagai sarana aborsi dari perspektif hukum pidana Indonesia dan Islam. Artikel ini bertujuan untuk mengeksplorasi bagaimana hukum pidana Indonesia dan Islam memperlakukan penyalahgunaan narkoba sebagai sarana untuk mengakhiri kehamilan. Penelitian ini menggunakan metode kualitatif. Artinya, penulis tidak menggunakan satu sampel pun. Pengumpulan data dilakukan dengan metode kepustakaan dan penulis mengidentifikasi secara sistematis sumber-sumber yang terkait dengan objek. Setelah menerima data, penulis menganalisis data peraturan hukum yang diperoleh pada subjek penelitian. Hasil penelitian ini menunjukkan bahwa menurut hukum pidana Indonesia dan hukum pidana Islam, penyalahgunaan zat dalam aborsi membawa hukuman yang berbeda untuk dokter, pelaku aborsi dan pelaku aborsi. Hukuman terberat menurut hukum pidana Indonesia adalah penjara dan denda sebesar Rp. 1 miliar bagi pelaku tindak pidana yang dikenai hukuman Ta’zir menurut hukum pidana Islam

One of the benefits of the semiotic approach is being able to examine in more detail the communication conveyed by works of art. In the current digital era, works of art can take the form of photography, videography, and so on, where these works of art can provide meaning or representation of a communication message. One of the works of art in the form of videography is video clips. One example of a video clip is a song entitled "Perfect My Day" sung by Rey Mbayang, which used to be trending 1 on YouTube in the music category. The background of this video is Dinda Hauw's documentary film when she is going through the process leading up to childbirth, this makes the writer interested in analyzing Ferdinand De Saussure's semiotics because the writer also has personal experience in dealing with the birth process. In this research, the researcher uses Ferdinand De Saussure's semiotic analysis method and examines the signs that refer to the video clip for the song "Sempurnaka Hariku" sung by Rey Mbayang. These signs are data such as images and other visual elements, as well as other supporting data, which will be studied and interpreted in the form of words and language. The results of the research on the video clip for the song "Perfect my day" sung by Rey Mbayang has signifiers and signifieds.
