Sexual behaviour or actions that differ from generally accepted sexual norms in the LGBT community should not be considered something that should be taken for granted. This sexual behaviour or action arises because there are variations in individual sexual desires. Sexual orientation and habits refer to a person's desire to express their desire, love, emotions, and sexual activities towards individuals of the same gender, the opposite gender, or both. LGBT is an abbreviation for Lesbian, Gay, Bisexual, and Transgender, which refers to a group of individuals who have a sexual orientation or gender identity that is different from the majority. There are various views in society regarding LGBT, with some rejecting this variation in sexual behaviour while others openly accepting it. The debate regarding LGBT issues is increasingly intense and widespread, with various arguments related to human rights (HAM) and arguments based on religion. This research aims to investigate different views regarding LGBT issues in Indonesia, both from a religious and a human rights perspective.

Waria are one of many different types of sexual intermediaries, including homosexuals and hermaphrodites who occupy the spectrum between pure men and pure women (Susan Stryker, 2008). From this quote, it can be understood that waria is like one who occupies a middle position between the concepts of men and women. The most obvious thing that distinguishes waria from men and women is the way they look that is not in accordance with the general sex that has been assigned to them since birth. Those who are biologically born male, in fact they (waria) look the opposite and resemble women. Waria often receive bad treatment from society such as discrimination, mental and physical violence and other actions that are contrary to morality. On May 2, 2022 waria who are members of the wagayo organization (Waria and gay organization) in Jember, East Java took action to commemorate national education day. From the attached news, the waria provide information that waria also want to get the same place as people in general in the world of education. This is enough to explain the existence of discrimination against transgender women even in the world of education which results in many transgender people being forced to drop out of school because they cannot stand ridicule from both friends and educators at their schools. This has implications for the cause of the low human resources of waria.

Homosexuals or currently better known as LGBT (lesbian, gay, bisexual and transgender) is a phenomenon that has graced the media lately. Starting from the prosecution for legalizing same-sex marriage, the pros and cons of its existence, prostitution of minors for gays to prosecution by certain groups to criminalize homosexuals. Although homosexuals have existed for a long time, it is not yet known for certain the cause of this same-sex liking. Including the debate whether homosexuality is classified as a nuisance, risk or grace (normal). Homosexuality is a feeling of being attracted to the same sex (Stuart, 2013). Homosexuality does not occur between men and men (gay) or women and women. Another understanding according to Behrman, et al (2012) states that homosexuality is a physical and romantic force of the same sex. Currently, the phenomenon of homosexuality is better known as the term LGBT (lesbian, gay, bisexual and transgender). This phenomenon has existed since ancient times, but nowadays homosexual behavior has begun to tend to be carried out openly. This is different from ancient times where homosexual behavior was carried out in secret (Budiarty, 2011).
