This research aims to reveal stability Friedrich Carl Von Savigny’s thoughts on the existence of annual sale and purchase customary love establishment. This research uses legal research methods, namely research carried out on legal norms that develop in society. The approach used is a conceptual and historical approach. The types and sources of data used in this research are primary and secondary data. The results of this research show that the teachings of the historical school initiated by Von Savigny emphasize that law is a reflection of the soul of the people that grows together with the people’s growth of the people and becomes strong together with the people’s strength. Furthermore, in the end, it dies if the nation loses its nationality. Thus, adherents of the historical school reject the view that law is made by an authorized institution, such as by making laws. Meanwhile, customary law that exists in Madurese society as the customary law of the Madurese people in some villages, such as “annual purchase and sale,” as the customary law of the community is maintained in the practice of annual purchase and sale of a plot of land that is perhaps not found in other areas in Indonesia. It is similar to the historical school, namely that law grows together with the growth of society and becomes strong together with the strength of society. Furthermore, in the end, it dies if the nation loses its nationality. This condition is recognized as existing by the constitution of the Indonesian legal state as regulated in Article 18B paragraph (2) of the 1945 Constitution of the Republic of Indonesia.

This study aimed to measure the impact of an educational program on developing emotional intelligence skills among fifth-grade primary school students in several mixed-gender schools in Baghdad. The research adopted the experimental scientific method, utilizing a pre-test and post-test design for two groups. The sample was randomly selected from a research population of 150 students, with 100 students chosen as the study sample. These students were divided into two equal groups: a control group (50 students) and an experimental group (50 students). The educational program was designed based on free dialogue, storytelling, as well as games and activities that help children understand and develop emotional intelligence skills in a smooth and constructive manner. The program was implemented over a period of 12 weeks, from March 1, 2024, to June 1, 2024, exclusively for the experimental group. Daniel Goleman’s 2002 emotional intelligence model was used as a measurement tool, as it is suitable for the age group of the study sample. The results indicated statistically significant differences between the mean scores of the experimental and control groups in the pre-test and post-test, demonstrating the clear impact of the program on the experimental group. Additionally, the results showed no statistically significant differences between male and female students within the experimental group. The researcher recommends adopting the program in primary schools and suggests organizing training courses for primary school teachers on intelligence development in children. Furthermore, the researcher proposes integrating intelligence development into teacher guides and increasing activities that focus on enhancing cognitive abilities.

The epistemology of Islamic theology (kalam) explores the nature, sources, methods, and validity of knowledge within an Islamic framework, balancing reason and revelation. In kalam thought, rationalism with deductive-metaphysical logic dominates, though revelation remains the primary foundation. The debate between the Mu'tazilite school, emphasizing reason, and the Ash'arite school, prioritizing revelation, highlights its epistemological dynamics. However, reliance on bayani reasoning, centered on textual authority, often restricts critique and renewal. Additionally, Islamic theology struggles with limited engagement with empirical reality due to insufficient application of the correspondence theory, which evaluates truth based on factual evidence. The deductive approach of the coherence theory often falls short in addressing contemporary issues, prompting some thinkers to adopt intuitive, Sufistic methods. Criticism of this stagnation has spurred calls for reformulating Islamic theology to address globalization and modernity. To remain relevant, Islamic theology must develop a more contextual and holistic methodology, integrating deductive, inductive, and empirical approaches. By fostering critical analysis and practical solutions, it can continue to serve as a vital tool for developing adaptive and relevant Islamic thought in every era.

This article examines marriage law as a form of uniformity and legal certainty. However, there are still differing views among Islamic scholars (fuqaha) regarding the position of witnesses in marriage. In light of this, the author is interested in discussing the role of marriage witnesses as one of the requirements for marriage according to the four fiqh schools of thought. This research employs a literature review method by collecting primary and secondary data from books, journals, and other legal regulations. The findings show that, according to the four fiqh schools, a marriage witness is an individual who clearly and certainly knows about the marriage event and is ready to provide evidence that can be held accountable if required by either party regarding the occurrence of the marriage. In the context of legal regulations, a marriage witness is recognized as one of the pillars of marriage, based on the view of the Shafi’i school. Two witnesses are the minimum requirement for marriage, and the purpose of having witnesses is to prevent the emergence of negative issues in society related to extramarital relationships. The presence of marriage witnesses also affirms the rights that arise after the marriage contract, such as the right to consultation, maintenance rights, and inheritance rights.
