In Indonesia, the main challenge in achieving the principle of the rule of law is unfair legal practices, where some powerful and rich people can manipulate the legal system for their personal interests. This situation hinders efforts to ensure justice for all people. Therefore, high legal awareness among the public and law enforcers is very important to realize the principle of the rule of law. Bureaucratic reform and the implementation of a code of ethics for law enforcers are essential steps in creating an environment that is more transparent and responsible for the legal needs of society. By carrying out this reform, it is hoped that law enforcement can become more consistent, fair and clear. Through consistent, fair and clear law enforcement, it is hoped that Indonesian society can move from dependence on the law out of fear, towards obedience based on a deep understanding of the importance of the law in maintaining order and social justice. This is a crucial step in building a society that truly obeys the law, with belief in the principles of justice championed by the legal system.

Political ethics As a result, those who want a government that is fair and based on ethical values have a lot to learn from what happened. The goal is that they can create peace by upholding the values of justice. The research method used is the library method. If resistance is not based on proper moral and ethical principles, it will lead to uncertainty. Its power will inevitably collapse, especially if the leader does not instill moral values. Therefore, good rulers are those who create happiness rather than the opposite. The legislative body is in charge of making or drafting laws.

Democracy is an important component in state life, originating from the Ancient Greek words, namely demos and kratos. Democracy means absolute rule by the people, and means a government where all the people are governed by their representatives. The principle of democracy in the constitutional law system is an important foundation in building a fair, just and civilized society. The principle of democracy ensures active participation of all citizens in the formation and implementation of laws. In the context of constitutional law, this means the separation of powers between the executive, legislative and judiciary, as well as an effective monitoring mechanism for each branch of power. The principle of checks and balances is key in preventing abuse of power and ensuring that decisions taken reflect the interests of society at large. Democratic principles encourage inclusion and fair representation in legal drafting. Indonesia is a democratic country that has a strong constitutional framework, stipulated in the 1945 Constitution. Unfortunately, Indonesia is still classified as a country that is "flawed" in democracy due to several shortcomings in implementing that democracy. Keywords: , ,

The constitution in a country, including Indonesia, is the source and basis making rules that have main principles, such as the rights and obligations of citizens. Human rigidity is the basis inherent in men as a gift from God, while the rights and obligations of citizens are a gift from the state. These are both concepts included in the second amendment to the 1945 Constitution, and cannot even be separated from each other because the two have a close relationship. The rights and obligations of citizens are an essential requirement of state legal democracy and must be implemented by people or citizens. Therefore, conceptual and strategic steps are needed so that the life of the nation and state becomes correct and fair under the auspices of the laws of a democratic country.

The civil law and common law systems are two primary approaches in global legal systems, each with unique principles, histories, and applications. Civil law, widely implemented in most European countries and those influenced by the Roman system, is based on the systematic codification of written laws. The main sources of this law are legal codes and legislation issued by legislative bodies. Judges interpret the law by referring to the established legal texts. On the other hand, common law developed in England and subsequently influenced countries that were once British colonies, such as the United States and Australia. This system emphasizes legal precedents set by judges' decisions in previous cases. Its principle is the doctrine of stare decisis, which means respecting previous decisions when similar cases arise in court. Key differences between them include the way laws are formed, the role of judges, and the approach to evidence. Civil law tends to be more structured and based on legislation, whereas common law is more flexible, relying on case interpretations to form the law. Nonetheless, globalization has led to the adoption of elements from both systems in other countries, creating hybrid or mixed systems in modern legal practice.

Development is one way to create people's welfare. Therefore, the results of development must be able to be enjoyed by all people as a form of increasing physical and spiritual welfare in a fair and equitable manner. To stimulate economic growth and focus investment policies, the government is aggressively creating Special Economic Zones (KEK) in various regions. It is hoped that people can feel the maximum benefits. Batam City has a strategic location, one of which is Rempang Island which has a lot of potential that can be developed, both in the tourism, economic and social sectors. However, there are misunderstandings between local communities and the government, giving rise to quite serious conflicts due to territorial struggles. So there is a need for efforts to protect the rights of people affected by the clearing of land for investment purposes on Rempang Island, Batam, which can be done with preventive efforts, repressive efforts or prosecution efforts. So this research uses normative juridical research methods, namely focusing on the analysis of doctrine, norms and the application of certain legal principles in dealing with certain legal subjects. With a statutory regulation approach and conceptualization method, it uses technical analysis of legal materials to solve frozen problems.
