The provisions of the 1945 Constitution Article 1 paragraph (3) "The State of Indonesia is a State of Law". In addition to being a state of law, Indonesia is also a democratic state. In the concept of democracy, the government of a country is a government of the people, by the people, and for the people (principle of democracy). One of the important moments for the state of Indonesia to adopt a democratic system is the implementation of elections. Elections are also a means to encourage accountability and public control over the state, direct elections will make prospective leaders in the election contest do various ways to attract public sympathy to be able to vote for them. Even with methods that violate the constitution are also carried out. As is often the case in society during the election period, namely money politics . Legal regulations related to money politics in Law no. 7 of 2017 concerning elections include several special articles that prohibit the practice of money politics, but legal loopholes in election regulations include unclear definitions and ambiguous exceptions. Law enforcement against the practice of money politics in Indonesia still faces many challenges. This study uses a library study method supported by relevant research. The results of the study show that the root of the problem of the emergence of money politics is the existence of legal loopholes, weak supervision and a proportional election system that opens up opportunities for the development of money politics. The problem of money politics needs to be analyzed to obtain an effective strategy in preventing it. Money politics is not in accordance with the principles of democratic theory which demands freedom and justice. Elections are said to be fair if all people have the same right to choose leaders by not violating the rule of law.

The principle of democracy and justice in general election (electoral justice) is that community involvement is absolute. General elections are a means of people’s sovereignty which is carried out directly, generally, freely, secretly, honestly and fairly and must meet the principles as referred to in Law Number 7 of 2017 concerning elections. The main problemsin the results of this research are: (1) How to realize clean, democratic and digfinified legislative elections, from the perspective of Constitutional Law? (2) Will there be money politics in the implementation of the 2024 elections, and what is the role of Bawaslu in handling these problems?. This research is a normative legal research, supported by empirical legal research, so that the data sources used are secondary data sources, primary data sources. Secondary data sources are obtained through literature, laws, and other literature, and supported by primary data obtained from findings in the field. Data are analyzed descriptively-qualitatively. The results of this study indicate that: (1) The implementation of clean and democratic general elections according to Constitutional Law in East Nusa Tenggara uses independent independence, functional independence, personal independence, and the principle of equality. (2) The role of Bawaslu in handling political money actions in East Nusa Tenggara seems to be still very minimal due to the welfare factor of the community which is still far from good standards so that it is still very difficult to report perpetrators of political money. Suggestions: (1) The public should be more vigilant against prospective leaders who do not have a sense of responsibility by buying votes. (2) The government should be more assertive in its level of supervision so that prospective leaders who engage in political corruption (money politics) should be crossed off the list of prospective political participants.

The fourth principle of Pancasila, “Democracy guided by the inner wisdom of deliberation/ representation,” serves as the foundation of Indonesia’s democratic system. The values of democraty, deliberation, wisdom, and representation reflect the unique characteristics of Pancasila democracy, distinguishing it from other democratic systems. This article aims to analyze the transformation of these vaules in Indonesia’s democratic life, both in governance and society. This research uses a qualitative method with a descriptive-analytical approach through literature reviews, legal regulations, and observations of Indonesia’s democratic pratices. The findings reveal that the implementation of the fourth mechanisms such as elections and representative institutions. However, challelnges such as corruption, money politics, low public participation, and a lack of Pancasila education remain significant obstacles. Public enthusiasm for government bonds is high due to the view that such investments are considered more saving and promising. In 1950 the government issued ORI with interest of 3% per year, but the bonds failed to pay because the government at that time did not have enough money so that many investors holding bonds as Government Debt Instruments experienced losses. In this research, a juridical analysis of the position of the parties in Government Debt Instruments (SUN) was carried out and an analysis of the form of legal protection for holders of Government Debt Instruments (SUN) in the risk of default provided by the government. The research method used in writing this law is normative juridical, with a statutory approach. There are findings that installments of principal and interest on state debt securities will be included as expenditure items in the APBN each year. In the event that the risk of default does not sever the civil relationship between the SUN Issuer and the SUN holder as an Investor in a civil relationship, investors who suffer losses based on their civil rights can file a lawsuit for default due to the risk of default.
