IURAN BPJS KESEHATAN MENURUT SYARIAT ISLAM

This research aims to analyze the law on BPJS Health contributions from the perspective of Islamic law. The main issues discussed in this research are: 1) Differences in opinions of ulama regarding the law on BPJS Health contributions, 2) BPJS Health practices which are contrary to Islamic law, 3) Questionnaire survey regarding the understanding of the Islamic community regarding the law on using BPJS Health. The methods used in this research are qualitative and quantitative research methods with literature and questionnaire research types. These data were obtained from research on scientific papers, research articles relevant to BPJS Health Contributions according to Islamic Sharia as a reference for solving the problems to be researched. The research results show that the government has attempted to implement a social security-based insurance program which is now being developed into BPJS Health. This is an effort to improve the welfare of the people by helping them face risks or threats to someone's life. Where people's health is a basic need that must be met by the state by providing medicines, adequate health services and facilitating access to health. BPJS Health contributions are an amount of money that must be paid by someone who is registered as a BPJS Health participant to obtain health services. According to the author, the Islamic law perspective on the Health Social Security Administering Agency (BPJS) in Indonesia which has the principle of social insurance is not appropriate because it can cause harm, namely contribution costs that are still too high and there are fines for late payment of contributions. In practice, BPJS health still contains elements of maisir, gharar and usury which are contrary to Islamic law.
